BASANT, J.\n\n           ````````````````````````````````````````````````````\n                   Tr.P.(Crl) No. 29 OF 2008\n           ````````````````````````````````````````````````````\n             Dated this the 29th day of April, 2008\n\n                             O R D E R\n<\/pre>\n<p>           Application for transfer. Petitioner faces indictment<\/p>\n<p>in a prosecution for the offences punishable under section<\/p>\n<p>377 read with 511 IPC. The trial has already commenced.<\/p>\n<p>Some witnesses were examined.\n<\/p>\n<p>     2.    At that stage, the petitioner went before the<\/p>\n<p>Sessions court to complain that he may not get justice at the<\/p>\n<p>hands of the presiding officer.            The said application for<\/p>\n<p>transfer was dismissed by the learned Sessions Judge by a<\/p>\n<p>detailed order, a copy of which is produced as Annexure-A2.<\/p>\n<p>     3.    His application for transfer having been dismissed<\/p>\n<p>by the learned Sessions Judge, the petitioner has come<\/p>\n<p>before this Court now with a prayer that there may be a<\/p>\n<p>direction for transfer.\n<\/p>\n<p>     4.    What is the ground for transfer? It is contended<\/p>\n<p>TPCR.29\/08<br \/>\n<span class=\"hidden_text\">                               : 2 :<\/span><\/p>\n<p>that the matter has been settled between the parties but the<\/p>\n<p>learned Magistrate     is refusing to accept such settlement.<\/p>\n<p>The learned Magistrate is insisting that the witnesses must<\/p>\n<p>conform to their statements given in the case diary. It is in<\/p>\n<p>these circumstances that the petitioner reiterates the prayer<\/p>\n<p>for transfer of the case.\n<\/p>\n<p>      5.   I have gone through the order passed by the<\/p>\n<p>learned Sessions Judge. I find the learned Sessions Judge<\/p>\n<p>has considered all the aspects of the matter.              The<\/p>\n<p>apprehension of the petitioner, who admittedly was not<\/p>\n<p>present on the date of examination of the witnesses, that the<\/p>\n<p>witnesses were intimidated by the Magistrate to compel them<\/p>\n<p>to conform to their case diary statements was found by the<\/p>\n<p>learned Sessions Judge to be without any basis or merit.<\/p>\n<p>      6.   I totally concur with the conclusion of the learned<\/p>\n<p>Sessions Judge. There is absolutely no merit to sail to a<\/p>\n<p>conclusion that the apprehension of the petitioner that he may<\/p>\n<p>not get justice at the hands of the learned Magistrate who is<\/p>\n<p>TPCR.29\/08<br \/>\n<span class=\"hidden_text\">                              : 3 :<\/span><\/p>\n<p>now trying the case has any substance. I am satisfied, in<\/p>\n<p>these circumstances, that this petition deserves to be<\/p>\n<p>dismissed.   The learned Magistrate        evidently was not<\/p>\n<p>prepared to accept the composition of a non-compoundable<\/p>\n<p>offence and that appears to be prompting the petitioner to<\/p>\n<p>make these applications for transfer.<\/p>\n<p>     7.
