Petitioners in this application        have prayed for<br \/>\nquashing the order dated 23.4.2008 passed by the Sub Judge, Dhanbad, in<br \/>\nTitle Suit no.278 of 2001 whereby the learned court below has refused to<br \/>\nallow the petitioners for marking certified copy of the sale deed no 8242<br \/>\ndated 21\/5\/19958 produced by the respondents, as an Exhibit.\n<\/p>\n<p>                   Heard the counsel for the           petitioners and the<br \/>\nrespondents.\n<\/p>\n<p>                   It is submitted on behalf of    the petitioners that the<br \/>\nlearned court below without assigning reasons has refused the petitioners&#8217;<br \/>\nprayer for introduction of the document which was initially produced by<br \/>\nthe respondents\/plaintiffs themselves and on           which the petitioner<br \/>\ndefendants would also rely. The same could have been accepted in<br \/>\nevidence and marked as Exhibit in the case, on admission.\n<\/p>\n<p>                   Learned counsel for the respondents on the other hand,<br \/>\nsubmits that the respondents would have no objection to the document<br \/>\nbeing introduced in evidence, but the learned counsel would point out,<br \/>\nthat the observation in the impugned order of the court below would<br \/>\nindicate that the attempt on the part of the petitioners\/defendants to<br \/>\nintroduce the document was made at a belated stage when arguments in<br \/>\nthe case were to be finally concluded.\n<\/p>\n<p>                   From the facts and circumstances of the case, as also<br \/>\nfrom the impugned order, it appears that the court below wanted<br \/>\nexpeditious disposal of the case and on such consideration, it disallowed<br \/>\nthe prayer of the petitioners for introduction of the document. But by<br \/>\ndoing so, the &#8216;expeditious disposal&#8217; has been further delayed by the<br \/>\npendency of this writ petition for almost one year .\n<\/p>\n<p><span class=\"hidden_text\">                                       2<\/span><\/p>\n<p>                    Be that as it may, the impugned order of the court<br \/>\nbelow is set aside with a direction to the court below to allow the prayer<br \/>\nof the petitioners for introduction of the document\/ sale deed, on the<br \/>\ncondition that the petitioners\/defendants shall deposit a cost of Rupees<br \/>\nfive thousand within ten days from the date of this order and on such<br \/>\ndeposit, the introduction of the document shall be accepted in evidence on<br \/>\nbehalf of the petitioner.\n<\/p>\n<p>                    The trial court shall also ensure that the trial is<br \/>\nconcluded within a period of two months from the date of introduction of<br \/>\nthe document in evidence.\n<\/p>\n<p>                    With the above observation, this application is disposed<br \/>\nof.\n<\/p>\n<pre>Ambastha\/                                          (D.G.R.
