SIRI JAGAN, J.\n                 - - - - - - - - - - - - - - - - - - - - - - -\n                       W.P.(C)No.232 of 2005\n                 - - - - - - - - - - - - - - - - - - - - - - -\n             Dated this the 8th day of April, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>     This writ petition is filed by the management in I.D.<\/p>\n<p>No.139\/95 before the Labour Court, Kollam. Challenging<\/p>\n<p>Ext.P4 award passed by the Labour Court in that I.D. the<\/p>\n<p>issues referred for adjudication were:<\/p>\n<blockquote><p>     1.    Justifiability of the action of management in having<br \/>\n           suspended Sri. Chacko Kurian w.e.f. 4.7.1994.\n<\/p><\/blockquote>\n<blockquote><p>     2.    Reimbursement of Sri. Chacko Kurian in supervision<br \/>\n           post.\n<\/p><\/blockquote>\n<blockquote><p>     3.    Legality of the action of Management in having dismissed<br \/>\n           Sri. Chacko Kurian during the period of conciliation.<\/p><\/blockquote>\n<p>     2.    It appears that before dismissing the workman no<\/p>\n<p>enquiry was conducted. But relying on some other enquiry<\/p>\n<p>conducted in respect of some other misconduct the<\/p>\n<p>management wanted to sustain the punishment.                       The<\/p>\n<p>Labour Court found that in respect of the particular charge<\/p>\n<p>for which the workman was punished there was no enquiry<\/p>\n<p>at all, not even a show cause notice. Labour Court further<\/p>\n<p>found that at the time of dismissal of the workman involved<\/p>\n<p>W.P.(C)No.232 of 2005<br \/>\n<span class=\"hidden_text\">                                     -2-<\/span><\/p>\n<p>an industrial dispute was pending in respect of a claim of<\/p>\n<p>the workman for a supervisory post. Therefore the Labour<\/p>\n<p>Court found that the dismissal is violative of Section 33 (1)<\/p>\n<p>(b) of the I.D. Act, in so far as before imposing the<\/p>\n<p>punishment of dismissal, approval of the appropriate<\/p>\n<p>authority had not been obtained. On these grounds the<\/p>\n<p>Labour Court found that the dismissal was bad and passed<\/p>\n<p>the award on the following terms:\n<\/p>\n<blockquote><p>     1.     The dismissal of the workman from service as per order<br \/>\n            dated 20.10.1994 is set aside.\n<\/p><\/blockquote>\n<blockquote><p>     2.     The management is directed to reinstate the workman in<br \/>\n            the post of watcher\/worker in which he was working with<br \/>\n            60% of the backwages for the period in which he has<br \/>\n            been kept out of service.\n<\/p><\/blockquote>\n<blockquote><p>     3.     The workman will be entitled to continuity in service for<br \/>\n            the period in which he was kept out of service.<\/p><\/blockquote>\n<p>      3.    The management is challenging that award in this<\/p>\n<p>writ petition. According to the management, the workman<\/p>\n<p>was validly dismissed from service for misconduct.                   The<\/p>\n<p>counsel for the 2nd respondent would support the impugned<\/p>\n<p>award.\n<\/p>\n<p>      4.    I have considered the rival contentions in detail.<\/p>\n<p>W.P.(C)No.232 of 2005<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>      5.    From a reading of the award it is abundantly clear<\/p>\n<p>that, for imposing the punishment of dismissal from service<\/p>\n<p>no enquiry was conducted and the earlier enquiry was<\/p>\n<p>concluded by imposing a punishment of imposition of<\/p>\n<p>punishment of Rs.280\/-.      After having imposed such a<\/p>\n<p>punishment, the management could not have dismissed the<\/p>\n<p>workman on the same set of facts. As far as the allegations<\/p>\n<p>on which the workman was dismissed, no enquiry was<\/p>\n<p>conducted. The management could have at least adduced<\/p>\n<p>evidence before the Labour Court to prove the misconduct<\/p>\n<p>of the workman.        No attempt is seen made by the<\/p>\n<p>management in that direction also.       Added to that, the<\/p>\n<p>dismissal was effected without obtaining prior approval as<\/p>\n<p>contemplated under Section 33 (1) (b). As such I do not<\/p>\n<p>find anything wrong with the conclusion of the Labour<\/p>\n<p>Court that dismissal of the workman is unsustainable. But I<\/p>\n<p>find that, the workman had refused to join duty despite the<\/p>\n<p>management giving him an opportunity to do so, in a post<\/p>\n<p>other than the supervisory post, which has been specifically<\/p>\n<p>W.P.(C)No.232 of 2005<br \/>\n<span class=\"hidden_text\">                               -4-<\/span><\/p>\n<p>found by the Labour Court also. Taking into account, the<\/p>\n<p>entire facts and circumstances of the case, I feel that the<\/p>\n<p>award of 50% backwages is too harsh on the management.<\/p>\n<p>Accordingly I modify Ext.P4 award by limiting backwages to<\/p>\n<p>25% instead of 50%. In all other respects the award would<\/p>\n<p>stand.\n<\/p>\n<p>      The writ petition is disposed of as above.<\/p>\n<p>                                                S.
