NOTICE TO BE SERVED THROUGH - &amp; 1 -\nRespondent(s)\n \n\n=================================================\n \nAppearance : \nMS\nAMITA S SHAH for Petitioner(s) : 1, \nMR NK MAJMUDAR for\nRespondent(s) : 1, \nMR PREMAL R JOSHI for Respondent(s) :\n2, \n=================================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 18\/01\/2011  \nORAL JUDGMENT<\/pre>\n<p>\tPresent<br \/>\npetition is preferred against notice dated 6.9.2003 demanding payment<br \/>\nof the unpaid bill issued by the respondent &#8211; Board &#8211;<br \/>\nCompany.\n<\/p>\n<p>\tIt<br \/>\nis noticed from the record that initially the respondent &#8211;<br \/>\nBoard &#8211; Company had issued a bill dated 23.4.1995 for a sum of<br \/>\nRs.55,062=00. It appears that the said bill amount was not paid<br \/>\ntherefore, the respondent &#8211; Board &#8211; Company issued demand<br \/>\nnotice dated 11.4.1996.\n<\/p>\n<p>\tThe<br \/>\npetitioner did not pay any heed to the said notice as well and the<br \/>\nbill amount remained unpaid.\n<\/p>\n<p>\tInterestingly,<br \/>\nthe respondent &#8211; Board &#8211; Company, after having issued the<br \/>\nnotice, forgot about the bill, the notice and the outstanding amounts<br \/>\nas well and allowed the time to pass so much so that the claim became<br \/>\ntime barred.\n<\/p>\n<p>\tSubsequently,<br \/>\nin 2003 i.e. after almost 8 years from the date of the bill and 7<br \/>\nyears after the first notice, the respondent &#8211; Board &#8211;<br \/>\nCompany woke up from its slumber and issued another notice demanding<br \/>\nthe payment. Aggrieved by the said notice, the petitioner has<br \/>\npreferred present petition and challenged the notices on diverse<br \/>\ngrounds.\n<\/p>\n<p>\tEx-facie,<br \/>\nthe claim in the notices have become time barred.\n<\/p>\n<p>\tIt<br \/>\nappears to be noted that by issuing the said two notices, the<br \/>\nrespondent &#8211; Board &#8211; Company had merely informed the<br \/>\npetitioner that if the amount in question was not paid, then the<br \/>\nrespondent &#8211; Board &#8211; Company would take appropriate<br \/>\naction in law for recovery of the outstanding amounts i.e. by filing<br \/>\nthe civil suit. From the record, it does not become clear as to<br \/>\nwhether any suit was filed within time or not after issuance of the<br \/>\nbill. If the suit has already been filed, it would take its own<br \/>\ncourse, if it is already not disposed of by appropriate order. If the<br \/>\nsuit has not been filed,  though intimated by the respondent by<br \/>\nvirtue of the said two notices, then, the proposed suit would<br \/>\nprobably not be maintainable as the claim appears to have become time<br \/>\nbarred. Even if the petitioner&#8217;s request is not accepted i.e. the<br \/>\nprayer to quash the notices is not granted, then also, the said<br \/>\nnotices would be of no avail to the respondent, since as aforesaid,<br \/>\nthe proposed suit appears to have become time barred, if not filed<br \/>\nwithin prescribed period of limitation from the date of issuance of<br \/>\nthe bill.\n<\/p>\n<p>\tSince<br \/>\nneither the petitioner nor the respondent has brought on record the<br \/>\nsaid factual aspect viz. whether the suit was filed within prescribed<br \/>\ntime limit or not after issuance of the bill amount, any direction or<br \/>\norder with regard to the said aspect is not passed.\n<\/p>\n<p>\tWith<br \/>\nthe aforesaid observations and having noted the fact that the<br \/>\npetition was listed for hearing yesterday and despite two calls, the<br \/>\nlearned advocate for the petitioner was not present and today also,<br \/>\nthe petitioner and\/or petitioner&#8217;s advocate is not present, the<br \/>\npetition is dismissed for non-prosecution.
