RAMKUMAR, J.\n                .........................................\n                        B.A. No.319 of 2011\n               ..........................................\n             Dated this the 25th day of January, 2011\n\n                                   ORDER\n<\/pre>\n<p>     Petitioners, who are         accused Nos.1 to 4 in Crime<\/p>\n<p>No.3240\/2010 of Kottarakkara Police Station for offences<\/p>\n<p>punishable under Sections 323,324,326,447 and 427 read with<\/p>\n<p>34 I.P.C., seek anticipatory bail.\n<\/p>\n<p>     2.    The    learned      Public    Prosecutor      opposed   the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated     2-12-2010       of the Apex Court      in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra<\/p>\n<p>and Others<\/a>      (2010(4) KLT 930),           I am of     the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer       has not had         the advantage of<\/p>\n<p>interrogating the petitioners.        But at the same time, I am<\/p>\n<p>inclined to permit the petitioners to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>have their application for bail considered by the Magistrate or<\/p>\n<p><span class=\"hidden_text\">B.A. No. 319\/2011                 -:2:-<\/span><\/p>\n<p>the Court       having jurisdiction.    Accordingly, the petitioners<\/p>\n<p>shall surrender before the investigating officer on 7.02.2011 or<\/p>\n<p>on 08.02.2011 for the purpose of interrogation and recovery<\/p>\n<p>of incriminating material,      if any.   In case the investigating<\/p>\n<p>officer is of the view that having regard to the facts of the case<\/p>\n<p>arrest of the     petitioners is imperative he shall record      his<\/p>\n<p>reasons for the arrest in the case-diary           as insisted    in<\/p>\n<p>paragraph 129        of Siddharam Satlingappa Mhetre&#8217;s case<\/p>\n<p>(supra). The petitioners shall thereafter be produced before the<\/p>\n<p>Magistrate or the Court concerned and permitted to file an<\/p>\n<p>application for regular bail on the same day or the next day.    In<\/p>\n<p>case the interrogation of the petitioners are without arresting<\/p>\n<p>them,     the    petitioners shall   thereafter appear before the<\/p>\n<p>Magistrate or the Court concerned        and apply for regular bail.<\/p>\n<p>The Magistrate        or the Court on being satisfied that      the<\/p>\n<p>petitioners have been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well,         consider and dispose of<\/p>\n<p>their application for regular bail preferably on the same<\/p>\n<p>date on which it is filed.\n<\/p>\n<p>      In case the petitioners while surrendering before the<\/p>\n<p>Investigating Officer have deprived        the investigating officer<\/p>\n<p><span class=\"hidden_text\">B.A. No. 319\/2011                   -:3:-<\/span><\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect            to the Magistrate or the<\/p>\n<p>Court concerned.
