The claimant is seeking for enhancement\u00e9of  ii: ., ..
\nthis appeal, not being satisfied with the judgrnexiit
\n25.07.2005 passed in MVC No. 2606;’iigioosiibyi’ivi.LxcT{ii1i;..jBagalkcit.
\nThe facts in a nutshell are as follows:g___i4_?” in 0 it 0 It in<\/p>\n
2. On 05.06.2002, the   to her house<\/p>\n
after attending a marriage ceiremonvy _at_ l\\i\/iiuttalageri village and<\/p>\n
when she C<':l.l'I'1'\u20ac"'1~"L!lAl\u20ac.A:5|l:'   ii'*fiitha1;Sutagundi a motorcycle
\nbearing No.Kh_28 1'}  Girisagar side dashed against
\nthe claimant onllaccount  accident, she is stated to have
\n "rightleg and injuries all over the body on<\/p>\n
acco_u'nt"*'o.f :yvhich.pVii'she was admitted to the district hospital,<\/p>\n
Bvagallrotihandvivhavs. treatment and she claims that she had<\/p>\n
l\ufb02becorne permanently disabled. On account of the said injuries<\/p>\n
4: she preferred a claim petition before the MACT-III,<\/p>\n
 MVC No. 260 of 2003 claiming compensation. On<\/p>\n
  '  registering the claim, notice was issued to the respondents and the<\/p>\n
,4?\n<\/p>\n

produced allowed the petition in part and awarded a total<\/p>\n
compensation of Rs.33,500\/ — under the following heads:<\/p>\n
\nTowards pain and sufferings  V<\/p>\n
Towards medical expenses Rs. “3 <\/p>\n
Towards disability        V<\/p>\n
Towards attendant and diet charges   if Rsi”2pA,.(}~C)yO;\/-”
\nTowards loss of earning during treatxncritp
\nTotal  _    RSI svsisciop
\nIt is this award which is  alssailed..in~ this’_appeal.<\/p>\n
3. We have hearld;.le’arried gce.un’sel”a.ppe_a:ring for the parties.<\/p>\n
It is contended  the appellant that the
\nTribunal erred’ igfllinotl  compensation towards loss of
\nfuture incloinep  clairriant was carrying on agricultural
\nopera’titonisl:.aiid  to the family and on account of<\/p>\n
injuries .sus’tained lifnvgthe accident she is not able to do any work<\/p>\n
 thus\u00bb..r1ot_able’j’..to contribute to family. As such she is required<\/p>\n
be-\u00bb.compen\\sated under the heading loss of future income. He<\/p>\n
  submit that the amounts awarded by the Tribunal<\/p>\n
 the various heads is abysmally low considering the nature of<\/p>\n

accordingly seeks for enhancement of the award.<\/p>\n
4. Per contra learned counsel for the insurance eompeany<\/p>\n
viz., respondent No.2 would contend that the claimant <\/p>\n
produced any evidence to establish the fact that sheAi_:was’-l.earninig  <\/p>\n
and the Tribunal has taking into consideration all  <\/p>\n
placed before it and has awarded the compensationiirhich justii\ufb01<\/p>\n
and reasonable and does not calliiiii’e’for anyiiie-nhancengient and
\naccordingly seeks for dismissal thyei.app’ca_l_i<\/p>\n
5. Having heard\ufb01evarnedli’counsel._”appe’arign\u00bbg for the parties,<\/p>\n
the only issue thatlia;i-jsgegsiiifor consideration is as follows:
\n“Whether  judigment’  award of the Tribunal requires<\/p>\n
togbe modified\/’enhanced  if so, to what extent?”<\/p>\n
_.6i. record both oral and documentary are<\/p>\n
lad”-reconsidered andi:-eiappreciated by us while considering the claim<\/p>\n
enhanceriilent. It is seen from the judgment and award of the<\/p>\n
 it has accepted that claimant was carrying on<\/p>\n
‘fagricultiural operations and erroneously does not award any<\/p>\n
amount towards loss of future income though pleaded. it is seen<\/p>\n
that even assuming that the claimant is to be considereVd”..tas._a<\/p>\n
housewife as per the dictum of Latha Wadhwa’s case  .<\/p>\n
AIR 2001 so 3218, the probable income that ca.–r’1”be::*:aI{e:n’–into’ \u00bb <\/p>\n
consideration would be Rs.3,000\/- and the.xevid,e.r1.ce’-  the<\/p>\n
medicai evidence on record establishes tiizait” thee.’c1’a_irriant_V\u00a7has <\/p>\n
suffered disability to the extent of  accepting the
\nsaid evidence of the doctor,   is taken
\nat 25%. The loss of iVncomeAAVV_thf’at.V  at would be
\nRs.’?50\/- [1\/4 of  compensation is
\ncomputed. The .i.bei’r\u00a71g’iRs.750\/-, the total
\ncompensation ret:1uireidVgt.oi’bie would be Rs. 1, 17,000\/ — i.e.,
\n125.750 x 12 x is and  awarded.\n<\/p>\n
7.  a’I’ribun’a].__V”havir1g considered the evidence of the<\/p>\n
claimantsand the evidence of the doctor and examining the medical<\/p>\n
 prescripti-o_n.s\/ w.h’ic”h are marked as Ex.P9 to PS1 has awarded<\/p>\n
 sum of Rs.1C3′,O0Cii’\/ ~ towards pain and suffering which requires to<\/p>\n
i if  Crnmodi\ufb01ed by awarding a sum of Rs.30.,OO0\/– under<\/p>\n
 ._’me headingiipain and suffering. Accordingly, it is awarded.<\/p>\n
 ‘ , .\n<\/p>\n<\/p>\n
8. We have perused the judgment and award passed by the<\/p>\n
court below. It is seen_ that at paragraph 11 of the award <\/p>\n
accepts that the medical bills produced by the <\/p>\n
Rs.24,146\/– and awards compensation of Rs.12,000\/Q:”i\u00ab.e}i:.i.SO9\/o of’  i <\/p>\n
the bills and reason for not accepting the b_iyl4lsj;in._ <\/p>\n
ground that doctor who tendered evidence hasrzot been confronted.  L’<\/p>\n
with the medical bills. This reasoning:ac’cording.toas isziperverse
\nand erroneous and requires toa’b.e  we do
\nso. The Tribunal having accepted in the
\nbills produced, particularly   along with the<\/p>\n
prescriptions, weiiare-of  .o4pi’nvi,or1–. the amount claimed by<\/p>\n
the claimantivtowardsiimediical’\u00abbillns, Rs.25,000\/– has to be awarded<\/p>\n
and accordingly we do so;  it<\/p>\n
9. Considering” the nature of injury by scrutinising the
\neyidence   ._c1octor”andi perusing the disability certi\ufb01cate-<\/p>\n
 {ware opinion that a sum of Rs.20,000\/– has to be<\/p>\n
‘ iVi’gaWardedA towards’Vis:l’os}:s of amenities. It is opined by the doctor who<\/p>\n
_hfi_seixamined \u00abas that there has been mal union of right tibia at<\/p>\n
junction of upper 1\/: and lower 3\/4 with varus angulation<\/p>\n
*5’ ‘<\/p>\n
of 25\u00b0 and accordingly he has given the disability certi\ufb01cate. In
\nview of the said medical evidence on record, a sum of Rs.20’,”0OO\/~<\/p>\n
is awarded towards loss of amenities.\n<\/p>\n
10. In so far as the nourishment, dietvcharges  it<\/p>\n
charges, a sum of Rs.10,000\/~ is required “be lawnarded <\/p>\n
circumstances of the case considering the” number of<\/p>\n
hospitalisation being 86 days as Ao.bus:erVed_. by.’ the._ApTH1fi\u00a7bt1nal in
\nparagraph 12 and accordingly :ia..st1rn3fbO.f \/~ is awarded<\/p>\n
towards nourishment and attendant chaiigesf. .t it ” it<\/p>\n
11.  was hospitalised for a period of
\n86 days i.e., from15.08.i2dfi2:_’toil’:11.2002 as per Ex.P13 and for
\nthe said  a it\/– is awarded as loss of income
\nperiod. Iri\ufb02allia total compensation of Rs.2,08,000\/–
\nis   the following order is passed:\n<\/p>\n
(i)A  The  is allowed in part.\n<\/p>\n
  {ii)_  judgment and award of the Tribunal is modified by<\/p>\n
 awarding total compensation of Rs.2,08,000\/- under<\/p>\n
the heads referred to above which amount shall carry<\/p>\n
