Justice S.SIRI JAGAN\n\n Dated :28\/11\/2008\n\n O R D E R\n                            S.SIRI JAGAN, J.\n\n                    ==================\n\n                     W.P(C).No.34617 of 2008\n\n                    ==================\n\n           Dated this the 28th day of November, 2008\n\n                            J U D G M E N T\n<\/pre>\n<p>      The petitioners are owners of flats in an apartment complex<\/p>\n<p>viz., &#8220;White Castle&#8221; at Edappally. Their grievance is that the 1st<\/p>\n<p>respondent Panchayat has demolished part of the apartment<\/p>\n<p>complex and is taking further steps to demolish more of the<\/p>\n<p>same. The petitioners submit that this is being done without any<\/p>\n<p>notice or hearing to the petitioners. The petitioners, therefore,<\/p>\n<p>seek the following reliefs:\n<\/p>\n<blockquote><p>     &#8220;i)   Issue a Writ of Mandamus or any other appropriate writ, order<br \/>\n           or direction directing the respondent No.2 to issue a copy of<br \/>\n           order authorizing demolition of any structure in the premises of<br \/>\n           the residential apartment White Castle and provide the<br \/>\n           petitioners an ample opportunity to hem to show cause against<br \/>\n           the order of demolition.\n<\/p><\/blockquote>\n<blockquote><p>      ii)  Issue a Writ of Mandamus or any other appropriate writ, order<br \/>\n           or direction directing the respondents to keep in abeyance the<br \/>\n           order for demolishing any structure in the premises of the<br \/>\n           residential apartment White Caste at Edappally till the<br \/>\n           petitioners are herad in the matter.&#8221;<\/p><\/blockquote>\n<p>      2.   The learned Standing Counsel appearing for the 1st<\/p>\n<p>respondent-Panchayat submits that complaints were received to<\/p>\n<p>the effect that the area earmarked for car parking has been used<\/p>\n<p>for construction of flats and therefore, notice was issued to the<\/p>\n<p><span class=\"hidden_text\">w.p.c.34617\/08                    2<\/span><\/p>\n<p>original owner of the apartment complex, who realising that the<\/p>\n<p>construction is unauthorised, demolished the portion himself and<\/p>\n<p>the Panchayat has not demolished any building. The Standing<\/p>\n<p>Counsel further submits that if any demolition is actually<\/p>\n<p>undertaken by the Panchayat, that would only be after issuing<\/p>\n<p>notice to all the affected and hearing them.
