PATTANAIK\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    WITH<br \/>\n\t TRANSFER PETITION (C) NOs. 384-396 OF 1996<br \/>\n\t\t\t O R D E R<br \/>\n     It is  rather unfortunate and we feel that every Indian<br \/>\ncitizen would  feel ashamed  of the  fact that\tnot even  on<br \/>\nsports-person out  of the huge population of 94 crores would<br \/>\nfind a\tplace in the victory stand in the Olympic Games 1996<br \/>\nheld at Atlanta. Instead, all these Associations are busy in<br \/>\nthe court  proceedings and  spending  their  spirit  on\t the<br \/>\nlitigation instead  of inculcating  spirit of  sports in the<br \/>\ntrack and  field. These\t cases are  some  instances  of\t the<br \/>\ndeplorable state  of affairs.  But, it is heartening to note<br \/>\nthat all  of them  have agreed\tfor the\t settlement  of\t the<br \/>\ndisputes  in  terms  of\t Rule  XIX  of\tthe  Indian  Olympic<br \/>\nAssociation Rules which reads as under:\n<\/p>\n<blockquote><p>     &#8220;Settlement  of  Disputes\/Conflicts<br \/>\n     in\t    the\t     National\t  Sports<br \/>\n     Federations\/State\t\t Olympic<br \/>\n     Associations\n<\/p><\/blockquote>\n<blockquote><p>     (i)  All\t   National\t  sports<br \/>\n     federations\/     Associations\/State<br \/>\n     Olympic Associations  affiliated to<br \/>\n     I.O.A.  shall   include  in   their<br \/>\n     Constitution a  provision that  the<br \/>\n     Federations\/   Associations   would<br \/>\n     have   all\t   unresolved\tdisputes<br \/>\n     settled by\t the I.O.A.,  and  their<br \/>\n     Members shall voluntarily surrender<br \/>\n     their right  of seeking  redress in<br \/>\n     any Court or Law.\n<\/p><\/blockquote>\n<blockquote><p>     (ii) Every Member\tshall be  deemed<br \/>\n     to continue  its membership  of the<br \/>\n     I.O.A. on\tthe  specific  condition<br \/>\n     that it  voluntarily surrenders its<br \/>\n     right of  seeking\tredress\t in  any<br \/>\n     Court of Law.\n<\/p><\/blockquote>\n<blockquote><p>     (iii)   All   unresolved\tdisputes<br \/>\n     arising within  the National Sports<br \/>\n     Fedrations\/Associations\/State<br \/>\n     Olympic Association  affiliated  to<br \/>\n     the IOA,  shall be\t referred by the<br \/>\n     Federations\/Associations to the IOA<br \/>\n     for settlement by the IOA. For this<br \/>\n     purpose, the IOA Executive Council,<br \/>\n     on recommendation\tof the president<br \/>\n     IOA, shall recommend 9 names to the<br \/>\n     disputing parties,\t to  select  one<br \/>\n     name,   consultation    with    the<br \/>\n     president IOA,  which is acceptable<br \/>\n     to\t  both\t  the\t parties.    The<br \/>\n     Arbitration  proceedings  shall  be<br \/>\n     completed\t within\t   the\t  period<br \/>\n     specified\tby   the  IOA  Executive<br \/>\n     Council. President\t IOA,  based  on<br \/>\n     the circumstances\tof the case, has<br \/>\n     the authority  to extend,\tor vary,<br \/>\n     the period.\n<\/p><\/blockquote>\n<blockquote><p>     (IV) In the  even of  an unresolved<br \/>\n     dispute within  an affiliated  Unit<br \/>\n     of IOA by Member, and which affects<br \/>\n     normal  working  to  the  Unit,  or<br \/>\n     prevents preparation  and\ttraining<br \/>\n     of the  sport\/team under the charge<br \/>\n     of\t the   Unit  for   purposes   of<br \/>\n     international\t representation\/<br \/>\n     Competition,  the\t IOA   Executive<br \/>\n     Council will  constitute an  ad-hoc<br \/>\n     body from within the Members of the<br \/>\n     General   Assembly,   as\tmay   be<br \/>\n     necessary until  the dispute within<br \/>\n     the Unit is resolved.\n<\/p><\/blockquote>\n<blockquote><p>     (v)  All disputes\tbetween National<br \/>\n     Sports Federations\/Associations and<br \/>\n     the IOA,  or within the IOA itself,<br \/>\n     will be  dealt  with  in  the  same<br \/>\n     manner as laid down in (iii) above.<\/p><\/blockquote>\n<p>     In the  furtherance thereof  the  Annual  General\tBody<br \/>\nmeeting of IOA held on November 29, 1995 decided as under:\n<\/p>\n<blockquote><p>     &#8220;Dispute\tin   Federations\/Olympic<br \/>\n     Associations<br \/>\n     Regarding the  disputes  in  Indian<br \/>\n     Triathlon Federation, Uttar Pradesh<br \/>\n     Olympic  Association   and\t J  &amp;  K<br \/>\n     Olympic\tAssociation    Dr.    B.<br \/>\n     Sivanthi  Adityan\tstated\tthat  he<br \/>\n     would appoint a tow or three member<br \/>\n     Committee which  will be  requested<br \/>\n     to submit\tits  report  before  the<br \/>\n     next Executive  Council meeting  of<br \/>\n     the IOA.\n<\/p><\/blockquote>\n<blockquote><p>     Decision:\n<\/p><\/blockquote>\n<blockquote><p>     The   President,\t IOA,\tis    to<br \/>\n     constitute a  two or  three  member<br \/>\n     committee to  look into all aspects<br \/>\n     or\t  disputes    and   submit   its<br \/>\n     recommendations\t   for\t     the<br \/>\n     consideration  of\t the   Executive<br \/>\n     Council IOA.<\/p><\/blockquote>\n<p>     In the  light of  the above  decision,  we\t direct\t the<br \/>\nPresident of  IOA to  flow the\tprocedure prescribed in Rule<br \/>\nXIX referred  to hereinbefore,\tin particular  clauses\t(i),\n<\/p>\n<p>(ii) and  (iii) and  appoint and  Arbitration Board in terms<br \/>\nthereof.\n<\/p>\n<p>     The Transfer Petitions are accordingly disposed or. All<br \/>\nthe suits  are transferred  to\tthe  Arbitration  Board.  No<br \/>\ncosts.\n<\/p>\n<p>     In view  of the  order passed  by us on 4.11.1996, Shri<br \/>\nRanjit Kumar,  learned counsel\thas  appeared  for  all\t the<br \/>\nrespondents though  he states  that he\tdid not\t receive any<br \/>\ninstruction from  any  one  of\tthem.
