KALAM, RESIDENT OF VILLAGE BISHAMHARA, P.S.\nSHERGARH, DISTRICT MATHURA (U.P.) ---- PETITIONER\n                                     Versus\n                            THE STATE OF BIHAR\n                                    -----------\n<\/pre>\n<p>2     22.12.2010                 Petitioner is an accused in a case under Sections 379<\/p>\n<p>                     and 411 of the Indian Penal Code.\n<\/p>\n<p>                                 It is alleged that the petitioner ran away with the<\/p>\n<p>                     tractor of the informant which was recovered at Durgawati police<\/p>\n<p>                     station.\n<\/p>\n<p>                                 Learned counsel for the petitioner submits that<\/p>\n<p>                     surprisingly the F.I.R. was not instituted at Durgawati police<\/p>\n<p>                     station where the alleged recovery was made nor is there any<\/p>\n<p>                     station diary entry to indicate that the tractor was recovered at<\/p>\n<p>                     Durgawati police station. The F.I.R. has been lodged at the place<\/p>\n<p>                     from where the tractor was stolen. There is no explanation by the<\/p>\n<p>                     petitioner for driving away with the tractor and as such, I am not<\/p>\n<p>                     inclined to grant bail to the petitioner for the present.
