JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\n \n \n\n\n \n\nDate\n: 09\/07\/2008 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.L.DAVE)<\/p>\n<p>\tThe<br \/>\nappellant \u00fd  Rajula Nagarpalika challenges the order of the learned<br \/>\nSingle Judge dated 16th January, 2008, passed in Special<br \/>\nCivil Application No.17237 of 2007 only to the extent where the<br \/>\nlearned Single Judge has awarded cost of Rs.10,000\/- to each of the<br \/>\nrespondents.\n<\/p>\n<p>\tThe<br \/>\nmain ground on which the Appeal is preferred is that the appellant is<br \/>\nfacing financial crises.\n<\/p>\n<p>\tWe<br \/>\nhave heard learned advocate Mr.R.V.Desai. Apart from his peripheral<br \/>\narguments, his main argument relating to the Appeal is that the<br \/>\nappellant is facing financial crises and that the respondents-workmen<br \/>\nwere represented by Union. Except that the quantum is on higher side,<br \/>\nlearned advocate Mr.Desai is unable to point out any element of<br \/>\narbitrariness in the order of the learned Single Judge awarding<br \/>\ncosts.\n<\/p>\n<p>\tA<br \/>\nplain reading of the order impugned makes it clear that the learned<br \/>\nSingle Judge was inclined to award costs and quantified it at<br \/>\nRs.10,000\/- for each workman keeping in mind that it was the third<br \/>\nround of litigation that the workmen were required to face.  In our<br \/>\nopinion, the amount of costs awarded by the learned Single Judge<br \/>\ncannot be in any manner considered to be either arbitrary or on<br \/>\nhigher side.\n<\/p>\n<p>\tSo<br \/>\nfar as poor financial condition of the appellant is concerned, that<br \/>\npart seems to have been taken care of by the learned Single Judge<br \/>\nwhen he says that the amount may be paid even by instalments. Under<br \/>\nthe circumstances, the award of costs being an order to the<br \/>\ndiscretion of the Court, and no arbitrariness having been found, this<br \/>\nCourt, as an appellate Court, would not interfere with the same.\n<\/p>\n<p>\tThe<br \/>\nAppeal, therefore, must fail.
