NO.853    OF 2002\n\n               ===========================\n\n\n\n         Dated this the 29th day of June, 2007\n\n\n\n                           JUDGMENT\n<\/pre>\n<p>     Appellant is the plaintiff in O.S.5\/1987 on the<\/p>\n<p>file   of   Munsiff   Court,   Vaikkom.     Respondents   are<\/p>\n<p>the   defendants.          Respondents   2   and   3   were<\/p>\n<p>subsequently   deleted   by   the   appellant   stating   that<\/p>\n<p>they   are   no   more   and     other   respondents   are   their<\/p>\n<p>legal   heirs.     Second   defendant   is   the   son   and<\/p>\n<p>defendants   3   and   4   are   the   parents   of   the   first<\/p>\n<p>defendant.     Appellant   was   admittedly   living   with<\/p>\n<p>first   defendant   as   husband   and   wife   under   a<\/p>\n<p>registered   agreement.     Second   respondent   was   born<\/p>\n<p>in   that   relationship.     When   the   relationship   got<\/p>\n<p>strained,   appellant   desserted   them.     Respondents   1<\/p>\n<p>and   2   claimed   maintenance   under   section   125   of<\/p>\n<p>Code   of   Crl.   Procedure   contending   that   first<\/p>\n<p>respondent   is   the   wife   and   the   second   respondent,<\/p>\n<p>the   son   of   appellant.     Courts   finally   found   that<\/p>\n<p>second respondent is the son, though on the failure<\/p>\n<p><span class=\"hidden_text\">S.A.853\/02                                    2<\/span><\/p>\n<p>of   first   respondent   to   prove   the   legal   marriage,<\/p>\n<p>her   status   as   the     legally   wedded   wife   was   not<\/p>\n<p>upheld.              The   suit   was   filed   by   the   appellant<\/p>\n<p>seeking            a         decree         for         mandatory         injunction<\/p>\n<p>contending   that   plaint   A   schedule   property   belongs<\/p>\n<p>to him as per Ext.A1 patta obtained from the Taluk<\/p>\n<p>Office and respondents have no manner of right over<\/p>\n<p>the   same.     Respondents   denied   the   title   and   also<\/p>\n<p>claimed   that   they   are   entitled   to   get   kudikidappu<\/p>\n<p>right.          Though   the   claim   for   kudikidappu   was<\/p>\n<p>referred   to   the   Land   Tribunal   under   section   125(3)<\/p>\n<p>of Kerala Land Reforms Act,  Land Tribunal found it<\/p>\n<p>against  first respondent.   The trial court on the<\/p>\n<p>evidence   found   that   appellant   has   admitted   that   he<\/p>\n<p>did   not   enter   into   the   plaint   schedule   property<\/p>\n<p>after  1980    and  Ext.B1  judgment  shows  that  earlier<\/p>\n<p>suit   filed   by   appellant   for   injunction   was<\/p>\n<p>dismissed   and   therefore   held   that   appellant   is   not<\/p>\n<p>entitled   to   the   decree   for   mandatory   injunction<\/p>\n<p>sought   for.     The   suit   was   dismissed.     Appellant<\/p>\n<p><span class=\"hidden_text\">S.A.853\/02                               3<\/span><\/p>\n<p>challenged         the         decree              and         judgment         before<\/p>\n<p>Additional District Court, Kottayam in A.S.50\/1992.\n<\/p>\n<p>Learned   District   Judge   on   reappreciation   of<\/p>\n<p>evidence   found   that     evidence   would   establish   that<\/p>\n<p>appellant   did   not   even   enter   into   the   plaint<\/p>\n<p>schedule property after 1980 and it has been in the<\/p>\n<p>possession   of   the   respondents   and   in   such<\/p>\n<p>circumstance,   appellant   is   not   entitled   to   the<\/p>\n<p>decree   for   mandatory   injunction.     The   appeal   was<\/p>\n<p>dismissed.  It is challenged in this second appeal.\n<\/p>\n<p>      2.  Learned counsel appearing for the appellant<\/p>\n<p>was heard.\n<\/p>\n<p>      3.     On   hearing   learned   counsel   and   on   going<\/p>\n<p>through the judgments of the courts below, I do not<\/p>\n<p>find   any   substantial   question   of   law   involved   in<\/p>\n<p>the appeal.   The admission of the appellant as PW1<\/p>\n<p>establish that respondents  have been in possession<\/p>\n<p>of   the   plaint   A   schedule   property   and   he   did   not<\/p>\n<p>even enter the plaint schedule property after 1980.\n<\/p>\n<p>Appellant   earlier   filed   O.S.216\/1981   claiming   a<\/p>\n<p><span class=\"hidden_text\">S.A.853\/02                                     4<\/span><\/p>\n<p>decree             for         injunction                against         respondents.\n<\/p>\n<p>Respondents derived the title and possession .Under<\/p>\n<p>Ext.B1 it was dismissed. Even in the suit appellant<\/p>\n<p>did   not   seek     declaration   of   his   title.   Ext.A1<\/p>\n<p>patta was obtained after Ext.B1 judgment.  The suit<\/p>\n<p>was   framed   as   if   respondents   are   rank   trespassers.\n<\/p>\n<p>First         appellate               court         found         that         in         such<\/p>\n<p>circumstance,   appellant   is   not   entitled   to   the<\/p>\n<p>decree. Courts below rightly dismissed the suit.
