Justice V.GIRI\n\n Dated :23\/11\/2007\n\n O R D E R\n                             V.GIRI,J.\n                       -------------------------\n                  W.P ( C) No. 34546 of 2007\n                      --------------------------\n            Dated this the 23rd November, 2007\n\n                        J U D G M E N T\n<\/pre>\n<p>     The petitioner who retired from service           from the<\/p>\n<p>Department of Health Services on 30.11.2001 is aggrieved by<\/p>\n<p>Exhibit-P6 order issued by the Government, wherein it accorded<\/p>\n<p>sanction to the Director of Health Services to proceed against<\/p>\n<p>the petitioner for recovery of Rs.89,182\/- stated to be the<\/p>\n<p>pecuniary    loss sustained by the Government         under the<\/p>\n<p>provisions of the Public Accountants Act, 1963.<\/p>\n<p>     2.   According to the petitioner, the order is passed<\/p>\n<p>without notice to him. Though he had sought for a personal<\/p>\n<p>hearing, the same was not granted.\n<\/p>\n<p>     3.   In my view, the petitioner has a right to object to any<\/p>\n<p>demand that is made under the Public Accountants Act, 1963,<\/p>\n<p>when the demand is made as such. Exhibit-P6 only accords<\/p>\n<p>sanction to the competent authority to raise a demand under the<\/p>\n<p>Public Accountants Act.\n<\/p>\n<p>     Learned Government Pleader brings to my notice Sub<\/p>\n<p>section 3 (3) of the said Act which provides that if the Public<\/p>\n<p>Accountant does not satisfy the demand, but appears and objects<\/p>\n<p>W.P ( C) No. 34546 of 2007<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>to the claim wholly or in part, the Collector shall enquire into the<\/p>\n<p>matter and record a decision. Obviously, if the petitioner objects<\/p>\n<p>to the demand, the procedure under Sub Section 3 (3) will have<\/p>\n<p>to be followed.\n<\/p>\n<p>      In the result, it is made clear that enforcement of the<\/p>\n<p>demand, if any raised pursuant to Exhibit-P6 can only be after<\/p>\n<p>following the procedure which is mentioned under Sub section<\/p>\n<p>3 (3) of the said Act.
