No.4475 of 2011\n                                      SURAY DEO RAM\n                                              Versus\n                                      The State Of Bihar\n                                            -----------\n<\/pre>\n<p>4       12-07-2011              Heard learned counsel for the petitioner as well as<\/p>\n<p>                     learned Additional Public Prosecutor for the state.<\/p>\n<p>                                Being husband of the deceased, the petitioner is in<\/p>\n<p>                     jail custody since 24.08.2010 in a case under sections-302,<\/p>\n<p>                     201\/34 of the Indian Penal Code. Admittedly, the marriage of the<\/p>\n<p>                     deceased had taken place 20 years ago with the petitioner.<\/p>\n<p>                     Although there is allegation that the petitioner wanted to marry<\/p>\n<p>                     with another woman and that was the reason, he committed<\/p>\n<p>                     murder of the deceased but admittedly, the case has not been<\/p>\n<p>                     registered under section-304B of the Indian Penal Code in which<\/p>\n<p>                     the burden lies upon the accused to prove his innocence. So,<\/p>\n<p>                     considering the facts and circumstances of the case as well as<\/p>\n<p>                     submission of the parties, let the petitioner, Suray Deo Ram be<\/p>\n<p>                     released on bail on furnishing bail bonds of Rs 10,000\/- (ten<\/p>\n<p>                     thousand) with two sureties of the like amount each in<\/p>\n<p>                     connection with Jay Nagar P.S.
