The amendment<br \/>\n\tmay be carried out forthwith.\n<\/p>\n<p>\tRule.\n<\/p>\n<p>\tMr.Amit P.Patel, learned Assistant Government Pleader, waives<br \/>\n\tservice of notice of Rule on behalf of the respondents. On<br \/>\n\tthe facts and in the circumstances of the case, and with the consent<br \/>\n\tof the learned counsel for the respective parties, the petition is<br \/>\n\tbeing heard and finally decided, today.\n<\/p>\n<p>\tThis<br \/>\n\tpetition, under Article 226 and 227 of the Constitution of India,<br \/>\n\thas been preferred challenging order dated 04.02.2010, passed by the<br \/>\n\tSecretary, Revenue Department, in Revision Application No.17\/1998<br \/>\n\twhereby, order dated 22.12.1997, passed by the District Collector,<br \/>\n\tAhmedabad, has been confirmed.\n<\/p>\n<p>\tThe<br \/>\n\tbrief facts of the case are that land bearing Survey No.424,<br \/>\n\tadmeasuring 5808 square metres, situated at Village: Gota, Taluka:<br \/>\n\tDascroi, District: Ahmedabad, is new tenure land, and is shown to be<br \/>\n\tin the occupation of the predecessors-in-interest of the<br \/>\n\tpetitioners, as per revenue records. The petitioners Nos.1\/1 and 1\/2<br \/>\n\tare the heirs and legal representatives of<br \/>\n\tdeceased Shantaben Gandaji Thakore. The said land has been granted<br \/>\n\tfor agriculture use, with certain conditions. It appears that<br \/>\n\twithout taking the prior permission of the State Government or<br \/>\n\tpaying the requisite amount of premium, the petitioners started<br \/>\n\tusing the said land for non-agricultural purposes, in contravention<br \/>\n\tof the conditions of grant. On the basis of the report of the Deputy<br \/>\n\tCollector, Viramgam Prant, the Collector, Ahmedabad, initiated<br \/>\n\tproceedings against the petitioners for breach of conditions of<br \/>\n\tgrant. By order dated 22.12.1997, the Collector, Ahmedabad, came to<br \/>\n\tthe conclusion that there was a breach of conditions of grant, and<br \/>\n\tdirected the land to be forfeited to the State Government. Aggrieved<br \/>\n\tby the above-mentioned order of the Collector, the petitioners<br \/>\n\tapproached the State Government by filing the above-mentioned<br \/>\n\trevision application, which has been dismissed by passing the<br \/>\n\timpugned order. In the above circumstances, the petitioners have<br \/>\n\tfiled the present petition.\n<\/p>\n<p>\tMr.Nehal<br \/>\n\tR.Joshi, learned counsel for the petitioners,<br \/>\n\thas submitted that although there are concurrent findings of both<br \/>\n\tthe authorities below against the petitioners, however, they are<br \/>\n\tready and willing to pay the full amount of premium at the<br \/>\n\tprevailing market price.\n<\/p>\n<p>\tIt<br \/>\n\tis further submitted that as per Section 67 of the Bombay Land<br \/>\n\tRevenue Code, 1879 ( the Code  for short), the Collector has the<br \/>\n\tpower to grant permission, as per Rules. As the land in question<br \/>\n\tcannot be used by the petitioners for agricultural purposes, and as<br \/>\n\tthe petitioners are doing the business of marble and granite on the<br \/>\n\tsaid land, the respondents may be directed to accept the amount of<br \/>\n\tpremium and grant non-agricultural use permission in respect of the<br \/>\n\tsaid land, to the petitioners.\n<\/p>\n<p>\tIt<br \/>\n\tis contended by the learned counsel for the petitioners that in<br \/>\n\tfact, no opportunity of hearing has been given to the petitioners by<br \/>\n\tthe Collector and even otherwise, the case of the petitioners has<br \/>\n\tnot been properly defended by the learned advocate appearing for<br \/>\n\tthem before the authorities<br \/>\n\tbelow, therefore, the petitioners should not be penalized for that.<br \/>\n\tOn the basis of the above submissions, it is prayed that the<br \/>\n\tpetition be allowed.\n<\/p>\n<p>\tNo<br \/>\n\tother submissions have been advanced by the learned counsel for the<br \/>\n\tpetitioners.\n<\/p>\n<p>\tOn<br \/>\n\tthe other hand, Mr.Amit Patel, learned Assistant Government Pleader<br \/>\n\tfor the respondents, has supported the orders of the District<br \/>\n\tCollector and the State Government, respectively, by submitting that<br \/>\n\tample opportunity of hearing has been granted to the petitioners,<br \/>\n\twhich is obvious from a perusal of the impugned order. The request<br \/>\n\tof the petitioners in the proceedings before the State Government to<br \/>\n\tthe effect that they are ready and willing to pay the full amount of<br \/>\n\tpremium at the prevailing rate has been rejected and the order of<br \/>\n\tthe Collector has been upheld. It is prayed by the learned Assistant<br \/>\n\tGovernment Pleader that the petition be dismissed.\n<\/p>\n<p>\tI<br \/>\n\thave heard the learned counsel for the respective<br \/>\n\tparties, perused the averments made in<br \/>\n\tthe petition, contents of the impugned order and other documents on<br \/>\n\trecord.\n<\/p>\n<p>\tIt<br \/>\n\tis an admitted position that the land in question is of new tenure,<br \/>\n\tand has been granted for agricultural use to the<br \/>\n\tpredecessors-in-title of the petitioners, subject to certain<br \/>\n\tconditions. It is also an admitted fact that the petitioners are<br \/>\n\tusing said land for non-agricultural purposes, by running a marble<br \/>\n\tand granite business thereupon. Admittedly, no permission has been<br \/>\n\tobtained from the Collector, as required, before using the land for<br \/>\n\tnon-agricultural purposes. This aspect is not disputed by the<br \/>\n\tlearned counsel for the petitioners. As per the provisions of<br \/>\n\tSection 65 of the Code, breach of conditions of grant of new tenure<br \/>\n\tland would entail forfeiture to the Government, which order has been<br \/>\n\tpassed by the Collector and confirmed in revision by the impugned<br \/>\n\torder.\n<\/p>\n<p>\tA<br \/>\n\tsubmission has been advanced by the learned counsel<br \/>\n\tfor the petitioners that under the provisions of Section 67 of the<br \/>\n\tCode, the Collector is empowered to grant permission on such terms<br \/>\n\tand conditions as may be prescribed. In order to deal with the said<br \/>\n\tsubmission, it would be necessary to look into the relevant<br \/>\n\tprovisions of law, which are reproduced hereinbelow, for ready<br \/>\n\treference:\n<\/p>\n<p>\t 65.\tUse<br \/>\n\tto which occupant of land for purposes of agriculture may put his<br \/>\n\tland &#8212;\n<\/p>\n<p>\t1.\tAny<br \/>\n\toccupant of land assessed or held for the purpose of agriculture is<br \/>\n\tentitled by himself, his servants, tenants, agents or other legal<br \/>\n\trepresentatives, to erect farm-building, construct wells or tanks,<br \/>\n\tor make any other improvements thereon for the better cultivation of<br \/>\n\tthe land, or its more convenient use for the purpose aforesaid.\n<\/p>\n<p>\tProcedure<br \/>\n\tif occupant wishes to apply his land to any other purpose &#8212;  But,<br \/>\n\tif any occupant wishes to use his holding or any part thereof for<br \/>\n\tany other purpose the Collector&#8217;s permission shall in the first<br \/>\n\tplace be applied for by the occupant. The Collector, on receipt of<br \/>\n\tsuch application,<\/p>\n<p>\t(a)\tshall<br \/>\n\tsend to the applicant a written acknowledgment of its receipt, and<\/p>\n<p>\t(b)\tmay,<br \/>\n\tafter due inquiry, either grant or refuse the permission applied<br \/>\n\tfor:\n<\/p>\n<p>\tProvided<br \/>\n\tthat, where the Collector fails to inform the applicant of his<br \/>\n\tdecision on the application<br \/>\n\twithin a period of three months, the permission applied for shall be<br \/>\n\tdeemed to have been granted; such period shall, if the Collector<br \/>\n\tsends a written acknowledgment within seven days from the date of<br \/>\n\treceipt of the application, be reckoned from the date of the<br \/>\n\tacknowledgment, but in any other case it shall be reckoned from the<br \/>\n\tdate of receipt of the application.\n<\/p>\n<p>\tUnless<br \/>\n\tthe Collector shall in particular instances otherwise direct, no<br \/>\n\tsuch application shall be recognised except it be made by the<br \/>\n\toccupant.\n<\/p>\n<p>\t(2)\tNotwithstanding<br \/>\n\tanything contained in sub-section (1) but subject to any terms and<br \/>\n\tconditions laid down by the State Government in this behalf where an<br \/>\n\toccupant has his holding in an area comprising a gram and such area<br \/>\n\tis not within an urban agglomeration or within a radius of five<br \/>\n\tkilometres from the limits of a municipal borough or notified area<br \/>\n\tor industrial estate and such occupant wishes to use his holding or<br \/>\n\ta part thereof only for the residential purpose, it shall not be<br \/>\n\tnecessary for him to obtain permission of the Collector under<br \/>\n\tsub-section (1)&#8230;.\n<\/p>\n<p>\t 65A.\n<\/p>\n<p>\tProcedure if occupant wishes to apply his land from one<br \/>\n\tnon-agricultural purpose to another non-agricultural purpose<br \/>\n\tWhere the occupant of any land assessed or held for any<br \/>\n\tnon-agricultural purpose wishes to use such land or part thereof for<br \/>\n\tany other non-agricultural purpose, the Collector&#8217;s permission shall<br \/>\n\tin the first place be applied for by him and the provisions of<br \/>\n\tsection 65 shall, so far as may be, apply to such application&#8230;.\n<\/p>\n<p>\t 66.\tPenalty<br \/>\n\tfor using land without permission   If any land referred to in<br \/>\n\tsection 65 or section 65A be used for any purpose other than the<br \/>\n\tpurpose for which such land is assessed or held without the<br \/>\n\tpermission of the collector being first obtained, or before the<br \/>\n\texpiry of three months referred to in section 65 or despite refusal<br \/>\n\tof permission during the said period of three months, then, without<br \/>\n\tprejudice to the occupant&#8217;s liability to pay the new assessment<br \/>\n\tleviable under section 48 or the conversion tax leviable under<br \/>\n\tsection 67A &#8212;\n<\/p>\n<p>\t(a)\tthe<br \/>\n\toccupant and any tenant or other person holding under or through him<br \/>\n\tshall be liable to be summarily evicted by the Collector from the<br \/>\n\tland so used and from the entire survey number or sub-division of<br \/>\n\tthe survey number of which it may form part;<br \/>\n\tand<\/p>\n<p>\t(b)\tthe<br \/>\n\toccupant shall also be liable to pay for the period during which the<br \/>\n\tsaid land has been so used, such fine as the Collector may, subject<br \/>\n\tto the general orders of the State Government, direct.\n<\/p>\n<p>\tAny<br \/>\n\ttenant of any occupant or any other person holding under or through<br \/>\n\tan occupant, who shall without the occupant&#8217;s consent use any such<br \/>\n\tland for any such purpose, and thereby render the said occupant<br \/>\n\tliable to the penalty aforesaid, shall be responsible to the said<br \/>\n\toccupant in damages.\n<\/p>\n<p>\t 67.\tPermission<br \/>\n\tmay be granted on terms   Nothing in sections 65, 65A and 66<br \/>\n\tshall prevent the granting of the permission aforesaid on such terms<br \/>\n\tor conditions as may be prescribed by the Collector, subject to any<br \/>\n\trules made in this behalf by the State Government.\n<\/p>\n<p>\tSections<br \/>\n\t65 and 65A, of the Bombay Land Revenue Code detail the uses to which<br \/>\n\tthe recipient of land for the purpose of agricultural may put the<br \/>\n\tsaid land to, and the procedure required to be followed on an<br \/>\n\tapplication being made by the occupant if he wishes to apply the<br \/>\n\tland for any other purposes. Section 66 provides for penalty for<br \/>\n\tusing the land without permission. Section 67 enumerates the terms<br \/>\n\ton which the Collector may grant permission. A conjoint reading of<br \/>\n\tthe above provisions of law would go to show that if the occupant<br \/>\n\twishes to use the granted land for any purpose, other than<br \/>\n\tagricultural use, then it is incumbent upon him to obtain the<br \/>\n\tpermission of the Collector in the first instance. Section 67<br \/>\n\tempowers the Collector to grant permission as provided in the said<br \/>\n\tprovision, subject to rules made in this regard by the State<br \/>\n\tGovernment. For the provisions of Section 67 to come into play, it<br \/>\n\tis necessary that the occupant of the land (in this case, the<br \/>\n\tpetitioners) make an application as required in Section 65 of the<br \/>\n\tCode, for permission to apply the<br \/>\n\tland for any other purpose. It is only on an application being made<br \/>\n\tthat the powers under Section 67 can be exercised. It is an admitted<br \/>\n\tposition that such an application has not been made at all by the<br \/>\n\tpetitioners or their predecessors-in-interest. In the above<br \/>\n\tcircumstances, the provisions of Section 67 cannot be pressed into<br \/>\n\tservice as permission can only be granted if it is prayed for by way<br \/>\n\tof an application, as provided by the above-mentioned provision of<br \/>\n\tlaw. As no permission has been sought by the petitioners,<br \/>\n\tappropriate proceedings have been initiated against them, leading to<br \/>\n\tthe passing of the impugned orders. After passing of the order of<br \/>\n\tforfeiture of the land by the Collector, as confirmed by the State<br \/>\n\tGovernment in revision, it is not open to the petitioners at this<br \/>\n\tbelated stage to submit, that the Collector should be directed to<br \/>\n\tconsider the case of the petitioners for grant of permission under<br \/>\n\tSection 67 of the Code, without ever having applied for permission.\n<\/p>\n<p>\tRegarding<br \/>\n\tthe second submission advanced by the learned counsel for the<br \/>\n\tpetitioners, to the effect that no opportunity of hearing has been<br \/>\n\tgranted to them by the Collector, the same is stated to be rejected.<br \/>\n\tThe impugned order of the State Government meticulously enumerates<br \/>\n\tthe various dates on which adjournment was sought by the<br \/>\n\tpetitioners. It is mentioned therein that notice regarding<br \/>\n\tinitiation of proceedings for breach of condition by the occupants<br \/>\n\tof land was issued on 20.12.1995. The petitioners appeared on<br \/>\n\t02.01.1996 before the Collector and requested for time. Thereafter,<br \/>\n\ton 25.01.1996, 16.02.1996, 30.07.1996, 10.09.1996, 23.04.1996 and<br \/>\n\t13.05.1997, the petitioners themselves, and their advocate, have<br \/>\n\tprayed for adjournment. In the above circumstances, it is clear that<br \/>\n\tthe petitioners have been given ample opportunity to plead their<br \/>\n\tcase, and the submission to the contrary by the learned counsel for<br \/>\n\tthe petitioners is not supported by the record. Nor is it borne out<br \/>\n\tfrom the record, as contended on behalf of the petitioners, that<br \/>\n\ttheir learned advocate did not represent their case.\n<\/p>\n<p>\tIt<br \/>\n\thas been repeatedly submitted by the learned counsel for the<br \/>\n\tpetitioners that the petitioners are ready and willing to pay the<br \/>\n\tfull amount of premium at the prevailing rate, as of today,<br \/>\n\ttherefore, this Court should direct the concerned authorities to<br \/>\n\taccept the same. This submission cannot be accepted in view of the<br \/>\n\treasons stated hereinabove. It was open to the petitioners to  have<br \/>\n\tmade an application as provided by law, to the Competent Authority,<br \/>\n\tat the relevant period of time, which has not been done, therefore,<br \/>\n\tdirections such as those sought by the petitioners cannot be issued<br \/>\n\tby this Court. The impugned order does not suffer from any<br \/>\n\tillegality or infirmity, so as to warrant interference.\n<\/p>\n<p>\tIn<br \/>\n\tview of the above discussion, and for the afore-stated reasons,<br \/>\n\tthere is no merit in the petition, which deserves to be dismissed.<br \/>\n\tIt is, accordingly, dismissed. Rule is discharged.
