C.,Pankah Kumar\n\nHon'ble Arun Tandon,J.\n<\/pre>\n<p>Learned counsel for the petitioner is directed to implead U.P.<br \/>\nSecondary Education Services Selection Board, Allahabad<br \/>\nthrough its Secretary as respondent no.5 during the course<br \/>\nof the day. A copy of the writ petition may be served upon<br \/>\nSri A.K. Yadav, Advocate who represents the Board today.\n<\/p>\n<p>Learned Standing Counsel represents respondent nos. 1 to\n<\/p>\n<p>3. Sri R.K. Ojha and Sri Pankaj Kumar, Advocate have<br \/>\naccepted notice on behalf of respondent no.4. Respondents<br \/>\nare granted time upto 27th July, 2010 to file counter affidavit.\n<\/p>\n<p>List this matter on 27th July, 2010.\n<\/p>\n<p>Respondent no.4 is working as Principal in petitioners&#8217;<br \/>\ninstitution, namely, Azad Hind Intermediate College, Karhal,<br \/>\nMainpuri. Against him disciplinary proceedings were initiated<br \/>\nwhich resulted in a resolution of the Committee of<br \/>\nManagement proposing punishment of dismissal from<br \/>\nservice. Papers in that regard have been transmitted to the<br \/>\nU.P. Secondary Education Services Selection Board through<br \/>\nthe office of the District Inspector of Schools on 23rd March,<br \/>\n2009. The board has not taken any decision thereto till date.<br \/>\nHowever, he was placed under suspension during this<br \/>\nperiod. The matter came up before this Court in Civil Misc.<br \/>\nWrit Petition No. 63995 of 2009. The writ Court vide order<br \/>\ndated 25th November, 2009 disposed of the writ petition<br \/>\nobserving that it would be appropriate that the matter with<br \/>\nregard to the proposed punishment may be examined by the<br \/>\nU.P. Secondary Education Services Selection Board within<br \/>\nthree months from the production of the certified copy of the<br \/>\norder. More than 7 months have elapsed since then. Since<br \/>\nthe respondent no.4 was continuing in the office, the<br \/>\nCommittee of Management noticed certain serious<br \/>\nirregularities on his part and proceeded to suspend him<br \/>\nagain vide resolution dated 17th April, 2010. A copy of the<br \/>\n resolution along with attending documents were forwarded<br \/>\nto the District Inspector of Schools for necessary approval<br \/>\nunder Section 16 G (7) of the U.P. Intermediate Education<br \/>\nAct. The District Inspector of Schools has rejected the<br \/>\nproposal submitted by the Committee of Management on the<br \/>\nground that it is not accompanied with the required<br \/>\ndocuments as also on the ground that it is in the interest of<br \/>\njustice to await the order of the U.P. Secondary Education<br \/>\nServices Selection Board in the matter of punishment<br \/>\nproposed earlier. This order as well as the order of the<br \/>\nDistrict Inspector of Schools dated 5th May, 2010, whereby<br \/>\nthe District Inspector of Schools has restrained the<br \/>\nCommittee of Management from entering into the institution<br \/>\nhave been challenged by means of the present writ petition.\n<\/p>\n<p>Learned counsel for the petitioner vehementally contended<br \/>\nthat all documents were forwarded to the District Inspector of<br \/>\nSchools as required under Regulation 39 of Chapter III of<br \/>\nthe Regulations framed under the U.P. Intermediate<br \/>\nEducation Act, 1921. Therefore, the order impugned is<br \/>\npatently illegal. He further submits that no Management can<br \/>\nbe restrained from entering into the institution by the District<br \/>\nInspector of Schools. If any complaint is made by the<br \/>\nPrincipal qua misbehaviour with him by Management, he<br \/>\nhas the liberty to either lodge a First Information Report or<br \/>\nto recommend action in accordance with the provisions of<br \/>\nU.P. Intermediate Education Act. However, the District<br \/>\nInspector of School has no power to pass ex parte order<br \/>\nrestraining the Management from entering into the<br \/>\ninstitution. He further contends that respondent no.4 has<br \/>\ntaken law in his own hand and he has not complied with the<br \/>\norder of the Management requiring him to produce the<br \/>\ndocuments asked for.\n<\/p>\n<p>Sri R.K. Ojha, learned counsel for respondent no.4 disputes<br \/>\nthe correctness of the charges levelled against respondent<br \/>\nno.4 as well as the allegation that all the papers as required<br \/>\nwere not submitted along with the order of suspension.\n<\/p>\n<p>This Court will examine the legality of the order disapproving<br \/>\nthe suspension after affidavits are exchanged.\n<\/p>\n<p>The U.P. Secondary Education Services Selection Board<br \/>\nmust conclude the proceedings by the next date fixed in<br \/>\naccordance with law, and inform the Court of the decision so<br \/>\ntaken on the papers transmitted.\n<\/p>\n<p> So far as the order of the District Inspector of Schools dated<br \/>\n5th May, 2010 is concerned, this Court is of the firm opinion<br \/>\nthat such order prima facie cannot be sustained, it has the<br \/>\naffect of restraining the employers from entering into their<br \/>\ninstitution. Consequently, the operation of the order of the<br \/>\nDistrict Inspector of Schools dated 5th May, 2010 shall<br \/>\nremain stayed. It is further directed that Principal of the<br \/>\ninstitution shall deposit all the records asked for by the<br \/>\nCommittee of Management of the institution with the District<br \/>\nInspector of Schools who shall permit the inspection thereof<br \/>\nto the Committee of Management on or before 19th July,<br \/>\n2010.\n<\/p>\n<p>It goes without saying that the Principal of the institution is<br \/>\nexpected to attend the institution on its scheduled time and<br \/>\nshould not reach the institution late, as it will lead to<br \/>\nindiscipline in the institution.\n<\/p>\n<p>                                            (Arun Tandon, J.)<\/p>\n<p>Order Date :- 8.7.2010<br \/>\nSushil\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court C\/M Of Azad Hind Inter College vs State Of U.P.
