It is submitted that the grounds for<br \/>\n\tdelay contended in the application have been duly supported by<br \/>\n\taffidavit of Under Secretary of Legal Department of the State.<br \/>\n\tMr.Pandya, further submitted that the applicant &#8211; appellant<br \/>\n\thas meritorious case, as the trial Court erred in not properly<br \/>\n\tappreciating the oral evidence adduced by the prosecution, and more<br \/>\n\tparticularly, the deposition of the prosecutrix herself, who was at<br \/>\n\tthe relevant time aged about 16 years and 4 months. It is,<br \/>\n\ttherefore, submitted that if the delay is not condoned and the<br \/>\n\tappeal is not permitted to be preferred, the applicant &#8211;<br \/>\n\tappellant &#8211; State would suffer great prejudice and its<br \/>\n\tmeritorious case shall be adversely affected.\n<\/p>\n<p>Since<br \/>\n\tMr.Pandya, learned APP, for the applicant &#8211; appellant submitted that<br \/>\n\tthere are merits in the appeal and if the delay is not condoned,<br \/>\n\tmeritorious case of the applicant &#8211; State shall be adversely<br \/>\n\taffected, and that it shall suffer prejudice, we deem it fit to<br \/>\n\texamine the merits of the case. For the said purpose, Mr.Pandya,<br \/>\n\tsupplied copies of depositions and other evidence for our perusal.<br \/>\n\tConsidering the impugned judgment and order rendered by the trial<br \/>\n\tCourt, so also the overall evidence on record, it clearly transpires<br \/>\n\tthat at the relevant time i.e. on dated, 14.11.2008 when the<br \/>\n\tincident occurred, the prosecutrix was aged about 16 years and 4<br \/>\n\tmonths and, therefore, she was not under 16 years of age. Perusing<br \/>\n\tthe deposition of the prosecutrix, PW-3, Exh.21, it is true that in<br \/>\n\ther examination-in-chief, she stated that she was forcibly kidnapped<br \/>\n\tby both the accused along with other juvenile accused and that she<br \/>\n\twas taken to different places and for more than one time, she was<br \/>\n\traped by respondent &#8211; accused No.1 Karsan Chanaji. If her<br \/>\n\tcross-examination is considered along with the evidence of the<br \/>\n\tInvestigating Police Officer, who recorded her police statement, and<br \/>\n\tas observed by the trial Court in the impugned judgment and order,<br \/>\n\tit clearly transpires that before the police, the prosecutrix had<br \/>\n\tstated that she was knowing the accused No.1 Karsan and that they<br \/>\n\twere in love. She further stated in her police statement, that on<br \/>\n\t14.11.2008, as previously understood, both herself and the accused<br \/>\n\tleft their home. It is further pertinent to note that from<br \/>\n\t14.11.2008 to 2.12.2008, she went to different places along with the<br \/>\n\taccused and they stayed together in different guest houses, and that<br \/>\n\tat the place called Varmanagar, they had hired a room and they were<br \/>\n\tstaying in the room. It further transpires that as per the evidence<br \/>\n\tof the prosecutrix, on 2.12.2008, since they were without any money,<br \/>\n\tshe herself and the accused voluntarily surrendered before Palanpur<br \/>\n\tpolice. It further transpires that the parents of the prosecutrix,<br \/>\n\tnamely, PW-2 Ramchandbhai and PW-3 Lilaben were called to the police<br \/>\n\tstation, but the prosecutrix refused to go with them to her home and<br \/>\n\topted to go to Nari Sanrakshan Gruh and she actually went to Nari<br \/>\n\tSanrakshan Gruh. Further examining the deposition of the<br \/>\n\tprosecutrix, so also the evidence of Medical Officer, PW-1<br \/>\n\tDr.Bhaderu, it transpires that before the Medical Officer, the<br \/>\n\tprosecutrix gave history to the effect that she was in love with the<br \/>\n\taccused and had gone together, as mutually understood, and the<br \/>\n\tintercourse was with her consent.\n<\/p>\n<p>In<br \/>\n\tthe impugned judgment, the trial Court elaborately discussed the<br \/>\n\tabove aspect of the matter as well as considered earlier decisions<br \/>\n\tdelivered by this Court in almost identical matters. In above view<br \/>\n\tof the matter, the trial Court, ultimately, came to the conclusion<br \/>\n\tthat the prosecution failed to prove its case against the accused<br \/>\n\tbeyond any reasonable doubt. The trial Court further observed that<br \/>\n\teven regarding the exact age of the prosecutrix, there was no cogent<br \/>\n\tevidence and the consistent stand of the accused before the trial<br \/>\n\tCourt was to the effect that the prosecutrix was major. The trial<br \/>\n\tCourt, ultimately, recorded the acquittal of the accused.\n<\/p>\n<p>Considering<br \/>\n\tthe above aspect of the matter, we are of the considered opinion<br \/>\n\tthat the trial Court did not commit any error in recording the<br \/>\n\tacquittal of the accused and, therefore, no interference is<br \/>\n\twarranted in the impugned judgment and order. When such is the<br \/>\n\tsituation, we are further of the opinion that the appeal is,<br \/>\n\ttherefore, devoid of any merits. Under such circumstances, even if<br \/>\n\tthe delay would be condoned and the appeal would be admitted, no<br \/>\n\tuseful purpose would be served.
