The<br \/>\nrespondents were not consumers of the petitioner company.  The<br \/>\npetitioner company issued bill for Rs. 4,62,516.98 calling upon the<br \/>\nrespondents to make payment.  The respondents failed to make payment<br \/>\nand therefore the company issued notices.  Thereafter, the petitioner<br \/>\ncompany filed Special Civil Suit No. 314 of 1995 in the Court of<br \/>\nCivil Judge (Senior Division), Surat for recovery of the amount with<br \/>\ninterest but the same was dismissed on 27.03.2008.  It is the case of<br \/>\nthe petitioner company that the company was not informed about the<br \/>\ndismissal of the suit and therefore there was a delay of about 135<br \/>\ndays in preferring restoration application being Delay Application<br \/>\nNo. 75 of 2008. The delay application was dismissed by the trial<br \/>\ncourt and hence the present petition is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Sinha, learned advocate appearing for the petitioner company has<br \/>\nsubmitted that the petitioner is a company constituted by the<br \/>\nGovernment of Gujarat in exercise of the powers under the Gujarat<br \/>\nElectricity Industry (Re-organisation &amp; Regulation) Act, 2003.<br \/>\nHe has submitted that the impugned order dismissing the suit for<br \/>\ndefault was not brought to the knowledge of the petitioner by the<br \/>\nlearned advocate for the petitioner before the trial court and<br \/>\ntherefore there was a delay in filing the restoration application.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Thakkar, learned advocate appearing for the respondents has supported<br \/>\nthe order of the trial court and submitted that the delay is not<br \/>\nrequired to be condoned in view of the fact that the petitioner being<br \/>\na company was represented by an advocate and therefore it would not<br \/>\nbe appropriate for the petitioner to submit that they were not aware<br \/>\nabout the order dismissing the suit.\n<\/p>\n<p>5.\tThis<br \/>\ncourt has heard learned advocates for either side and perused the<br \/>\npapers on record.  The trial court has rejected the delay condonation<br \/>\napplication on the ground that the petitioner did not file the<br \/>\nrestoration application within limitation period and that even the<br \/>\napplication for certified copy was made on 18.06.2008.  The trial<br \/>\ncourt has found that no plausible explanation was given while filing<br \/>\nthe delay condonation application<br \/>\nwhich is true.\n<\/p>\n<p>5.1\tIt<br \/>\nis pertinent to note that the petitioner company is a<br \/>\nstatutory authority constituted under the Electricity Act.  It is<br \/>\nwell settled that on account of an<br \/>\nimpersonal machinery and the inherited bureaucratic methodology<br \/>\nimbued with the note making, file pushing and passing on the buck<br \/>\nethos, delay on the part of such statutory body is less difficult to<br \/>\nunderstand though more difficult to approve.  In that view of the<br \/>\nmatter, this court is of the opinion that the approach of the Courts<br \/>\nmust be to do even-handed justice on merits in preference to the<br \/>\napproach which scuttles a decision on merits.\n<\/p>\n<p>6.\tIt<br \/>\nis also required to be noted that due to such a conduct of the<br \/>\npetitioner company, great inconvenience has been caused to the<br \/>\nrespondents as well. In that view of the matter, this court is of the<br \/>\nopinion that interest of justice will be served if<br \/>\nthe delay is condoned on payment of appropriate costs by the<br \/>\npetitioner company.\n<\/p>\n<p>6.\tAccordingly,<br \/>\nthe delay of 135 days caused in filing the restoration<br \/>\napplication before the trial court is hereby condoned on condition<br \/>\nthat the petitioner company pays cost of Rs. 7500\/- to the<br \/>\nrespondents by way of an account payee cheque within a period of two<br \/>\nweeks from today.  The trial court shall hear the restoration<br \/>\napplication on merits after the cost is paid to the respondents and<br \/>\npass order accordingly.
