HARI RANI, JJ.\n             -------------------------------------------------\n                  W.P.(Cri) No. 314 of 2009-S\n             -------------------------------------------------\n          Dated this the 11th day of August, 2009\n\n                             JUDGMENT\n<\/pre>\n<p>Basant,J.\n<\/p>\n<\/p>\n<p>     The petitioner &#8211; a person aged about 60 years, has come<\/p>\n<p>to this Court with this petition for issue of a writ of habeas<\/p>\n<p>corpus to search for, trace and produce his daughter Ms.<\/p>\n<p>Remya, aged above 24 years, who has been missing from<\/p>\n<p>22\/7\/09.    The petitioner apprehended that his daughter was<\/p>\n<p>illegally detained by the 4th respondent herein.<\/p>\n<p>     2. This writ petition was filed on 4\/8\/09. It was admitted<\/p>\n<p>on 5\/8\/09.     Notice was ordered to the respondents and the<\/p>\n<p>case was posted to this date.\n<\/p>\n<p>     3.    Today, when the case is called, the petitioner is<\/p>\n<p>present along with his wife. His counsel is also present. The<\/p>\n<p>3rd respondent has appeared before this Court. The alleged<\/p>\n<p>W.P.(Cri) No. 314 of 2009-S<br \/>\n<span class=\"hidden_text\">                               -: 2 :-<\/span><\/p>\n<p>detenue Ms. Remya is also present.\n<\/p>\n<p>      4. As the alleged detenue was coming from the custody of<\/p>\n<p>the 4th respondent, we permitted her to remain in the Chamber<\/p>\n<p>without being influenced by any one.    Of course, the petitioner<\/p>\n<p>and his wife were permitted to have interactions with the alleged<\/p>\n<p>detenue.\n<\/p>\n<p>      5.   We met the alleged detenue after lunch recess and<\/p>\n<p>interacted with her. She stated before us that she is aged about<\/p>\n<p>25 years &#8211; she having been born on 19\/10\/84. She is a Teacher<\/p>\n<p>and was employed at A.J. Central School, Kazhakoottam. She<\/p>\n<p>has B.Sc. and B.Ed. degrees. According to her, she has married<\/p>\n<p>the 4th respondent in accordance with the Hindu religious rites<\/p>\n<p>on 1\/8\/09 at Sree Bhadradevi Temple, Kodimarathin Moodu.       A<\/p>\n<p>certificate of marriage issued by the Local Registrar of Hindu<\/p>\n<p>Marriages, Pallickal Grama Panchayat is produced to confirm<\/p>\n<p>such marriage.\n<\/p>\n<p>      6. The alleged detenue Ms.Remya has asserted before us<\/p>\n<p>that the 4th respondent is her legally wedded husband and that<\/p>\n<p>she is not under illegal confinement or detention of any one. In<\/p>\n<p>W.P.(Cri) No. 314 of 2009-S<br \/>\n<span class=\"hidden_text\">                                -: 3 :-<\/span><\/p>\n<p>response to a specific query put by this Court, Ms. Remya stated<\/p>\n<p>that she wants to leave this Court along with her husband &#8211; the<\/p>\n<p>4th respondent.\n<\/p>\n<p>      7.   We interacted with all concerned and their counsel<\/p>\n<p>including the learned Government Pleader in the Chamber.<\/p>\n<p>Though attempts were made to induce the parties to come to a<\/p>\n<p>harmonious settlement, we find that such attempts are not<\/p>\n<p>successful today.   It is hoped that the parties shall be able to<\/p>\n<p>settle their disputes in the near future.<\/p>\n<p>      8. The 4th respondent is present before Court and has filed<\/p>\n<p>a counter affidavit.     Along with that a marriage certificate<\/p>\n<p>referred to above has been produced.<\/p>\n<p>      9. We are satisfied that the alleged detenue Ms. Remya is<\/p>\n<p>not under the illegal confinement or detention of any one. The<\/p>\n<p>learned Government Pleader reports that Ms. Remya was traced<\/p>\n<p>by the police and was produced before the learned Magistrate<\/p>\n<p>having jurisdiction and accepting her statement, the learned<\/p>\n<p>Magistrate had allowed her to go with the 4th respondent.<\/p>\n<p>      10.   We are,    in these circumstances, satisfied that no<\/p>\n<p>W.P.(Cri) No. 314 of 2009-S<br \/>\n<span class=\"hidden_text\">                              -: 4 :-<\/span><\/p>\n<p>further directions are necessary in this writ petition. This writ<\/p>\n<p>petition is accordingly dismissed and the alleged detenue Ms.<\/p>\n<p>Remya is permitted to go along with her husband &#8211; the 4th<\/p>\n<p>respondent from this Court as desired by her.<\/p>\n<p>                                            Sd\/-\n<\/p>\n<p>                                         R.
