     This petition under Art.226 of the Constitution is filed by<\/p>\n
the petitioner arraying 13 respondents with a prayer that the<\/p>\n
investigation into a crime allegedly committed by the 12th<\/p>\n
respondent may be entrusted to the C.B.I.                The petitioner<\/p>\n
does not even specify the number and details of the crime<\/p>\n
which he wants to be so entrusted for investigation to the<\/p>\n
C.B.I.\n<\/p>\n
     2. The petitioner explains his interest in the case in the<\/p>\n
following words in para-19:\n<\/p>\n
                 “19. The writ petitioner is a law-<\/p>\n
           abiding Indian citizen and a firm believer<\/p>\n
           in rule of law. Each citizen of India has<\/p>\n
           a bounden duty to prevent the illegality<\/p>\n
           and violation of law and to respect and<\/p>\n
           obey the legal system and its procedure.<\/p>\n<\/blockquote>\n

           In the circumstances, the petitioner is left<\/p>\n
           no other equally efficacious remedy than to<\/p>\n
           approach this Honourable Court under<\/p>\n
           Art.226 of the Constitution of India.”\n<\/p>\n<\/p>\n
      3. This petition has been perused by me in detail.     The<\/p>\n
petitioner has been heard.    The learned Public Prosecutor was<\/p>\n
asked to take notice.    The learned Public Prosecutor furnishes<\/p>\n
the following details:\n<\/p>\n
      On the complaint given by a specified individual\/depositor,<\/p>\n
Crime No.480\/08 of the Medical College Police Station,<\/p>\n
Trivandrum, has been registered against, inter alia, the 12th<\/p>\n
respondent.    It is alleged in that crime that the offence under<\/p>\n
Sec.420 read with Sec.34 IPC has been committed. The crux of<\/p>\n
the allegations is that the de facto complainant\/depositor was<\/p>\n
defrauded by the accused persons. Investigation is in progress.<\/p>\n
According to the learned Public Prosecutor, the crime was<\/p>\n
registered on 27\/8\/08.      Considering the seriousness of the<\/p>\n
allegations raised, investigation has now been entrusted to the<\/p>\n
Crime Branch Police and they have taken over the investigation<\/p>\n

from 4\/9\/08. One Mr.Harinath Misra, IPS., a senior police officer<\/p>\n
who had served 7 years in the C.B.I., is carrying on the<\/p>\n
investigation now. The learned Public Prosecutor submits that a<\/p>\n
proper and efficient investigation is being conducted and at this<\/p>\n
stage there is absolutely no justification in the prayer for<\/p>\n
transfer of the investigation to the C.B.I.    The learned Public<\/p>\n
Prosecutor further submits that the petitioner has no tangible<\/p>\n
data or specific material to justify his claim for transfer of the<\/p>\n
investigation to the C.B.I.  The petitioner has not even cared to<\/p>\n
ascertain the vital and relevant facts and the application made by<\/p>\n
a person like him, who has no real, substantial, tangible or<\/p>\n
sublime interest in the investigation of the crime, only deserves<\/p>\n
to be rejected in limine.\n<\/p>\n
     4. I have considered all the relevant inputs. I must, at the<\/p>\n
very outset, observe that I do not intend to express any opinion<\/p>\n
on the complicity of any of the accused in that crime who have<\/p>\n
already been brought on record or who, it is alleged, at the Bar,<\/p>\n
are also involved in the commission of the crime.         But it is<\/p>\n
impossible not to observe that the petitioner has only made wide<\/p>\n

and sweeping allegations without any serious pursuit as would<\/p>\n
be expected from a public spirited individual who wants to<\/p>\n
maintain such an application before this Court. I have read the<\/p>\n
averments in the petition in detail.   I have heard the learned<\/p>\n
counsel for the petitioner.    Except the nebulous, vague and<\/p>\n
general information collected by reading the newspapers, the<\/p>\n
petitioner does not appear to have undertaken any serious effort<\/p>\n
to ascertain the details of the issues involved or justify his<\/p>\n
grievance against the investigation. He is not a depositor. He<\/p>\n
is not interested in any of the depositors.  His credentials as a<\/p>\n
public interest litigant is not even attempted to be revealed.<\/p>\n
Essentially, the allegation is one of cheating and the petitioner<\/p>\n
is not a victim of any such cheating also.   I need only observe<\/p>\n
that, at the moment and with the available inputs, I am not<\/p>\n
persuaded to invoke the extraordinary constitutional jurisdiction<\/p>\n
under Art.226 of the Constitution to issue any directions<\/p>\n
regarding investigation. I do further note that the petitioner has<\/p>\n
not chosen to move the Magistrate, if he has any specific<\/p>\n
information\/data about the inadequacy of investigation. If he is<\/p>\n

a public spirited individual interested in a proper investigation,<\/p>\n
he must collect tangible data and share it with the Investigating<\/p>\n
Officers and if he has not satisfied that, they are not interested<\/p>\n
in pursuing the details furnished by him, he must certainly<\/p>\n
approach the Magistrate and complain about the inadequate<\/p>\n
investigation as already held by the Supreme Court in Sakiri<\/p>\n
Vasu v. State of U.P.<\/a> (2008 (1) KLT 724 (SC)) which has been<\/p>\n
followed by the decision in Vasanthi Devi v. S.I. of Police<\/a><\/p>\n
(2008 (1) KLT 945).           I am satisfied, in the facts and<\/p>\n
circumstances of this case, that this writ petition only deserves<\/p>\n
to be dismissed. I do so.\n<\/p>\n<\/p>\n
