JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/06\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\npetition, under Article 226 of the Constitution of India, has been<br \/>\nfiled with the following prayers:-\n<\/p>\n<p>&#8220;[A]\t&#8220;YOUR<br \/>\nLORDSHIPS TO admit and allow this petition.\n<\/p>\n<p>[B]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to issue a write of mandamus or writ in<br \/>\nthe nature of mandamus or any other writ order and or direction u\/s<br \/>\n226 of the constitution of India appropriate writ and or order, your<br \/>\nLordships may be pleased to hold and declare that the petitioner was<br \/>\ndirectly appointed as Accountant from 01\/04\/1980 and that he is<br \/>\nentitled for his revised pension and revised 4th higher<br \/>\npay scale from on 01\/01\/1986 and other retirement benefits and all<br \/>\nconsequential benefits on the post of Accountant carried at the<br \/>\nrelevant time.\n<\/p>\n<p>[C]\t&#8220;YOUR<br \/>\nLORDSHIPS To issue direction to<br \/>\nthe respondents to releases all consequential<br \/>\nretrial benefits taking the entire service of the petitioner from<br \/>\n01\/04\/1980 to 31\/07\/1988 as continuous on the basis of judgment and<br \/>\norder has passed in special civil application no. 10408 of 2009 said<br \/>\norder is passed on 30\/09\/2009 here it is also marked as Annexure-G<br \/>\nand order passed in special<br \/>\ncivil application no.6992 of 2002 on  09\/03\/2006 here it is also<br \/>\nmarked as Annexure-H.\n<\/p>\n<p>[D]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to Any other relief which is suitable<br \/>\nand necessary in the circumstances of this case be granted.\n<\/p>\n<p>[E]\t&#8220;YOUR<br \/>\nLORDSHIPS may be pleased to the cost of this petition be<br \/>\ngranted.&#8221;\n<\/p>\n<p>2.\tAt<br \/>\nthe very outset, Ms. Tejal K. Shah, learned counsel for the<br \/>\npetitioner states that the interest of justice would be met, if<br \/>\nrespondent No.1 is directed to consider and decide representation<br \/>\ndated 03.05.2011 (Annexure-&#8216;F&#8217;
