SHAH\n\t\t\t\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\tAll<br \/>\nthese applications have been preferred by the applicant-The New India<br \/>\nAssurance Company Ltd.  to stay further implementation, execution and<br \/>\noperation of the impugned orders passed by the learned tribunal,<br \/>\nwhich are subject matter of the main First Appeals.\n<\/p>\n<p>2.\tHaving<br \/>\nheard Shri Salil Thakor, learned advocate appearing for Ms. Megha<br \/>\nJani, learned advocate appearing on behalf of the applicant, Shri<br \/>\nPoojara, learned advocate appearing on behalf of the original<br \/>\nclaimants and Shri Sandeep Patel, learned advocate appearing on<br \/>\nbehalf of respondents nos. 2 and 3 in Civil Application No.<br \/>\n14495\/2010 and considering the defense on behalf of the applicant<br \/>\nthat the respective persons were travelling in the goods vehicle and,<br \/>\ntherefore, the appellant-The New India Assurance Company Ltd. is to<br \/>\nbe exonerated, by way of interim order it is directed that during<br \/>\npendency and final disposal of the main First Appeals there shall be<br \/>\nstay of the common judgment and award passed by the learned Motor<br \/>\nAccident Claims Tribunal (Auxiliary) Dhrangadhra in M.A.C.P. Nos.<br \/>\n575\/1998, 573\/1998, 630\/1998 and M.A.C.P. No. 725\/1998.\n<\/p>\n<p>3.\tWith<br \/>\nthis, the present application is allowed.  Rule is made absolute to<br \/>\nthe aforesaid extent.
