RADHAKRISHNAN, J.\n<\/p>\n<\/p>\n<p>      The respondent in the writ petition is the review petitioner.<\/p>\n<p>He was an employee of BSNL. It appears that he was surety to<\/p>\n<p>certain transactions.   The creditors moved the civil court or<\/p>\n<p>initiated proceedings under the Revenue Recovery Act, 1968.<\/p>\n<p>They obtained various restraint orders by way of injunctions or<\/p>\n<p>otherwise. The garnishee, namely, the employer of the review<\/p>\n<p>petitioner was thus bound by those orders to abstain from<\/p>\n<p>releasing even the retirement benefits. May be, those decisions<\/p>\n<p>are unsustainable. The employee, the review petitioner herein,<\/p>\n<p>moved this Court by filing a writ petition seeking reliefs. On<\/p>\n<p>BSNL being brought under the coverage of the Administrative<\/p>\n<p>Tribunals Act, 1985, the writ petition stood transferred for being<\/p>\n<p><span class=\"hidden_text\">R.P.659\/10                      2<\/span><\/p>\n<p>considered as a transferred application by the C.A.T., Ernakulam<\/p>\n<p>Bench.     With that, the consideration of the case stood<\/p>\n<p>circumscribed by the jurisdictional limits of the Tribunal under<\/p>\n<p>the Administrative Tribunals Act.     The Tribunal ordered the<\/p>\n<p>establishment to release the amounts due to the employee<\/p>\n<p>towards commuted value of pension, gratuity etc.               The<\/p>\n<p>establishment filed the writ petition before this Court. We had<\/p>\n<p>necessarily to hold that the Tribunal have over-stepped its<\/p>\n<p>jurisdiction in as much as it could not have sat in judgment over<\/p>\n<p>the correctness of the decision of the civil court or the statutory<\/p>\n<p>orders under the Revenue Recovery Act imposing injunctions or<\/p>\n<p>ordering attachment. We, therefore, issued the judgment sought<\/p>\n<p>to be reviewed.\n<\/p>\n<\/p>\n<p>      2. We heard Adv.Sri.James Fletcher on behalf of the review<\/p>\n<p>petitioner quite in extenso. He says that had the writ petition<\/p>\n<p>continued here, the matter could have been looked at differently.<\/p>\n<p>As of now, we cannot say anything as to how this Court could<\/p>\n<p>have moulded the reliefs, if possible, having regard to the<\/p>\n<p>submissions now being made. But, we find that it is beyond, for<\/p>\n<p><span class=\"hidden_text\">R.P.659\/10                        3<\/span><\/p>\n<p>us to say in the case in hand, because the writ petition stood<\/p>\n<p>transferred to the C.A.T, to be decided in terms of the<\/p>\n<p>Administrative Tribunals Act. The writ petitioner, unfortunately,<\/p>\n<p>had not persuaded this Court to exercise jurisdiction under<\/p>\n<p>Article 226 of the Constitution of India. Not only that, though<\/p>\n<p>the learned counsel very persuasively pointed out that in terms<\/p>\n<p>of the decisions of the Apex Court and this Court, the validity of<\/p>\n<p>attachments may be contrary to the statutory provisions, it is<\/p>\n<p>not within the limits of the Tribunal to have gone into that issue.<\/p>\n<p>It is either for the debtor, suffering the attachment, namely, the<\/p>\n<p>review petitioner or for the garnishee, the establishment, to seek<\/p>\n<p>relief from the attaching authorities or authorities which have<\/p>\n<p>issued injunctions. This, obviously was either the civil courts or<\/p>\n<p>the authorities under the Revenue Recovery Act.<\/p>\n<p>      3. The learned counsel for the establishment states that<\/p>\n<p>during the pendency of the writ petition before this Court, the<\/p>\n<p>establishment had moved some of the attaching courts seeking<\/p>\n<p>modification of its liabilities as garnishee and had been able to<\/p>\n<p>obtain a couple of favourable orders, though some matters are<\/p>\n<p><span class=\"hidden_text\">R.P.659\/10                     4<\/span><\/p>\n<p>still pending.\n<\/p>\n<\/p>\n<p>      In the aforesaid circumstances, we refuse to interfere the<\/p>\n<p>order sought to be reviewed. We, however, direct that if the<\/p>\n<p>review petitioner files any application before any civil court or<\/p>\n<p>any authority under the Revenue Recovery Act, to lift the<\/p>\n<p>attachment or injunction, such authority shall expeditiously take<\/p>\n<p>up the review petitioner&#8217;s request and consider it and issue<\/p>\n<p>orders in accordance with law with no delay. Review petition is<\/p>\n<p>ordered accordingly.\n<\/p>\n<\/p>\n<p>                         THOTTATHIL B.
