CHAUDHARI, J.)\n<\/pre>\n<p>     1.               Being aggrieved by the judgment and order<\/p>\n<p>     dated 26.10.2004, passed by the Additional Sessions<\/p>\n<p>     Judge, Achalpur in Session Trial No.10\/2004 by which<\/p>\n<p>     the appellant\/accused was convicted for the offence<\/p>\n<p>     punishable under Section 302 of Indian Penal Code and<\/p>\n<p>     was   sentenced          to    undergo      rigorous        imprisonment            for<\/p>\n<p>     life and to pay a fine of Rs.1,000\/-, in default of<\/p>\n<p><span class=\"hidden_text\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                                2<\/span><\/p>\n<p>     payment of fine to further undergo simple imprisonment<\/p>\n<p>     for    15    days,       the    present    appeal         was     filed       by    the<\/p>\n<p>     appellant.\n<\/p>\n<p>     2.               In support of the appeal, learned Counsel<\/p>\n<p>     for the appellant made the following submissions.\n<\/p>\n<p>                      (a)            The prosecution case is not based<\/p>\n<p>     on any direct evidence and is based only on oral and<\/p>\n<p>     written dying declarations.\n<\/p>\n<p>                      (b)            The     witnesses           on       oral        dying<\/p>\n<p>     declaration have not supported the prosecution and the<\/p>\n<p>     trial Court has also disbelieved them.\n<\/p>\n<p>                      (c)            The only evidence on record that<\/p>\n<p>     remains for consideration is that of written dying<\/p>\n<p>     declaration            proved    by   P.W.8             Abdul       Jabbar,         the<\/p>\n<p>     Executive Magistrate.\n<\/p>\n<p>                      (d)            Perusal of the evidence of P.W.8<\/p>\n<p>     Abdul       Jabbar       with    other     evidence           and       the      dying<\/p>\n<p>     declaration (Exh.28) show many serious discrepancies<\/p>\n<p>     and    therefore,         the    said     dying      declaration           (Exh.28)<\/p>\n<p>     will    have      to     be    discarded.     In      the     absence         of    any<\/p>\n<p>     corroborative            evidence       and       existence          of       serious<\/p>\n<p>     discrepancies in the dying declaration, the same is<\/p>\n<p>     liable to be rejected and consequently, the appellant<\/p>\n<p><span class=\"hidden_text\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                                3<\/span><\/p>\n<p>     is liable to be acquitted.\n<\/p>\n<p>                      (e)           F.I.R. was lodged by the sister of<\/p>\n<p>     the deceased but she has not been examined before the<\/p>\n<p>     Court though the prosecution claimed that she was an<\/p>\n<p>     eye witness to the incident. There is no explanation<\/p>\n<p>     furnished by the prosecution for not producing her<\/p>\n<p>     before the Court.\n<\/p>\n<p>     3.               Per     contra,        learned           A.P.P.           for       the<\/p>\n<p>     respondent opposed the appeal and argued that some<\/p>\n<p>     corroboration            can       be     found             out         from         the<\/p>\n<p>     cross-examination of the witnesses who deposed about<\/p>\n<p>     oral dying declaration and particularly the mother of<\/p>\n<p>     the deceased and therefore, the appeal deserves to be<\/p>\n<p>     dismissed.\n<\/p>\n<p>     4.               We have heard learned Counsel for the rival<\/p>\n<p>     parties at length. We have also carefully perused the<\/p>\n<p>     record     and     the    evidence       of       the      witnesses.            F.I.R.\n<\/p>\n<p>     (Exh.32)         was   lodged      by    Smt.        Rajali         Kasdekar         the<\/p>\n<p>     younger sister of the deceased Maniklal. The F.I.R.\n<\/p>\n<p>     was exhibited and proved by the Investigating Officer.\n<\/p>\n<p>     5.               Informant Rajali described the incident in<\/p>\n<p>     the    F.I.R.      stating      therein           that     on     1.11.2003          the<\/p>\n<p>     appellant had brought his daughter Pramila and the<\/p>\n<p><span class=\"hidden_text\">                                                        ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                               4<\/span><\/p>\n<p>     deceased Maniklal from Burhanpur to the village since<\/p>\n<p>     his daughter had eloped with him. At about 5:00 p.m.<\/p>\n<p>     the    appellant         came   with    stick         to     her     house       when<\/p>\n<p>     deceased         Maniklal       was    with        her      in       the      house.\n<\/p>\n<p>     Therefore, Maniklal went out from the back door of the<\/p>\n<p>     house towards the house of his uncle Munna Bhilavekar<\/p>\n<p>     who was followed by Bisram and Isram. Then deceased<\/p>\n<p>     Maniklal went inside the house of uncle Munna and the<\/p>\n<p>     appellant and Isram barged their entry into the house<\/p>\n<p>     of uncle. Then Isram lifted kerosene tin and put it on<\/p>\n<p>     the    person       of     Maniklal         while       Bisram        lighted          a<\/p>\n<p>     matchstick and burnt Maniklal. She raised shouts and<\/p>\n<p>     thereafter had poured water on his person. It is thus<\/p>\n<p>     clear that she was an eye witness to the incident and<\/p>\n<p>     was also the informant.\n<\/p>\n<p>     6.               In the first place, she lodged F.I.R. on<\/p>\n<p>     6.11.2003 in respect of the incident dated 1.11.2003,<\/p>\n<p>     for which there is no explanation. If she was an eye<\/p>\n<p>     witness the police did not make any attempt to produce<\/p>\n<p>     her before the Court during trial and there is no<\/p>\n<p>     explanation why she was not produced. The story set<\/p>\n<p>     out in the F.I.R. (Exh.31) is completely different<\/p>\n<p>     from    the       story    stated      by    Maniklal           in     his      dying<\/p>\n<p><span class=\"hidden_text\">                                                      ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                            5<\/span><\/p>\n<p>     declaration (Exh.28). In dying declaration (Exh.28)<\/p>\n<p>     the story about he being in the house with his sister<\/p>\n<p>     Rajali at the relevant time and then he going out from<\/p>\n<p>     the back door as Bisram the appellant had come with<\/p>\n<p>     stick at the house is to be found nowhere in the dying<\/p>\n<p>     declaration (Exh.28). The story that the appellant had<\/p>\n<p>     gone to the house of Maniklal armed with stick is not<\/p>\n<p>     to be found in the dying declaration (Exh.28).\n<\/p>\n<p>     7.<\/p>\n<p>                      On the contrary, the dying declaration shows<\/p>\n<p>     that while Maniklal was moving on the road, he found<\/p>\n<p>     appellant and Isram with axe and stick in their hands<\/p>\n<p>     at some distance and therefore, he went into the house<\/p>\n<p>     of his uncle where the incident of burning allegedly<\/p>\n<p>     took place.\n<\/p>\n<p>     8.               In   our   opinion,     this      discrepancy           in     the<\/p>\n<p>     dying     declaration        and   the    prosecution            story       is     a<\/p>\n<p>     serious discrepancy. Not only that the evidence of<\/p>\n<p>     P.W. 8        Abdul Jabbar that Maniklal had told him while<\/p>\n<p>     giving dying declaration that Bisram and Isram met him<\/p>\n<p>     in the way when he was going to the house of his uncle<\/p>\n<p>     and    that      they   were    armed     with      stick,        is     a     very<\/p>\n<p>     important omission, which has been duly brought on<\/p>\n<p>     record     in     the   cross-examination            of    P.W.8             Abdul<\/p>\n<p><span class=\"hidden_text\">                                                   ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                               6<\/span><\/p>\n<p>     Jabbar. It is further seen that Maniklal was burnt as<\/p>\n<p>     per the prosecution case to the extent of 90% and was<\/p>\n<p>     shifted      from        Dharni         hospital       to     Irvin        hospital<\/p>\n<p>     Amravati and the dying declaration was recorded on the<\/p>\n<p>     second day.\n<\/p>\n<p>     9.               From the evidence of Doctor particularly in<\/p>\n<p>     the cross-examination, it is difficult to believe that<\/p>\n<p>     the     patient          was      mentally        fit        to      give         dying<\/p>\n<p>     declaration. It is highly doubtful whether he was fit<\/p>\n<p>     to    give   dying       declaration         having         been    administered<\/p>\n<p>     pain    killers        and     the      Doctor    says      that     he     did     not<\/p>\n<p>     measure the body temperature of the patient before<\/p>\n<p>     declaring him fit.\n<\/p>\n<p>     10.              It is in this view of the matter, we are of<\/p>\n<p>     the    opinion         that       the     dying     declaration            (Exh.28)<\/p>\n<p>     requires corroboration. But then all other prosecution<\/p>\n<p>     witnesses have not supported the prosecution case and<\/p>\n<p>     thus    there       is       no    corroborative            evidence         to     the<\/p>\n<p>     satisfaction of this Court for corroborating the dying<\/p>\n<p>     declaration (Exh.28). We are of the opinion that we<\/p>\n<p>     should not take the risk of convicting the appellant<\/p>\n<p>     or confirming the conviction of the appellant in the<\/p>\n<p>     wake    of       the     above       serious      discrepancies              in     the<\/p>\n<p><span class=\"hidden_text\">                                                       ::: Downloaded on &#8211; 09\/06\/2013 17:11:02 :::<\/span><br \/>\n<span class=\"hidden_text\">      apeal76.05.odt                              7<\/span><\/p>\n<p>     prosecution             evidence.     That           apart,          the        dying<\/p>\n<p>     declaration (Exh.28) though was recorded on 2.11.2003<\/p>\n<p>     and    was       received    by     the    Investigating             Officer         on<\/p>\n<p>     4.11.2003, no offence was registered and it is only<\/p>\n<p>     after Rajali gave a report, the offence was registered<\/p>\n<p>     on 6.11.2003 but then Rajali had no explanation as to<\/p>\n<p>     why F.I.R. was lodged after 5 days particularly when<\/p>\n<p>     she was an eye witness. There is no explanation as to<\/p>\n<p>     where was she when the deceased Maniklal was taken to<\/p>\n<p>     Dharni       hospital       first         and     thereafter            to      Irvin<\/p>\n<p>     hospital, Amravati.\n<\/p>\n<p>     11.              To sum up, in the above factual scenario,<\/p>\n<p>     benefit      of    doubt    will     have       to   be     extended         to    the<\/p>\n<p>     accused. We, therefore, hold that the conviction of<\/p>\n<p>     the appellant for the offence charged against him is<\/p>\n<p>     not legal.
