Respondents are charged of disobeying the<br \/>\norders passed by this court dated 23.3.93 and having<br \/>\ncommitted contempt. Whether they are guilty is the<br \/>\nquestion.\n<\/p>\n<p>2. Petitioner, a registered society filed writ<br \/>\npetition (CWP No. 1657\/93) for restraining R-2 from<br \/>\nhanding over any part of the Asiad Village Complex<br \/>\n including leasing out of the Asiad tower and areas<br \/>\nappurtenant thereto to anyone. It also sought interim<br \/>\nrestraint order in CM No. 2675\/93 on similar lines.\n<\/p>\n<p>3. Respondents were put on notice in this petition<br \/>\non 23.3.1993 when an interim stay order was also passed<br \/>\nwhich is at the root of controversy and which is<br \/>\nreproduced hereunder for proper appreciation.\n<\/p>\n<p>  &#8220;The respondents are restrained from leasing<br \/>\nout or alienating any part of the Asiad Village<br \/>\nComplex without the permission of the court till<br \/>\nthe next date.&#8221;\n<\/p>\n<p>Petitioners allege that respondents had<br \/>\nblatantly violated this order by auctioning the Asiad<br \/>\nTower for running of a restaurant to R-3 and had thus<br \/>\ncommitted contempt of court. Their senior counsel<br \/>\nMr. K.T.S. Tulsi claimed that they had done so<br \/>\ndeliberately and willfully and they were therefore,<br \/>\nliable to be punished for contempt. He asserted that<br \/>\nAsiad Tower was very much a part of Asiad Village<br \/>\nComplex and was, therefore, covered by the terms of the<br \/>\ncourt order and in any case if respondents entertained<br \/>\nany doubt about this, they should have sought<br \/>\nclarification from this court before going ahead with<br \/>\ntheir auction plans. He cited Supreme Court judgment in<br \/>\n <a href=\"\/doc\/96186\/\">Anil Ratan Sarkar v. Hirak Ghosh<\/a>  to<br \/>\nsuggest that misunderstanding or a party&#8217;s own<br \/>\nunderstanding of the court order was not a permissible<br \/>\ndefense in a contempt action.\n<\/p>\n<p>4. Both, official and private respondents have<br \/>\nfiled their reply explaining their position. It is<br \/>\ndenied by them that they had deliberately or willfully<br \/>\ndisobeyed the court order in question. It is pointed<br \/>\nout by them that petitioner&#8217;s prayer in both the writ<br \/>\npetition and the interim stay application (CM 2675\/93)<br \/>\nwas to restrain the DDA from leasing out or alienating<br \/>\nany part of the Asiad Village Complex  including the<br \/>\nAsiad Tower and its surrounding areas which by itself<br \/>\nleft no scope for doubt that even they were regarding<br \/>\nthe Asiad Tower different from the Asiad Village Complex<br \/>\nlike its surrounding areas. Therefore since the interim<br \/>\nrestraint order specifically covered Asiad Village<br \/>\nComplex only and the prayer in respect of Asiad Tower<br \/>\nand its surrounding areas was impliedly declined. This<br \/>\nis buttressed by dismissal of petitioner&#8217;s allied CM<br \/>\nNo. 5267\/93 also on 27.11.1993 complaining of violation<br \/>\nof court order dated 23.3.1993 when the DDA had issued<br \/>\nadvertisement for auctioning of the Asiad Tower. It is<br \/>\nalso avered by them that they had taken due care to<br \/>\nascertain the legal position in the matter and had<br \/>\nsought advice from the Standing Counsel of DDA who had<br \/>\nopined on the same lines and on which basis a second<br \/>\nadvertisement notice was issued and the auction process<br \/>\nsubsequently completed which action was later affirmed<br \/>\nin CWP No. 3319\/2002 vide judgment dated 25.9.2002 and,<br \/>\ntherefore, respondents could not be charged of<br \/>\ncommitting any breach of the court order dated<br \/>\n23.3.1993.\n<\/p>\n<p>5. It requires to be made clear at the very outset<br \/>\nthat contempt power was exercisable in the interest of<br \/>\ngeneral public and to ensure that the faith and<br \/>\nconfidence in the administration of justice was not<br \/>\neroded. It was so invokable to protect and safeguard<br \/>\nthe majesty of law and the dignity of court and the<br \/>\nintegrity of the court orders and not for enabling the<br \/>\nparties to settle their personal scores or to gain an<br \/>\nupper hand or advantage in litigative spirit. A<br \/>\ncontempt of court was the matter between the court and<br \/>\nthe alleged contemner and a litigant inviting the<br \/>\nattention of the court only enjoyed the status of an<br \/>\ninformer and did not assume the role of a complainant or<br \/>\nthat of prosecutor in the contempt proceedings. He<br \/>\ncould not insist upon punishing an alleged contemner<br \/>\nirrespective of whether or not court felt satisfied<br \/>\nabout it because what was contumacious was for the court<br \/>\nto decide.\n<\/p>\n<p>6. With this preface and given regard to the facts<br \/>\nand circumstances of the case, it does not appear to us<br \/>\nthat respondents had willfully or deliberately disobeyed<br \/>\ncourt order dated 23.3.1993 restraining them from<br \/>\nalienating any part of the Asiad Village Complex. This<br \/>\nis so because petitioner&#8217;s own prayer in the writ<br \/>\npetition and the CM was suggestive of the fact that they<br \/>\nhad treated the Asiad Tower and the surrounding areas<br \/>\ndifferently from the Asiad Village Complex and since the<br \/>\nrestraint order covered only the Asiad Village Complex.<br \/>\nRespondents could not be held responsible for dealing<br \/>\nwith the Asiad Tower.\n<\/p>\n<p>7. Apart from this, this court had already<br \/>\ndismissed petitioner&#8217;s alleged CM No. 5267\/93 on the<br \/>\nissue affirming the action of DDA which was also<br \/>\nsupported later by the judgment in CWP No. 3319\/2002<br \/>\nfiled by one V.P. Singh. Regard being had to all this it<br \/>\ncould not be said that respondents had deliberately or<br \/>\nwillfully disobeyed the court in question. Because even<br \/>\nif it was assumed that the Asiad Tower formed a part of<br \/>\nthe Asiad complex, they had taken sufficient precaution<br \/>\nto seek legal advice and had evolved the requisite<br \/>\nunderstanding of the court order on the strength of<br \/>\norders passed by this court in petitioners allied CM<br \/>\n5267\/93 and also CWP No. 3319\/2002.\n<\/p>\n<p>8. The legal position enunciated in the Supreme<br \/>\nCourt judgment cited at the Bar does not persuade us to<br \/>\ntake any contrary view in the matter because the court<br \/>\nhad held the contemners guilty in the peculiar facts and<br \/>\ncircumstances of the case and after finding that the<br \/>\ncontemner had deliberately avoided the implementation of<br \/>\nthe court order. The court found:-\n<\/p>\n<p> &#8220;The defense of understanding is not only<br \/>\nmoonshine but a deliberate attempt to overreach<br \/>\nthis court&#8217;s order and as such willfulness in the<br \/>\nmatter of disregard of this court&#8217;s order is<br \/>\napparent on the face of it and we are not prepared<br \/>\nto accept the same as a defense of an action for<br \/>\ndeliberate and willful disregard of an order of the<br \/>\ncourt. We find that the actions on the part of<br \/>\nthe respondent authorities are not only<br \/>\nunreasonable but deliberate and spiteful and that<br \/>\ntoo in spite of a specific direction in all the<br \/>\nfive judgments so far obtained by the petitioners<br \/>\nin their favor. Avoidance is written large and<br \/>\nit would be difficult for us to consume the same<br \/>\nwithout any particular rhyme or reason.&#8221;\n<\/p>\n<p>9. Therefore, even going by the terms of this<br \/>\njudgment, it all depended upon the facts and<br \/>\ncircumstances of each case whether the defense of<br \/>\nunderstanding of a court order put up by the contemner<br \/>\npointed out to his deliberate attempt to disregard the<br \/>\norder or whether his understanding was bonafide and<br \/>\ngenuine.\n<\/p>\n<p>10. In the present case, respondents&#8217; understanding<br \/>\nwas based on the petitioners prayer made in their writ<br \/>\npetition and stay application and also on the orders<br \/>\npassed by this court in their allied CM and judgment in<br \/>\nCWP No. 3319\/2002. They cannot be as such charged of<br \/>\nhaving set up an understanding which had no basis or<br \/>\nwhich was aimed at defeating the court order. It would<br \/>\nhave more desirable if they had sought the clarification<br \/>\nin the matter but once their action was affirmed by this<br \/>\ncourt in colateral proceedings, that should set the<br \/>\ncontroversy at rest for good.\n<\/p>\n<p>11.
