PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\nLeave granted<br \/>\n     This appeal  by special  leave arises from the order of<br \/>\nthe Division  Bench of\tthe Calcutta  High  Court,  made  on<br \/>\nNovember 29,1996  in G.A.  No.3616\/96. We  decline to  go to<br \/>\ninto the  merits of the matter. Suffice it to interfere with<br \/>\nthe order of the learned single judge appointing a Receiver.<br \/>\nWhen the  matter was  mentioned in the Chief Court for early<br \/>\nhearing, this  Court passed  an order  on December  4,\t1996<br \/>\nthus|<br \/>\n     &#8220;Permission to  make the Receiver a<br \/>\n     party  respondent\tgranted.  Notice<br \/>\n     will  go  to  the\tReceiver.  Dasti<br \/>\n     service permitted.\t There\twill  be<br \/>\n     an-interim\t order\t directing   the<br \/>\n     Receiver  not   to\t part  with  the<br \/>\n     possession\t of   the  premises   to<br \/>\n     anyone till  further  orders.  List<br \/>\n     the matter on 18.12.1996.&#8221;\n<\/p>\n<p>    Parties  have  filed  their\t respective  affidavits\t and<br \/>\ncounter-affidavits. In\tthe affidavit filed on behalf of the<br \/>\nappellants,  they   pointed  out   certain  changes  in\t the<br \/>\ncircumstances on  the basis  of which  Shri Dipankar  Gupta,<br \/>\nlearned senior\tcounsel, sought\t to content  that there is a<br \/>\nMemo of understanding before the BIFR in which one O.P. Mall<br \/>\nand Associates\tundertook to revive the sick industry of the<br \/>\ndefendant-tenant. If  the said agency is permitted to revive<br \/>\nthe sick industry to work under the direction and control of<br \/>\nthe Receiver,  it  may\tnot  cause  any\t impediment  to\t the<br \/>\ninterest of  the respondent-landlord.  The  said  stand\t was<br \/>\ndisputed  by   the  learned   counsel  appearing   for\t the<br \/>\nrespondent. In that view of the matter, we think that it may<br \/>\nnot be\tdesirable at  this stage to go into the question. It<br \/>\nwould be  open to  the parties\tto place the entire material<br \/>\nbefore the  Division Bench which would go into the matter on<br \/>\nmerits and decide according to law.\n<\/p>\n<p>    In\tview of\t the fact  that the  industry requires to be<br \/>\nrevived, we think that it would be expedient that the appeal<br \/>\npending\t before\t  the  Division\t  Bench\t  is   disposed\t  of<br \/>\nexpeditiously. Accordingly,  we request\t the  learned  Chief<br \/>\nJustice to  direct G.A. No. 3616\/96 and the connected Appeal<br \/>\nAPOT No.626\/96\tto be  posted  before  appropriate  Division<br \/>\nBench for  final disposal preferably on any date between 6th<br \/>\nJanuary, 1997 and 9th January, 1997.\n<\/p>\n<p>   The appeal is accordingly disposed of.
