Shah for respondent<br \/>\nNo. 1 that a Court Commissioner be appointed and panchnama of suit<br \/>\nland be drawn and same be placed on record of this Court.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above consensus, learned District Judge, Surat, is<br \/>\ndirected to appoint a member of the staff as Court Commissioner to<br \/>\ndraw panchnama of the suit land together with map. The Court<br \/>\nCommissioner is directed to carry out the commission work after<br \/>\ninforming learned advocates for the parties intimating them about the<br \/>\ntime and date of commission work  to enable them to remain present at<br \/>\nthe time of commission work. The cost of commission work shall be<br \/>\nborne by the parties.\n<\/p>\n<p>\t\tAs<br \/>\nregards remuneration, learned District Judge is at liberty to pass<br \/>\nappropriate orders. The Court Commissioner is directed to submit the<br \/>\nreport on or before 26.10.2010.\n<\/p>\n<p>\t\tIn<br \/>\nview of the above, the order of stay passed by the appellate Court<br \/>\nearlier to continue till then.
