With\u00a0the\u00a0consent\u00a0of\u00a0the\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0parties\u00a0<br \/>\nthe\u00a0matter\u00a0is\u00a0heard\u00a0finally.\n<\/p>\n<p>       In \u00a0 this \u00a0 writ \u00a0 petition \u00a0 which \u00a0 has \u00a0 been \u00a0 filed \u00a0 as \u00a0 a \u00a0 public\u00a0<br \/>\ninterest\u00a0 litigation, \u00a0 the \u00a0 petitioner \u00a0 has \u00a0 assailed\u00a0 the \u00a0legality \u00a0 and\u00a0<br \/>\nvalidity\u00a0of\u00a0the\u00a0order\u00a0dated\u00a022\u00ad02\u00ad2010\u00a0contained\u00a0in\u00a0Annexure\u00ad<br \/>\nP\/5,\u00a0passed\u00a0by\u00a0the\u00a0Collector,\u00a0Tikamgarh.\n<\/p>\n<p>       The \u00a0 facts \u00a0 leading \u00a0 to \u00a0 filing \u00a0 of \u00a0 the \u00a0 writ \u00a0 petition, \u00a0 briefly\u00a0<br \/>\nstated,\u00a0are\u00a0that\u00a0the\u00a0petitioner\u00a0is\u00a0a\u00a0society\u00a0registered\u00a0under\u00a0the\u00a0<br \/>\nprovisions\u00a0of\u00a0M.P.\u00a0Societies\u00a0Registrikaran\u00a0Adhiniyam,\u00a01973.\u00a0\u00a0The\u00a0<br \/>\nCollector \u00a0 vide \u00a0 order \u00a0 dated \u00a0 22\u00ad02\u00ad2010 \u00a0 has \u00a0 directed \u00a0 that\u00a0<br \/>\nwholesale \u00a0 dealers \u00a0 after \u00a0 taking \u00a0 delivery \u00a0 of \u00a0 kerosene \u00a0 oil \u00a0 from\u00a0<br \/>\nGwalior \u00a0 Depot, \u00a0 would \u00a0 come \u00a0 to \u00a0 District \u00a0 Headquarter, \u00a0 i.e.,\u00a0<br \/>\nTikamgarh \u00a0 and \u00a0 shall \u00a0 get \u00a0 kerosene \u00a0 oil \u00a0 tankers \u00a0 verified \u00a0 by \u00a0 the\u00a0<br \/>\nInspection \u00a0 Committee \u00a0 and \u00a0 shall \u00a0inform \u00a0 the \u00a0 Committee \u00a0 as\u00a0 to\u00a0<br \/>\nwhere\u00a0the\u00a0kerosene\u00a0oils\u00a0has\u00a0to\u00a0be\u00a0supplied.\u00a0\u00a0The\u00a0petitioner\u00a0has\u00a0<br \/>\nalleged \u00a0 in \u00a0 the \u00a0 writ \u00a0 petition \u00a0 that \u00a0 by \u00a0 adopting \u00a0 the \u00a0 aforesaid\u00a0<br \/>\nprocess\u00a0the\u00a0price\u00a0of\u00a0kerosene\u00a0oil\u00a0would\u00a0be\u00a0increased\u00a0by\u00a015\u00a0paise\u00a0<br \/>\nto\u00a016\u00a0paise\u00a0per\u00a0liter,\u00a0which\u00a0would\u00a0not\u00a0be\u00a0in\u00a0the\u00a0public\u00a0interest\u00a0<br \/>\nand\u00a0would\u00a0cause\u00a0great\u00a0hardships\u00a0to\u00a0the\u00a0weaker\u00a0sections\u00a0of\u00a0the\u00a0<br \/>\n community.\n<\/p>\n<p>       Learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioner\u00a0contended\u00a0that\u00a0if\u00a0the\u00a0<br \/>\norder\u00a0dated\u00a022\u00ad02\u00ad2010\u00a0(Annexure\u00adP\/5)\u00a0is\u00a0required\u00a0to\u00a0be\u00a0carried\u00a0<br \/>\nout\u00a0by\u00a0the\u00a0wholesale\u00a0dealers\u00a0the\u00a0same\u00a0will\u00a0give\u00a0rise\u00a0to\u00a0hike\u00a0in\u00a0<br \/>\nthe \u00a0 price \u00a0 of \u00a0 kerosene \u00a0 oil \u00a0 which \u00a0 would \u00a0 ultimately \u00a0 affect \u00a0 the\u00a0<br \/>\nweaker\u00a0sections\u00a0of\u00a0the\u00a0society.\u00a0\u00a0It\u00a0was\u00a0further\u00a0submitted\u00a0by\u00a0him\u00a0<br \/>\nthat\u00a0initially\u00a0also,\u00a0vide\u00a0Annexure\u00adP\/3,\u00a0dated\u00a028\u00ad10\u00ad2009,\u00a0at\u00a0the\u00a0<br \/>\nblock\u00a0level\u00a0verification\u00a0of\u00a0kerosene\u00a0oil\u00a0tankers\u00a0was\u00a0being\u00a0made\u00a0<br \/>\nby \u00a0 the \u00a0 Assistant \u00a0 Supply \u00a0 Officer\/Junior \u00a0 Supply \u00a0 Officer \u00a0 and,\u00a0<br \/>\ntherefore, \u00a0 there \u00a0 was \u00a0 no \u00a0 need \u00a0 to \u00a0 pass \u00a0 the \u00a0 impugned \u00a0 order\u00a0<br \/>\n(Annexure\u00adP\/5).\n<\/p>\n<p>       On\u00a0the\u00a0other\u00a0hand,\u00a0learned\u00a0Additional\u00a0Advocate\u00a0General\u00a0<br \/>\nwhile \u00a0 opposing \u00a0 the \u00a0 submissions \u00a0 advanced \u00a0 by \u00a0 the \u00a0 learned\u00a0<br \/>\ncounsel \u00a0 for \u00a0 the \u00a0 petitioner \u00a0 submitted \u00a0 that \u00a0 the \u00a0 order \u00a0 dated\u00a0<br \/>\n22\u00ad02\u00ad2010, \u00a0 Annexure\u00adP\/5, \u00a0 \u00a0 has \u00a0 been \u00a0 passed \u00a0 with \u00a0 a \u00a0 view \u00a0 to\u00a0<br \/>\ncheck \u00a0 the \u00a0 menace \u00a0 of \u00a0 black\u00admarketing \u00a0 and \u00a0 to \u00a0 ensure \u00a0 that\u00a0<br \/>\nkerosene\u00a0oil\u00a0is\u00a0distributed\u00a0to\u00a0the\u00a0weaker\u00a0sections\u00a0of\u00a0the\u00a0society\u00a0<br \/>\nin\u00a0proper\u00a0quantity.\u00a0It\u00a0has\u00a0further\u00a0been\u00a0stated\u00a0that\u00a0there\u00a0would\u00a0<br \/>\nbe\u00a0a\u00a0nominal\u00a0hike\u00a0of\u00a06\u00a0paise\u00a0per\u00a0liter\u00a0in\u00a0Jatara\u00a0and\u00a0Palera\u00a0Blocks\u00a0<br \/>\nand\u00a016\u00a0paise\u00a0per\u00a0liter\u00a0in\u00a0Prithvipur\u00a0ad\u00a0Niwari\u00a0blocks,\u00a0\u00a0however,\u00a0<br \/>\nthe\u00a0order\u00a0has\u00a0been\u00a0passed\u00a0by\u00a0the\u00a0Collector\u00a0to\u00a0avoid\u00a0the\u00a0menace\u00a0<br \/>\nof \u00a0 black\u00admarketing \u00a0 and \u00a0 adulteration. \u00a0 \u00a0 It \u00a0 has \u00a0 been \u00a0 further\u00a0<br \/>\nsubmitted \u00a0 that \u00a0 the \u00a0 decision \u00a0 has \u00a0 been \u00a0 taken \u00a0 in \u00a0 the \u00a0 public\u00a0<br \/>\ninterest.\u00a0\u00a0It\u00a0is\u00a0further\u00a0submitted\u00a0that\u00a0in\u00a0the\u00a0instant\u00a0writ\u00a0petition\u00a0<br \/>\nno\u00a0element\u00a0of\u00a0public\u00a0interest\u00a0is\u00a0involved\u00a0and\u00a0the\u00a0same\u00a0appears\u00a0<br \/>\nto\u00a0be\u00a0sponsored\u00a0at\u00a0the\u00a0instance\u00a0of\u00a0wholesale\u00a0dealers.\n<\/p>\n<p>       We\u00a0have\u00a0considered\u00a0the\u00a0submissions\u00a0made\u00a0by\u00a0both\u00a0sides.\n<\/p>\n<p>       From\u00a0perusal\u00a0of\u00a0the\u00a0impugned\u00a0order,\u00a0Annexure\u00adP\/5,\u00a0it\u00a0is\u00a0<br \/>\napparent \u00a0 that \u00a0 the \u00a0 aforesaid \u00a0 order \u00a0 has \u00a0 been \u00a0 passed \u00a0 with \u00a0 the\u00a0<br \/>\n       object\u00a0to\u00a0strengthen\u00a0the\u00a0public\u00a0distribution\u00a0system.\u00a0 \u00a0Whether\u00a0<br \/>\n      the\u00a0verification\u00a0of\u00a0kerosene\u00a0oil\u00a0tankers\u00a0should\u00a0be\u00a0done\u00a0at\u00a0the\u00a0<br \/>\n      district \u00a0 level \u00a0 or \u00a0 at \u00a0 the \u00a0 block \u00a0 level, \u00a0 is \u00a0 within \u00a0 the \u00a0 realm \u00a0 and\u00a0<br \/>\n      discretion\u00a0of\u00a0the\u00a0district\u00a0authorities\u00a0and\u00a0this\u00a0Court,\u00a0in\u00a0exercise\u00a0<br \/>\n      of\u00a0power\u00a0under\u00a0Article\u00a0226\u00a0of\u00a0the\u00a0Constitution\u00a0of\u00a0India,\u00a0cannot\u00a0<br \/>\n      interfere\u00a0with\u00a0the\u00a0same,\u00a0until\u00a0and\u00a0unless\u00a0the\u00a0decision\u00a0is\u00a0shown\u00a0<br \/>\n      to\u00a0be\u00a0capricious\u00a0or\u00a0arbitrary.\n<\/p>\n<p>               From\u00a0perusal\u00a0of\u00a0the\u00a0order\u00adimpugned\u00a0in\u00a0the\u00a0instant\u00a0writ\u00a0<br \/>\n      petition\u00a0and\u00a0for\u00a0the\u00a0reasons\u00a0assigned\u00a0in\u00a0support\u00a0of\u00a0the\u00a0order\u00a0<br \/>\n      passed\u00a0by\u00a0the\u00a0respondents,\u00a0we\u00a0find\u00a0that\u00a0the\u00a0Collector\u00a0has\u00a0taken\u00a0<br \/>\n      a \u00a0 decision \u00a0 for \u00a0 verification \u00a0 of \u00a0 kerosene \u00a0 oil \u00a0 tankers \u00a0 by \u00a0 the\u00a0<br \/>\n      Inspection\u00a0Committee\u00a0at\u00a0the\u00a0District\u00a0Headquarter,\u00a0with\u00a0a\u00a0view\u00a0<br \/>\n      to \u00a0 prevent \u00a0 the \u00a0 menace \u00a0 of \u00a0 black\u00admarketing \u00a0 and \u00a0 adulteration.\u00a0<br \/>\n      The \u00a0 order \u00a0 cannot \u00a0 be \u00a0 termed \u00a0 as \u00a0 arbitrary \u00a0 or \u00a0 capricious.\u00a0<br \/>\n      Therefore,\u00a0we\u00a0do\u00a0not\u00a0find\u00a0any\u00a0reason\u00a0to\u00a0interfere\u00a0with\u00a0the\u00a0order\u00a0<br \/>\n      passed\u00a0by\u00a0the\u00a0Collector.\u00a0\u00a0Under\u00a0the\u00a0impugned\u00a0order,\u00a0wholesale\u00a0<br \/>\n      dealers \u00a0 of \u00a0 kerosene \u00a0 oil \u00a0 have \u00a0 to \u00a0 get \u00a0 the \u00a0 kerosene \u00a0 oil \u00a0 tankers\u00a0<br \/>\n      verified\u00a0by\u00a0the\u00a0inspection\u00a0committee.\u00a0\u00a0Therefore,\u00a0we\u00a0are\u00a0of\u00a0the\u00a0<br \/>\n      opinion, \u00a0 that \u00a0 the \u00a0 instant \u00a0 writ \u00a0 petition \u00a0 appears \u00a0 to \u00a0 be \u00a0 a\u00a0<br \/>\n      sponsored\u00a0litigation\u00a0at\u00a0the\u00a0instance\u00a0of\u00a0wholesale\u00a0dealers\u00a0and\u00a0it\u00a0<br \/>\n      is\u00a0not\u00a0a\u00a0genuine\u00a0and\u00a0bonafide\u00a0public\u00a0interest\u00a0litigation.\n<\/p>\n<p>               For\u00a0the\u00a0aforementioned\u00a0reasons,\u00a0the\u00a0writ\u00a0petition,\u00a0being\u00a0<br \/>\n      misconceived, \u00a0 is \u00a0 dismissed \u00a0 with \u00a0 cost, \u00a0 which \u00a0 we \u00a0 quantify \u00a0 at\u00a0<br \/>\n      Rs.10,000\/\u00ad\u00a0(rupees\u00a0ten\u00a0thousand)\u00a0only.\n<\/p>\n<pre>      \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(S.R.Alam)    \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0(Alok\u00a0Aradhe)\n      \u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0Chief\u00a0Justice
