Justice K.T.SANKARAN\n\n Dated :30\/07\/2009\n\n O R D E R\n                         K.T.SANKARAN, J.\n                 ---------------------------------------------\n                        B.A.No.4162 of 2009\n                 ---------------------------------------------\n               Dated this the 30th day of July, 2009\n\n\n\n                                 ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the sole accused<\/p>\n<p>in Crime No.108 of 2009 of Ramamangalam Police Station.<\/p>\n<p>      2.  The offence alleged against the petitioner is under<\/p>\n<p>Section 302 of the Indian Penal Code.\n<\/p>\n<p>      3.   The date of occurrence was on 7.3.2009.                The<\/p>\n<p>petitioner was arrested on 8.3.2009. The petitioner filed Bail<\/p>\n<p>Application No.2622 of 2009 which was dismissed by me by the<\/p>\n<p>order dated 29th May 2009. Thereafter, the petitioner moved the<\/p>\n<p>Sessions Court for the grant of default bail under Section 167(2)<\/p>\n<p>of the Code of Criminal Procedure. The learned Sessions Judge<\/p>\n<p>rejected that prayer and dismissed the application on 29.6.2009.<\/p>\n<p>      4.   Learned counsel for the petitioner submitted that in<\/p>\n<p>this Bail Application the petitioner is not claiming any benefit<\/p>\n<p>under Section 167(2) of the Code of Criminal Procedure. The<\/p>\n<p>petitioner confines his submission on the merits of the case.<\/p>\n<p>Learned counsel for the petitioner submitted that the accused as<\/p>\n<p><span class=\"hidden_text\">BA No. 4162\/2009                 2<\/span><\/p>\n<p>well as the deceased were living together in a house. They were<\/p>\n<p>coolie workers. They belong to Tamil Nadu.<\/p>\n<p>      4.    Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the present stage of<\/p>\n<p>investigation, I am of the view that bail can be granted to the<\/p>\n<p>petitioner on stringent conditions.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p>bond for Rs.50,000\/- with two solvent sureties for the like<\/p>\n<p>amount, who shall be persons belonging to State of Kerala and<\/p>\n<p>who own immovable properties in the State of Kerala, to the<\/p>\n<p>satisfaction of the Judicial Magistrate of the First       Class-<\/p>\n<p>Kolencherry.    The sureties shall produce the title deeds in<\/p>\n<p>respect of their property before the learned Magistrate for<\/p>\n<p>perusal. The grant of bail is also subject to the following<\/p>\n<p>conditions:\n<\/p>\n<p>a)    The petitioner shall report before the investigating officer<br \/>\n      between 9 A.M. and 11 A.M. on every Sunday, Wednesday<br \/>\n      and Friday, till the final report is filed or until further<br \/>\n      orders;\n<\/p>\n<p>b)    The petitioner shall not leave the limits of Ramamangalam<br \/>\n      Police Station without the permission of Judicial Magistrate<br \/>\n      of the First Class &#8211; Kolencherry.\n<\/p>\n<p><span class=\"hidden_text\">BA No. 4162\/2009                  3<\/span><\/p>\n<p>c)   The petitioner shall appear before the investigating officer<br \/>\n     for interrogation as and when required;\n<\/p>\n<p>c)   The petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;\n<\/p>\n<p>d)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;\n<\/p>\n<p>e)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.\n<\/p>\n<p>\n     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                 JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Thobiyas vs State Of Kerala on 30 July, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4162 of 2009() 1.
