herein is  “\ufb01led -‘the complaint under Section
\n338 of  elleging that on 10.1 1.2001, the
\naecused “1Z4}~.\u00a7)’31’V1TkZ)’i.3\\?'{‘:(1″V1(V3\u00a3a.;t_;.’l V(V’_’$2f  1T3,090\/– and has assured to repay
\n  the repayment of the said loan, he<\/p>\n
iss\ufb01ezf{we pe9$’%.ve1eied–:”cheques on 10.132001 drawn on Mysore<\/p>\n
T’ 2   Ce\ufb01pexa\ufb01ve Bank and when the accused did next<\/p>\n
”  jzhe ieani,’ the cheques were presented by the complainant<\/p>\n
  ‘i;'<1\u00a3:3r_\\&f\u00abere I'6t1}.I"H\u20acd unpaid with an endorsement of insu\ufb01icient<\/p>\n
 Immediately, thereafter the complainant issued a notice to<\/p>\n
 f.he.Vaccused and though the notice was served, the accused did not<\/p>\n
S repay the same or reply the no\ufb01ee. In the circumstances, the<\/p>\n
complainant approached the Trial Court for taking actiern against<\/p>\n

marked documents Exs.P.1  ,  of the accused

4. The 1:rial”courtp’V:1 Aa;\u00a7f)i*eeia\ufb01on of the materials on me-:)n:l,
\n  ‘under Section 138 of Negotiable<\/p>\n
ieeiruniente’Ae\u00a3;’a\ufb01d—.ordered to pay \ufb01ne of Rs.25,00()\/- and to<\/p>\n
 e.._J1;nderg’0. Si1m1\u00a71e’.V-ijga\ufb01ixveisenment for six months and from the said<\/p>\n
 xto pay Rs.24,()OG\/– to the complainant under<\/p>\n
.1   RC. Aggrieved by the conviction and sentence, the<\/p>\n
 epproached the Sessions Court in Criminal appeal<\/p>\n
 ‘   2006 and the sale” appeai came to be dismissed on merits.<\/p>\n

Court in zevision.\n<\/p>\n

\norder is: illegal and perverse, this  in
\nappreciate the material on record: \u20ac31}  he <\/p>\n
for dismissal of the pe\ufb01tion.\n<\/p>\n
8. The complainant   and his evidence
\nzeveais about the E9311 pf  request by the
\naccused for payzygeegt   and he further
\nstates that  10.11.2001 and the two
\ncheques “v:\u00e9::s;6,’500\/~ each were given. He
\nfurther stat;es  teat   of the cheques they were<\/p>\n
returned   endo1jee1ne\ufb01;t of insumcient funds and thereafter,<\/p>\n
liiew   :”j1’1:)_tice Ex.P.5 by Registered post. In the<\/p>\n
cimz1’m.s’aa11ees;’V there was a busiaess transaction and these<\/p>\n
9. 9W.1 in his evi\u00e9enee states that the cheques issued were
\nnot towards payment of any debt, but were in respect of the<\/p>\n
payment towards the purchase of raw silk from the complainant<\/p>\n

accused, having given four cheques;–ve_f6r. the silk ‘biufasixievseddis with V<\/p>\n
regard to the purchase of  vcd;:Lii:11VVe_:’aveis._.’:et12’i’:1ed ‘es it was<\/p>\n
defective. But he admits in  that they have
\nget the documents   ‘efdefective silk. These
\ndocuments are    \ufb01dtforth by the accused
\nin the    of evidence cf Dive. 1
\nand 2 has : been  by Way of repiy to notice at
\nEx.P.5. Furyhereiete; flee.  of the eroswexamination of PWK1<\/p>\n
   eheqdee ‘iS3’ii\u20acd at Exs.P. 1 and 9.2 do get relate to<\/p>\n

 e,..A__VVaeeused. dijn  E;x.S.2 and Exs.D.2a and 11213 refers to a<\/p>\n
tefaeeaetiee cf Aehedeomplainant and payment of cash. If really, any<\/p>\n
 ehecguee were issued by the accused pertaining to the<\/p>\n

Wedidddhave secured the presence of bank of\ufb01eiais regardizrxg to<\/p>\n
 the payment in cash in pursuance of the cheques. Apart<\/p>\n
from this, it is relevant to note that the dates of the cheques have<\/p>\n
met been disclosed in the document produced in 3325.2. A<\/p>\n
