Justice K.M.JOSEPH\n\n Dated :22\/02\/2008\n\n O R D E R\n                               H.L.DATTU, C.J.   &amp;   K.M.JOSEPH, J.\n\n                                    ------------------------------------------\n\n                                             W.P.(C) No.5146 of 2008\n\n                                    ------------------------------------------\n\n                           Dated, this the   22nd day of February,  2008\n\n\n                                            JUDGMENT\n<\/pre>\n<p>H.L.Dattu, C.J.\n<\/p>\n<p>         First   petitioner   is   the   authorised   dealer   and   stockist     of   M\/s.Surya<\/p>\n<p>Petroleum   Private   Limited   under   the   name   and   style     &#8216;Aswathy  Gas   Agency&#8217;.\n<\/p>\n<p>Second petitioner  is  the  wife of  the  first  petitioner.    It  appears  that  they have<\/p>\n<p>two   children.     In   this   petition   filed   under   Article   226   of   the   Constitution,   the<\/p>\n<p>petitioners   allege   that   the   4th  respondent   is   harassing   them   by   unnecessarily<\/p>\n<p>calling   them   to   the   police   station   and   unnecessarily   interfering   with   their<\/p>\n<p>business activity.             Therefore,  the  petitioners   are  before  this  Court  for  the<\/p>\n<p>following directions:\n<\/p>\n<blockquote><p>                   &#8220;i. Issue a writ in the nature of mandamus or any other<\/p>\n<p>          appropriate writ, direction  or order directing  the 4th  respondent<\/p>\n<p>          to forbear from interfering with the business of the petitioner in<\/p>\n<p>          supplying and distributing gas cylinders;<\/p>\n<\/blockquote>\n<blockquote><p>                   ii) issue a writ in the nature of mandamus  or any other<\/p>\n<p>          appropriate   writ,   direction   or   order   directing   the   respondent   4<\/p>\n<p>          not to launch any criminal prosecution against the 1st  petitioner<\/p>\n<p>          for   doing   the   supply   of   gas   cylinders   and   not   to   harass   the<\/p>\n<p>          petitioners   and   their   workers   and   their   family   by   inflicting<\/p>\n<p>          unforeseen offences;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>                   iii.   Issue   such   other   writ,   direction   or   order   as   this<\/p>\n<p>          Hon&#8217;ble court may deem fit and proper in the circumstances of<\/p>\n<p>          this case;    and<\/p>\n<p>                   iv. Award costs of the petitioners in these proceedings&#8221;<\/p>\n<\/blockquote>\n<p>W.P.(C) No.5146 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                              2<\/span><\/p>\n<p>            (2)   The   Circle   Inspector   of   Police,   Mala,     who   is   arrayed   as   the   third<\/p>\n<p>respondent,  has filed a detailed counter affidavit and in that has brought to our<\/p>\n<p>notice that certain criminal cases are pending against the first petitioner and it is<\/p>\n<p>only for the purpose of investigation that the petitioner  was called to the police<\/p>\n<p>station.\n<\/p>\n<p>            (3)  In view of the statement made by the third respondent in the counter<\/p>\n<p>affidavit,   in   our   opinion,   at   this   stage,   it   would   suffice   if   we   only   direct<\/p>\n<p>respondents 1 to 3 not to harass the petitioner unnecessarily.
