Pleader\nappearing for     \" \n3. \u20acF*a.i.r';_t,e  this writ petition are\n    namely Shankaranarayana\n\nBhat to: be4V the' in respect of 10 guntas of land\n\n v  in  191 V'0f.\u00a7aI9iagadde village, Kumta taluk, filed Form\n\n ---.'.1'ribu::1a1, Kumta, seeking to register him as\n\n fhe land. At the same time, the fourth\n\n --- Ramakrishna, also made Form '7 to the same\n\n  \"ii Tribunal, seeking to register him as occupant of the\n\n'    land. The Land Tribunal by its earlier order -Annexure\n\n \n\n'TB' dt.24- 10-78 considered the claim of the petitioner and\n\n@y.\n\n\n\n \n\n4\nregistered him as occupant of the land and rejected the claim\nof the fourth respondent<\/pre>\n
4. Sri. Jayaprakash, learned Counsel appea\ufb01ng for<\/p>\n
the petitioner vehemently contends that the “of the<\/p>\n

\nNo.27099\/ 1996’   e.  Court allowed the
\nsaid writ;   i:1\u00a7;e”ea1*\ufb01er order of the Land
\nTx~ibun:;1   dt. 24-10-78 and remitted
\nthe  Kuinta for reoonsidera\ufb02on in<\/p>\n
aocroxfdargoe  reconsideration, the Land ‘I’rib1mal<\/p>\n
 V.  ‘ &o’f’\ufb02 1e Petitioner and gamed the occ11pEu’1C\u00a5<\/p>\n
  ‘ in question  favour of the fourth<\/p>\n
‘ V V ‘ ‘ respondeim  A<\/p>\n
 ..  1 It is the contention of Sri. Jayaprakash, the<\/p>\n
  Counsel appearing for the petitioner, that though<\/p>\n
fourth respondent has not challenged the earlier order of the<\/p>\n
Land Tribunal, passed vide Annexure *3′ dt. 24-dd1od;t7e,a and<\/p>\n
the same became \ufb01nal, in so far as the  <\/p>\n
concerned, it is not open to   AV <\/p>\n
occupancy right in his favour. It his   <\/p>\n
the fourth respondent is     ownet of
\nthe Zand, namely  Shet, being his
\nbrother’s son and he  claim against
\nhis own family’     clear, it is stated
\nthat    am Ganapathi Shet are
\ndirect  — Ramakrishna, is
\nthe  Sri. Jayaprakash also brings to<\/p>\n
my notice   records relating to the land in<\/p>\n
 V. “Q11\u00a7~\u00a7tton””Ah\u20ac1V\u00a2  etandiilg in his name continuously,<\/p>\n
 relevant period of 1-3-74 and prior to that.<\/p>\n
.   Be    the Land Tribunal is required to consider<\/p>\n
 the petitioner has been cuitivating the land in<\/p>\n
A  ‘question as tenant on 1-3-74 or prior to that. The Land<\/p>\n
   is also required to consider the fact that the fourth<\/p>\n

respect of the same land, and his claim having been rejected

by the Land Tribune} by its earlier order vide Armexgue ‘B’ (it.

\nCourt  pf, No. 27o97\/ 1995,

  reoonsiderr  olatter afresh after issuing notice<\/p>\n
 to aL’_\u00a7the  including the fourth respondent.<\/p>\n
 V’Be. axoay, the Land Tribunal is required to consider<\/p>\n
 with the provisions of the Land<\/p>\n
V  and in the light of the observation made by this<\/p>\n
  its order passed in W.P.No.27()97\/1996. While<\/p>\n
—   so, a duty is cast upon the authority to consider the<\/p>\n

claiming tenancy under his family member. It is open to the<\/p>\n
