Tamak, Advocate, for\n                 the petitioner.\n\n<\/pre>\n<p>                 Mr. Anjum Ahmad, Additional Advocate<br \/>\n                 General, Haryana, for respondent<br \/>\n                 Nos.1 and 2.\n<\/p>\n<p>                 Mr. Praveen Gupta,                 Advocate,    for<br \/>\n                 respondent No.3.\n<\/p>\n<\/p>\n<pre>                              .        .     .\n\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p>                 This civil writ petition filed under<\/p>\n<p>Article 226\/227 of the Constitution of India prays<\/p>\n<p>for   issuance   a     writ       in       the   nature   of   mandamus<\/p>\n<p>directing the respondents to allow the petitioner to<\/p>\n<p>appear in final theory papers (3rd Semester) for the<\/p>\n<p>course of Diploma in Civil Engineering of the State<\/p>\n<p>Board   Technical       Examinations              commencing    w.e.f.\n<\/p>\n<pre> CWP No.583 of 2009                                                [2]\n\n\n\n2.1.2009.\n\n<\/pre>\n<p>                      Learned counsel for the petitioner has<\/p>\n<p>contended       that       the    petitioner              took    admission        in<\/p>\n<p>Vaish      Technical              Institute,                Rohtak,           Haryana<\/p>\n<p>(respondent          No.3)        in         Diploma       Course        in    Civil<\/p>\n<p>Engineering through Central Entrance Examination of<\/p>\n<p>the Diploma in Engineering Programmes (DEP 2007).<\/p>\n<p>The    petitioner          completed          the    1st    and    2nd    Semester<\/p>\n<p>examinations          successfully.                 The      petitioner          was<\/p>\n<p>promoted to the 3rd Semester.\n<\/p>\n<p>                      In    the        3rd    Semester,          the    petitioner<\/p>\n<p>attended      the    classes           of     theory       and    practical      and<\/p>\n<p>submitted his permission -cum- admission form for<\/p>\n<p>appearing in the State Board of Technical Education<\/p>\n<p>Haryana Exam. On 19.11.2008, however, father of the<\/p>\n<p>petitioner met with an accident which resulted in<\/p>\n<p>his    death.       Due     to    consequent             circumstances,           the<\/p>\n<p>petitioner could not attend the classes thereafter.<\/p>\n<p>Death Certificate has been appended as Annexure P-3.<\/p>\n<p>The petitioner was sick in the month of September<\/p>\n<p>2008    and    therefore,          he         had   to      be    hospitalised.<\/p>\n<p>Medical Certificate has been appended as Annexure<\/p>\n<p>P-4 to justify the absence of the petitioner from<\/p>\n<p>the Institute. Principal of the Institute had been<\/p>\n<p>informed about the hardship faced by the petitioner.<\/p>\n<p>The     petitioner          was        allowed         to     take       practical<\/p>\n<p>examinations          by      respondent             No.3,         held        w.e.f.<\/p>\n<p>15.11.2008 to 17.11.2008.\n<\/p>\n<p>                      The datesheet was circulated for the<br \/>\n CWP No.583 of 2009                                           [3]<\/p>\n<p>theory examinations of 3rd Semester that commenced<\/p>\n<p>w.e.f.     2.1.2009.         When     the       petitioner         wanted    to<\/p>\n<p>appear, he was not allowed to sit in examinations.<\/p>\n<p>When     the     petitioner         met     the     Principal         of    the<\/p>\n<p>Institute,        no        reason        was     assigned,           however,<\/p>\n<p>subsequently the petitioner was informed that there<\/p>\n<p>was shortage of lectures of the petitioner.<\/p>\n<p>                      It is the case of the petitioner that<\/p>\n<p>no prior notice was given to the petitioner that he<\/p>\n<p>was falling short of lectures. The petitioner made a<\/p>\n<p>representation (Annexure P-5). It transpires that he<\/p>\n<p>had attended 67% lectures whereas the petitioner was<\/p>\n<p>required to attend 80% of the delivered lectures for<\/p>\n<p>theory and practical classes combined.<\/p>\n<p>                      Learned counsel for the petitioner, in<\/p>\n<p>view of his contentions, has cited judgment rendered<\/p>\n<p>by Division Bench of this Court in Civil Writ Petition<\/p>\n<p>No.10630 of 2008, titled &#8216;<a href=\"\/doc\/66776\/\">Suresh Parmar vs. State of Haryana &amp;<\/p>\n<p>Others&#8217;<\/a> decided on 3.9.2008.\n<\/p>\n<p>                      Learned       counsel       for    the       respondent-<\/p>\n<p>State     says       that     because       the        rules       allow    the<\/p>\n<p>respondents only to give benefit to the petitioner<\/p>\n<p>to a limited extent, considering the rigours of the<\/p>\n<p>rules,    no     further      relief       could        be   given     to   the<\/p>\n<p>petitioner. The hardship faced by the petitioner,<\/p>\n<p>however, has been admitted.\n<\/p>\n<p>                      Learned       counsel       for    the       respondents<\/p>\n<p>however,       have    not     been       able    to     distinguish        the<\/p>\n<p>judgment rendered in Suresh Parmar&#8217;s case (supra).\n<\/p>\n<pre> CWP No.583 of 2009                                           [4]\n\n\n\n                     I     have        considered         the      facts        and\n\ncircumstances        of     the        case.    When      the      facts        are\n\n<\/pre>\n<p>collectively considered, it becomes clear that the<\/p>\n<p>petitioner       was       successful          in    Central          Entrance<\/p>\n<p>Examination scheduled for admission to the Course.<\/p>\n<p>The petitioner had been a regular student and has<\/p>\n<p>been able to clear 1st and 2nd Semesters also. The<\/p>\n<p>respondents have not disputed the factum of ailment<\/p>\n<p>of the petitioner, death of father of the petitioner<\/p>\n<p>and     consequent         hardship        faced       by       the     family.<\/p>\n<p>Clearly,       the       circumstances          being       faced      by       the<\/p>\n<p>petitioner were unusually harsh and beyond control<\/p>\n<p>of the petitioner. I am of the considered opinion<\/p>\n<p>that the facts and circumstances of the case entitle<\/p>\n<p>the petitioner to allow him to pursue his further<\/p>\n<p>studies as bonafide endeavour of the petitioner to<\/p>\n<p>pursue studies has been established.<\/p>\n<pre>                     By     virtue       of     interim         order       dated\n\n16.1.2009,       the      petitioner           was   allowed          to     take\n\n<\/pre>\n<p>examination for the 3rd Semester. The petitioner has<\/p>\n<p>already       appeared.          The     ratio       of      the      judgment<\/p>\n<p>delivered in Suresh Parmar&#8217;s case (supra) also helps the<\/p>\n<p>case of the petitioner.\n<\/p>\n<p>                     In view of the above, the petitioner<\/p>\n<p>is entitled to clemency and lenient approach.<\/p>\n<p>                     The petition is allowed.<\/p>\n<pre>\n\n                     It    is     directed       that       the    petitioner\n\nshall    be    allowed      to    continue       his      studies.
