Justice PIUS C.KURIAKOSE\n\n Dated :15\/01\/2007\n\n O R D E R\n                       PIUS C.KURIAKOSE, J.\n\n                      ----------------------------------\n\n                    W.P.(C)NO. 1557   of    2007\n\n                      ----------------------------------\n\n               Dated this 15th day of  January, 2007\n\n\n\n\n                               JUDGMENT\n<\/pre>\n<p>      Sri.Johnson   P.John,   the   learned   Standing   Counsel   takes<\/p>\n<p>notice for the respondent Corporation.<\/p>\n<p>      2.  This writ petition has been filed by a retired Mechanic of<\/p>\n<p>the KSRTC seeking out of turn   release of his retiral benefits on<\/p>\n<p>the ground that the marriage of his daughter, Sandhya has  to be<\/p>\n<p>conducted   on   11.4.2007.   According   to   him   unless   the   retiral<\/p>\n<p>benefits are released, it will  be very difficult for him to conduct<\/p>\n<p>the marriage.\n<\/p>\n<\/p>\n<p>      3.   The   learned   Standing   Counsel   submits   that   guidelines<\/p>\n<p>which have been formulated on the basis of the judgment  of this<\/p>\n<p>court   in     W.A.   No.   289\/2001   are   to   be   followed.     But,<\/p>\n<p>Sri.K.P.Rajeevan,   the   learned   counsel   for   the   petitioner   invites<\/p>\n<p>my attention to the judgment of a Division Bench of this court in<\/p>\n<p>W.A.   No.1775\/2004   and   submits   that   notwithstanding   the<\/p>\n<p>scheme   which   is   framed   as   per   the   judgment   in   W.A.<\/p>\n<p>No.289\/2001 there is justification for deviating from the seniority<\/p>\n<p><span class=\"hidden_text\">WPC No.1557\/2007                        2<\/span><\/p>\n<p>to meet urgent necessities like   marriages of the children of the<\/p>\n<p>employees.   The   learned     counsel   further   submits   that   the<\/p>\n<p>petitioner   has   no   other   source   of   income   from   which   amounts<\/p>\n<p>can be raised for conducting marriage.\n<\/p>\n<\/p>\n<p>       4.
