NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition is filed against the order<br \/>\nof the\tOrissa Administrative  Tribunal at Cuttack passed on<br \/>\nDecember 6, 1996, in Transfer Application No.610\/87.\n<\/p>\n<p>     Admittedly, the  petitioner, while working as Lecturer,<br \/>\nhad appeared  in competitive examination and was selected to<br \/>\nthe Orissa  Administrative Service. As Orissa Administrative<br \/>\nService, Class-II,  his\t scale\tof  pay\t was  Rs.525-1150\/-.<br \/>\nEarlier, also  when he\tworked as Lecturer, the scale of pay<br \/>\nwas Rs.525-1150\/-  which was  subsequently  revised  by\t the<br \/>\nUniversity Grants Commission w.e.f. April 1, 1974 to Rs.700-<br \/>\n1600\/-. In  that pay  scale, his pay fixed at Rs.780. He was<br \/>\npaid  arrears  of  salary  with\t retrospective\teffect\tfrom<br \/>\n1.1.1974. After\t he was selected and appointed to the Orissa<br \/>\nAdministrative Service,\t he sought  protection of  his\tlast<br \/>\ndrawn pay  and his  upgraded fitment in the pay scale in the<br \/>\nOrissa Administrative Service. The Tribunal has rejected the<br \/>\nclaim. Thus this special leave petition.\n<\/p>\n<p>     Shri Janaranjan  Das, learned counsel appearing for the<br \/>\npetitioner, contends  that since  the  petitioner  had\tbeen<br \/>\ngiven the pay scale with retrospective effect from 1.1.1974,<br \/>\non his appointment to the Orissa Administrative Service, his<br \/>\nlast drawn pay need to be protected. As per the instructions<br \/>\nof the\tAccountant General,  his pay is entitled to be fixed<br \/>\nat Rs.780\/-  in the  pay scale\tin  the\t service  of  Orissa<br \/>\nAdministrative Service.\t We find no force in the contention.<br \/>\nThe service  as a  Lecturer is\tentirely different  from the<br \/>\nservice of the Orissa Administrative Service. Merely because<br \/>\nhe happened to work earlier as a Lecture and in the same pay<br \/>\nscale which was subsequently revised, he cannot be permitted<br \/>\nto have\t the benefit  of U.G.C.\t scale in the Administrative<br \/>\nService and  fitment in\t the pay-scale\ton that\t basis. That<br \/>\nwould create  imbalance and  gross infraction and distortion<br \/>\nand would  result in  flood of\tclaims of similarly situated<br \/>\npersons under  Article 39(d) of the Consitution.
