Justice R.BASANT\n\n Dated :09\/10\/2007\n\n O R D E R\n                               R.BASANT, J\n                       ------------------------------------\n                      Crl.M.C.No.3106 of 2007\n                       -------------------------------------\n               Dated this the 9th day of October, 2007\n\n                                 O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution under Sections<\/p>\n<p>452 and 354 I.P.C. The petitioner was not enlarged on bail at the<\/p>\n<p>crime stage.     He had not appeared before the court or the<\/p>\n<p>Investigating Officer. Investigation is now complete. Final report has<\/p>\n<p>already been filed. Cognizance has been taken by the learned<\/p>\n<p>Magistrate. The petitioner has not been able to appear so far. He is<\/p>\n<p>employed abroad.     No notice or summons was ever served on the<\/p>\n<p>petitioner.  The learned Magistrate has now transferred the case<\/p>\n<p>against the petitioner to the list of Long Pending Cases.               Coercive<\/p>\n<p>processes are being issued against the petitioner. The petitioner finds<\/p>\n<p>such warrants of arrest issued by the learned Magistrate chasing him.<\/p>\n<p>      2.    According to the petitioner, he is absolutely innocent. His<\/p>\n<p>absence earlier was not wilful. The petitioner is now willing to appear<\/p>\n<p>and apply for bail and co-operate with the court for expeditious<\/p>\n<p>disposal of the case. The petitioner apprehends that his application for<\/p>\n<p>bail may not be considered by the learned Magistrate on merits, in<\/p>\n<p>accordance with law and expeditiously.               It is therefore prayed that<\/p>\n<p>directions under Section 482 Cr.P.C may be issued in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3106 of 2007            2<\/span><\/p>\n<p>      3.   It is for the petitioner to appear before the learned<\/p>\n<p>Magistrate and explain to the learned Magistrate the circumstances<\/p>\n<p>under which he could not earlier appear before the learned Magistrate.<\/p>\n<p>I have no reason to assume that the learned Magistrate would not<\/p>\n<p>consider such application on merits, in accordance with law and<\/p>\n<p>expeditiously. Every court must do the same. No special or specific<\/p>\n<p>direction appears to be necessary. Sufficient general directions have<\/p>\n<p>already been issued in <a href=\"\/doc\/147290035\/\">Alice George v. The Deputy Superintendent<\/p>\n<p>of Police<\/a> [2003(1) KLT 339].\n<\/p>\n<p>      4.
