PUBLIC PROSECUTOR for\nRespondent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE H.B.ANTANI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 29\/07\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>1.\t\tThis<br \/>\nis an application preferred under Section 439 of the Code of Criminal<br \/>\nProcedure by the applicant who came to be arrested in connection with<br \/>\nCR No. I-180 of 2009  registered at  Vidyanagar  Police Station for<br \/>\nthe offence punishable under Sections 406, 420, 409, 467, 468 and<br \/>\n114  of the IPC.\n<\/p>\n<p>2.\t\tHeard<br \/>\nthe learned Advocate for the applicant and the learned APP  as well<br \/>\nas learned Advocate Mr R R Marshall for the complainant  at length<br \/>\nand in great detail.   Learned Advocate for the complainant, at the<br \/>\noutset, submitted that the applicant has paid substantial amount<br \/>\nwhich has been misappropriated as on today.  However, an amount of<br \/>\nRupees One Lakh is already paid to him by way of cheque  but the same<br \/>\nis not deposited or realised till today.   However, considering the<br \/>\nfact that the substantial amount which has been misappropriated has<br \/>\nalready been paid, I am of the view that the applicant deserves to be<br \/>\nenlarged on bail taking into account the role   attributed to the<br \/>\napplicant as reflected in the FIR, police papers as well as  the<br \/>\nprovisions of the aforesaid sections, quantum of punishment and the<br \/>\ngravity of offence etc. Hence the application is allowed. The<br \/>\napplicant is ordered to be enlarged on bail in connection with<br \/>\naforesaid offences on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount to the satisfaction<br \/>\nof the Trial Court and subject to the conditions that he shall:\n<\/p>\n<p>[a]\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty;\n<\/p>\n<p>[b]\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>[c]\tsurrender<br \/>\nhis passport, if any, to the lower Court within a week;\n<\/p>\n<p>[d]\tnot<br \/>\nleave the State of Gujarat without the prior permission of the<br \/>\nSessions court concerned;\n<\/p>\n<p>[e]\tmark<br \/>\nhis presence at the concerned Police Station on any day of every<br \/>\nfirst week of English calendar month between 9.00 AM and 2.00 PM.<br \/>\ntill the trial is over;\n<\/p>\n<p>[f]\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>[g]\tmaintain<br \/>\nlaw and order.\n<\/p>\n<p>3.\t\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or to take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>4.\t\tBail<br \/>\nbond to be executed before the lower Court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>5.\t\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>6.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\tDirect Service is<br \/>\npermitted.\n<\/p>\n<p>\t\t\t\t\t\t\t\t[H.B.ANTANI,<br \/>\nJ.]<\/p>\n<p>msp<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Amit vs State on 29 July, 2010 Author: H.B.Antani,&amp;Nbsp;
