M. SAHAI)<\/p>\n<p>1.\tWe<br \/>\nhave heard Mr. R.N. Singh, learned advocate appearing for the<br \/>\npetitioner, Ms. Shruti Pathak, learned AGP appearing for the<br \/>\nrespondent no. 1 and Mr. Chinmay Gandhi, learned advocate appearing<br \/>\nfor the respondent no. 5.\n<\/p>\n<p>2.\tThis<br \/>\npetition has been filed by the petitioner that the respondent<br \/>\nauthorities be directed to release the land of the petitioner bearing<br \/>\nRevenue Survey No. 984 and 1037 situated in village Dahej, Taluka<br \/>\nVagra, Bharuch from acquisition which is sought by issuing<br \/>\nnotification under section 4 dated 22.11.2009 and notification under<br \/>\nsection 6 dated 14.12.2010 of the Land Acquisition Act.\n<\/p>\n<p>3.\tThe<br \/>\nState Government under section 48 of the Land Acquisition Act can<br \/>\nrelease only the acquired land provided the petitioner is in<br \/>\npossession of the land in dispute.  In the instant case, Mr. Singh<br \/>\nhas submitted that the land in question is in possession of the<br \/>\npetitioner which is not disputed by Ms. Pathak, learned AGP appearing<br \/>\nfor the respondent State.  Learned AGP however submitted that the<br \/>\npetitioner may prefer appropriate fresh representation before the<br \/>\nconcerned authorities of State Government which shall be considered<br \/>\nin accordance with law.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above, this petition is disposed of with the following<br \/>\ndirections:\n<\/p>\n<p>The<br \/>\n\tpetitioner shall make a fresh detailed representation under Section<br \/>\n\t48 of the Land Acquisition Act before the concerned authorities of<br \/>\n\tthe State Government within a period of four weeks from today.\n<\/p>\n<p>\tThe<br \/>\n\tauthorities shall consider the same in accordance with law and<br \/>\n\tdispose of the same by way of a reasoned and speaking order within a<br \/>\n\tperiod of three months from the date of receipt of the<br \/>\n\trepresentation.\n<\/p>\n<p>It<br \/>\n\tis made clear that this Court has not entered into the merits of the<br \/>\n\tmatter.\n<\/p>\n<p>5.\tRule<br \/>\nis discharged.
