NO. 127 OF 2009\n            = = = = = = = = = = = = = = =\n        Dated this the 31st day of March, 2010.\n\n                      J U D G M E N T\n<\/pre>\n<p>     This is an appeal preferred against the order of the<\/p>\n<p>Workmen&#8217;s Compensation Commissioner, Ernakulam in<\/p>\n<p>W.C.C. 53\/06.     The Compensation Commissioner fixed a<\/p>\n<p>compensation of Rs.75,375\/- with 12% from the date of<\/p>\n<p>accident. It is against the grant of interest from the date of<\/p>\n<p>accident the appeal is preferred.     The insurance company<\/p>\n<p>would contend that since the amount is determined only by<\/p>\n<p>way of passing an award the interest shall be paid only from<\/p>\n<p>that date and not from the date of accident.<\/p>\n<p>     2.    Learned counsel also relies upon the rulings of the<\/p>\n<p>Hon&#8217;ble Supreme Court in that regard. A Division Bench of<\/p>\n<p>this Court in National Insurance Co. Ltd. Rekha 2007<\/p>\n<p>(4) KLT 386 has considered this point elaborately taking<\/p>\n<p>into consideration the later two judges Bench decision of the<\/p>\n<p>M.F.A.. 127 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:2:-<\/span><\/p>\n<p>Hon&#8217;ble Supreme Court as well as the Constitution Bench<\/p>\n<p>decision of the Supreme Court and had arrived at a decision<\/p>\n<p>that interest is payable from the date of accident.       The<\/p>\n<p>Division Bench in Rekha&#8217;s case referred to the Constitution<\/p>\n<p>Bench decision of the Hon&#8217;ble Supreme Court in <a href=\"\/doc\/1640530\/\">Pratap<\/p>\n<p>NarainSingh Deo v. Shrinivas Sabata (AIR<\/a> 1976 SC<\/p>\n<p>222) and also the later two judges Bench decision of the<\/p>\n<p>Hon&#8217;ble Supreme Court and held that when there is a conflict<\/p>\n<p>of decisions of the Hon&#8217;ble Supreme Court the decision of the<\/p>\n<p>Constitution Bench will prevail. Therefore in the light of the<\/p>\n<p>said dictum the Division Bench considered and held that<\/p>\n<p>interest is liable to be paid from the date of accident.<\/p>\n<p>Following these decisions the Himachal Pradesh High Court<\/p>\n<p>also in the decision reported in <a href=\"\/doc\/1415098\/\">New India Assurance<\/p>\n<p>Company v. Budh Ram and<\/a> another(2009(4) TAC 614)<\/p>\n<p>(HP) held that the entitlement is from the date of accident.<\/p>\n<p>The said decision is extracted as follows.<\/p>\n<p>M.F.A.. 127 OF 2009<br \/>\n<span class=\"hidden_text\">                              -:3:-<\/span><\/p>\n<p>          &#8221;The Constitutional Bench had already<\/p>\n<p>          decided   the   question     as   to   when<\/p>\n<p>          compensation falls due in terms of the<\/p>\n<p>          Workmen&#8217;s     Compensation      Act,  1923.\n<\/p>\n<p>          Unfortunately,   this    decision   of  the<\/p>\n<p>          Constitution Bench was not brought to the<\/p>\n<p>          notice of the Apex Court while deciding<\/p>\n<p>          National   Insurance    Company     Ltd.  v.\n<\/p>\n<p>          Mubasir Ahmed and another, 2007 ACJ 845:<\/p>\n<p>          2007(2) TAC 3. Therefore, I feel that this<\/p>\n<p>          Court is bound by the judgment rendered<\/p>\n<p>          by the Constitutional Bench of the Apex<\/p>\n<p>          Court and I accordingly hold that the<\/p>\n<p>          compensation falls due on the date when<\/p>\n<p>          the accident takes place and in case the<\/p>\n<p>          same is not deposited within thirty days,<\/p>\n<p>          the workman is entitled to claim interest at<\/p>\n<p>          the rate of 12% per annum without having<\/p>\n<p>          to show that delay in depositing the<\/p>\n<p>          compensation    was   attributable  to  the<\/p>\n<p>          employer.   While taking this view, I am<\/p>\n<p>          supported by a Division Bench judgment of<\/p>\n<p>          the Kerala High Court reported in <a href=\"\/doc\/636231\/\">National<\/p>\n<p>          Insurance Company Ltd. V. Rekha,<\/a> 2008<\/p>\n<p>          ACJ 886.&#8221;\n<\/p>\n<p>M.F.A.. 127 OF 2009<br \/>\n<span class=\"hidden_text\">                                -:4:-<\/span><\/p>\n<p>     So in the light of the Constitution Bench decision of the<\/p>\n<p>Supreme Court and the dictum laid down in Rekha&#8217;s case it<\/p>\n<p>has to be held that interest is payable from the date of<\/p>\n<p>accident. This is what is precisely done by the Compensation<\/p>\n<p>Commissioner and therefore the appeal lacks merit and the<\/p>\n<p>same is dismissed.\n<\/p>\n<\/p>\n<p>                           M.N.
