S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\ncounsel for the respondent &#8211; State, on instructions, submits<br \/>\nthat as the petitioners were admitted in the Dental Colleges, they<br \/>\ncould have been called for re-shuffling till the cut off date i.e.<br \/>\n30.9.2010, as was fixed by the Supreme Court. By the cut off date<br \/>\ni.e. 30.9.2010, three counselling having made, the petitioners were<br \/>\ncalled for in the third counselling.  By that time, there was no seat<br \/>\navailable.  Newly created and approved seats in the Ayurved and<br \/>\nPhysiotherapy courses were made available after 30.9.2010.  At that<br \/>\ntime, the fourth counselling was done.   As those students admitted<br \/>\nin the Ayurved and Physiotherapy courses, for them, the cut off date<br \/>\nprescribed is 31.10.2010, those persons were called for in the fourth<br \/>\ncounselling.  The petitioners could not have been called for in the<br \/>\nfourth counselling as otherwise the seat in the Dental College which<br \/>\nwould have fallen vacant if the petitioners would have taken<br \/>\nadmission in the Ayurved and Physiotherapy courses, would not have<br \/>\nbeen filled up by any other persons on the cut off date of 31.10.2010<br \/>\nhaving elapsed.  That is the reason those who were admitted in the<br \/>\nMedical and Dental Colleges  were not called for further counselling<br \/>\nafter 30.9.2010.\n<\/p>\n<p>\tThe<br \/>\nlearned counsel for the State Government prays for and is allowed a<br \/>\nweek&#8217;s time to file further affidavit in the line as orally submitted<br \/>\ntoday.\n<\/p>\n<p>\tPost<br \/>\nthe matter on 13th December, 2010.\n<\/p>\n<p>\t\t\t\t\t\t[S.J.\n<\/p>\n<p>MUKHOPADHAYA, CJ.]<\/p>\n<p>\t\t\t\t\t\t\t[K.\n<\/p>\n<p>M.
