Advocate\n\nHon'ble Imtiyaz Murtaza,J.\n<\/pre>\n<p>Hon&#8217;ble Shri Kant Tripathi,J.\n<\/p>\n<p>Heard \u00a0 learned \u00a0 counsel \u00a0 for \u00a0 the \u00a0 petitioners \u00a0 and \u00a0 also \u00a0 learned \u00a0 A.G.A.\u00a0<br \/>\nappearing\u00a0for\u00a0the\u00a0State\u00a0authorities.\n<\/p>\n<p>By\u00a0means\u00a0of\u00a0this\u00a0petition,\u00a0the\u00a0petitioners\u00a0have\u00a0prayed\u00a0for\u00a0the\u00a0relief\u00a0of\u00a0a\u00a0<br \/>\nwrit\u00a0of\u00a0certiorari\u00a0quashing\u00a0the\u00a0F.I.R.\u00a0in\u00a0case\u00a0crime\u00a0no.652\u00a0of\u00a02009\u00a0under\u00a0<br \/>\nsection\u00a0364\u00a0IPC\u00a0P.S.\u00a0Massoorie\u00a0Distt\u00a0Ghaziabad.\n<\/p>\n<p>Attention\u00a0is\u00a0drawn\u00a0to\u00a0the\u00a0Full\u00a0Bench\u00a0of\u00a0this\u00a0court\u00a0in\u00a0Ajit\u00a0Singh\u00a0@\u00a0Muraha\u00a0<br \/>\nv.\u00a0State\u00a0of\u00a0U.P.\u00a0and\u00a0others\u00a0(2006\u00a0(56)\u00a0ACC\u00a0433)\u00a0in\u00a0which\u00a0this\u00a0Court\u00a0<br \/>\nreiterated\u00a0the\u00a0view\u00a0taken\u00a0by\u00a0the\u00a0earlier\u00a0Full\u00a0Bench\u00a0in\u00a0Satya\u00a0Pal\u00a0v.\u00a0State\u00a0<br \/>\nof\u00a0U.P.\u00a0and\u00a0others\u00a0(2000\u00a0Cr.L.J.\u00a0569)\u00a0that\u00a0there\u00a0can\u00a0be\u00a0no\u00a0interference\u00a0<br \/>\nwith\u00a0the\u00a0investigation\u00a0or\u00a0order\u00a0staying\u00a0arrest\u00a0unless\u00a0cognizable\u00a0offence\u00a0is\u00a0<br \/>\nnot\u00a0ex\u00adfacie\u00a0discernible\u00a0from\u00a0the\u00a0allegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0or\u00a0<br \/>\nthere\u00a0is\u00a0any\u00a0statutory\u00a0restriction\u00a0operating\u00a0on\u00a0the\u00a0power\u00a0of\u00a0the\u00a0Police\u00a0to\u00a0<br \/>\ninvestigate\u00a0a\u00a0case\u00a0as\u00a0laid\u00a0down\u00a0by\u00a0the\u00a0Apex\u00a0Court\u00a0in\u00a0various\u00a0decisions\u00a0<br \/>\nincluding\u00a0State\u00a0of\u00a0Haryana\u00a0v.\u00a0Bhajan\u00a0Lal\u00a0and\u00a0others\u00a0(AIR\u00a01992\u00a0SC\u00a0604)\u00a0<br \/>\nattended \u00a0 with \u00a0 further \u00a0 elaboration \u00a0 that \u00a0 observations \u00a0 and \u00a0 directions\u00a0<br \/>\ncontained\u00a0in\u00a0Joginder\u00a0Kumar&#8217;s\u00a0case\u00a0(Joginder\u00a0Kumar\u00a0v.\u00a0State\u00a0of\u00a0U.P.\u00a0<br \/>\nand\u00a0others\u00a0(1994)\u00a04\u00a0SCC\u00a0260\u00a0contradict\u00a0extension\u00a0to\u00a0the\u00a0power\u00a0of\u00a0the\u00a0<br \/>\nHigh\u00a0Court\u00a0to\u00a0stay\u00a0arrest\u00a0or\u00a0to\u00a0quash\u00a0an\u00a0F.I.R.\u00a0under\u00a0Article\u00a0226\u00a0and\u00a0the\u00a0<br \/>\nsame \u00a0 are \u00a0 intended \u00a0 to \u00a0 be \u00a0 observed \u00a0 in \u00a0 compliance \u00a0 by \u00a0 the \u00a0 Police, \u00a0 the\u00a0<br \/>\nbreach\u00a0whereof,\u00a0it\u00a0has\u00a0been\u00a0further\u00a0elaborated,\u00a0may\u00a0entail\u00a0action\u00a0by\u00a0way\u00a0<br \/>\nof \u00a0 departmental \u00a0 proceeding \u00a0 or \u00a0 action \u00a0 under \u00a0 the \u00a0 contempt. \u00a0 The \u00a0 Full\u00a0<br \/>\nBench\u00a0has\u00a0further\u00a0held\u00a0that\u00a0it\u00a0is\u00a0not\u00a0permissible\u00a0to\u00a0appropriate\u00a0the\u00a0writ\u00a0<br \/>\njurisdiction \u00a0 under \u00a0 Article \u00a0 226 \u00a0 of \u00a0 the \u00a0 constitution \u00a0 as \u00a0 an \u00a0 alternative \u00a0 to\u00a0<br \/>\nanticipatory\u00a0bail\u00a0which\u00a0is\u00a0not\u00a0invocable\u00a0in\u00a0the\u00a0State\u00a0of\u00a0U.P.\u00a0attended\u00a0with\u00a0<br \/>\nfurther\u00a0observation\u00a0that\u00a0what\u00a0is\u00a0not\u00a0permissible\u00a0to\u00a0do\u00a0directly\u00a0cannot\u00a0be\u00a0<br \/>\ndone\u00a0indirectly.\u00a0\n<\/p>\n<p>The\u00a0learned\u00a0counsel\u00a0for\u00a0the\u00a0petitioners\u00a0has\u00a0not\u00a0brought\u00a0forth\u00a0anything\u00a0<br \/>\ncogent\u00a0or\u00a0convincing\u00a0to\u00a0manifest\u00a0that\u00a0no\u00a0cognizable\u00a0offence\u00a0is\u00a0disclosed\u00a0<br \/>\nprima\u00a0facie\u00a0on\u00a0the\u00a0allegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0or\u00a0that\u00a0there\u00a0was\u00a0<br \/>\n any\u00a0statutory\u00a0restriction\u00a0operating\u00a0on\u00a0the\u00a0police\u00a0to\u00a0investigate\u00a0the\u00a0case.\n<\/p>\n<p>Having\u00a0scanned\u00a0the\u00a0allegations\u00a0contained\u00a0in\u00a0the\u00a0F.I.R.\u00a0the\u00a0Court\u00a0is\u00a0of\u00a0the\u00a0<br \/>\nview \u00a0 that \u00a0 the \u00a0 allegations \u00a0 in \u00a0 the \u00a0 F.I.R. \u00a0 do \u00a0 disclose \u00a0 commission \u00a0 of\u00a0<br \/>\ncognizable \u00a0 offence \u00a0 and \u00a0 therefore \u00a0 no \u00a0 ground \u00a0 is \u00a0 made \u00a0 out \u00a0 warranting\u00a0<br \/>\ninterference\u00a0by\u00a0this\u00a0Court.\u00a0The\u00a0petition\u00a0is\u00a0accordingly\u00a0dismissed.<br \/>\nOrder Date :- 4.1.2010<br \/>\nMH\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Malika And Others vs State Of U.P.
