Labour<br \/>\n Cotirt, Banigajdre, in I.1:).No.64\/2005 Dt.27.08.2o0&#8217;7 placed at<br \/>\n&#8216;Ani1cx\u00a5S.'&#8221;&#8216;&#8211;7\u00a3&#8217;d the  petition. in so far as denial of the backwagcs<\/p>\n<p>  increments, etc.,.\n<\/p>\n<p>&#8220;&#8216;The.s\u00a7c&#8217;  Petitions coming on for  Hearing &#8216;B&#8217;<\/p>\n<p>  j\ufb01fmup thisjday, the Court made the following:<\/p>\n<p>S2_B_Q_E.B<\/p>\n<p>  both the Writ Petitions, an award datcd 27*&#8221; August<\/p>\n<p> am in I.D.No.6~&#8217;~\u00a5\/2005 is called in question by both the<\/p>\n<p>Management as well as the workman.\n<\/p>\n<p>,w~&#8217;<\/p>\n<p><span class=\"hidden_text\">-3-<\/span><\/p>\n<p>2. W.P.No.20140\/2007 is \ufb01led by the Corporation.<\/p>\n<p>W.P.No. 159812008 is \ufb01led by the Workman.<\/p>\n<p>3. The Corporation has questioned the awarcl<\/p>\n<p>the setting aside of the order of punishment and   <\/p>\n<p>reinstate back into service whereas, tl1e&#8221;ivorlenian.;hnVs bquiestioned b T it<\/p>\n<p>the order on preliminary issue and   <\/p>\n<p>continuity of service and consequential bene\ufb01ts:   <\/p>\n<p>4. By article of    the &#8220;Corporation<br \/>\nalleged that, the worl@anVV_got._VtL&#8217;ii.eVl  on the basis of<br \/>\nfalse Transfer  to   &#8216;o.p1eointment to the post<\/p>\n<p>of I-ielmr-B    the employment is in<\/p>\n<p>violationilvof e3au.se-43 (9) of the Karnataka State Road<\/p>\n<p>Transport  Recruitment) Regulations, 1982.<\/p>\n<p>   his zeply dated 10.7.2003 denied the<\/p>\n<p> _  an enquiry was held. Before the Enquiry<\/p>\n<p>O\ufb01ieei&#8217;; *3_veitr1esses were examined on behalf of the<\/p>\n<p> &#8216;Corporation. ll\ufb02orkxnan also got himself examined. The Enqu1Iy&#8217;<\/p>\n<p>  on the evidence gave a \ufb01nding that the charge is<\/p>\n<p> Therea\ufb01er, the Disciplinary Authority passed an order of<\/p>\n<p>T  The order of dismissal was called in question by the<\/p>\n<p>i it x worlman before the Appellate Authority. The appeal was also<\/p>\n<p>dismissed. Thereafter, the Workmazi raised a dispute under<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>Section 10(4~A) of the Industrial Disputes Act. The Labour Court<br \/>\nheld that the enqxiixy is fair and proper and it is also held\u00bb that<br \/>\ncharge is proved. However, on consideration of the<br \/>\npassed. by the Corporation and also on consideration<br \/>\ndismissal order is not based on unsnitahility<br \/>\nperformance of the duties by<br \/>\nCorporation to reinstate the  ..se;rvice;:l&#8217;<br \/>\nhowever, denied the backweges  ihenei\ufb01ts.<\/p>\n<p>6. Learned Counsel   the Corporation<br \/>\nsubmitted that, in&#8217; the  it is speci\ufb01cally<\/p>\n<p>mentioned     produced the Transfer<br \/>\nCerti\ufb01ca.te&#8217;t&#8217;ohfla  as ?l\\&#8221;I\u00a3i.t1hu1*ay&#8217;s Sri Namperumal<br \/>\nHigh schoei. )mder\u00a7o;;p\u00a2t;v.\u00a7\u00a7;es,E.&#8221; and the workman has replied<\/p>\n<p>to the same. it However,   reply. he has not stated that, he<\/p>\n<p>&#8216;seas  in iithgmad school, but in turn, has only denied<\/p>\n<p>the ~el1e&#8211;ged that. the xerox copy is produced and the<\/p>\n<p>   ozigizlhaleeiisv  gnoduced. It is also submitted that, the<\/p>\n<p> f;oIpo;re&#8217;1tion.AV MW~1 &#8212; Security O\ufb01cezr, who made the<\/p>\n<p> * ig\u00e9eseggeen and in support of the cause, clerk of the said school<\/p>\n<p>I\u00bb   examined as MW&#8211;~2, who has stated that, the register<\/p>\n<p>T &#8220;n\ufb01inber pertaining to the Workman mentioned in the Transfer<\/p>\n<p>it  Certi\ufb01cate does not belong to that school and does not pertain to<\/p>\n<p>the petitioner. It is also submitted that, for the first time, the<br \/>\nGa)&#8217;<\/p>\n<p>.5-\n<\/p>\n<p>workman produced Ex.Wi before the Labour Court showing that<br \/>\nhe had studied in Government High School, Yeshwanthput upto<\/p>\n<p>8th standard and this document was neither produced heto1_e~.the<\/p>\n<p>Enquiry O\ufb01cer nor was referred to in the reply  <\/p>\n<p>charges or in the evidence of the workman. It is  that,&#8221; 2 <\/p>\n<p>once the enquiry is heid as fair and  the&#8217;:ou1\ufb01&#8217;que_et\u00a7o\ufb01<\/p>\n<p>that, the Labour Court could coneidet&#8217;  as   ;<\/p>\n<p>\ufb01ndings of the Enquiry Gt\ufb01ceu&#8217;  orig there is<br \/>\nvictimization or unfair  is  etridence on<br \/>\nthe perversity of the fmdiugst  uo of victimization<br \/>\nand there is no e*\u00a2ic;te:iee as to  practice. The<\/p>\n<p>Labour Court hot.   Ex.W1. which was<\/p>\n<p>produced for the  the Labour Court. It is further<\/p>\n<p>submitted that;  has committed an error in<\/p>\n<p>_looking the Vsaidiceniticate to find out the suitability of the<\/p>\n<p>   in the post. It is also submitted that,<\/p>\n<p>O\ufb01cer or before the Appellate Authority,<\/p>\n<p>&#8216;  nowhere. the  took a stand that, he studied in the<\/p>\n<p>hi &#8221; &#8216;:4A&#8217;\u00a3&#8217;:o&#8217;veI&#8217;u,ment  Schoo}, Yeshwanthpur.<\/p>\n<p>&#8212;   ;?.&#8217;iiLea;&#8217;ned Counsel appearing for the Workman submitted<\/p>\n<p>  &#8216;  &#8221; as against the article of charges, reply was given and in the<\/p>\n<p> &#8216;deeply. he speci\ufb01cahy denied the alleged charge Even in the<\/p>\n<p>evidence before the Enquixy Omcer. he speci\ufb01cally stated that.<\/p>\n<p>13?&#8217;<\/p>\n<p>-\\<\/p>\n<p>.5-\n<\/p>\n<p>the documents produced by the Corporation are only xerox<br \/>\ncopies and shoulct not have been relied by the Enqui1yh_O\ufb01eer.<br \/>\nHe also submitted that, the original dooument.$a..VV_:&#8217;a1_:e~ not<\/p>\n<p>produced. He further submitted that, the is<\/p>\n<p>marked in the evidence shows that the  in\u00bb <\/p>\n<p>Government High School, Yeshwanthpur:    h&#8217;<\/p>\n<p>is not looked into by the Labour  . E~ie subitiittegi  that,<\/p>\n<p>Labour Court was not jus\ufb01\ufb01ed   .er1qhi1Sjas fair and<br \/>\nproper. He submits no optforttmity before<br \/>\nthe Enquixy O\ufb01cer nor  the documents,<br \/>\ndespite the Labour   is fair and proper.<br \/>\nHe further   Vworkzman has admitted<br \/>\nthat, he  referred to in the article of<\/p>\n<p>charges he   document showing the school<\/p>\n<p>in whieh the  had studied is produced before the<\/p>\n<p>   as Ex.W}. In such circumstances. the Labour<\/p>\n<p>  in giving a \ufb01nding that, the charge is<\/p>\n<p>    &#8216;weebnot justi\ufb01ed in holding that, the enquiry is fair<\/p>\n<p>  It is not in dispute that the worlmaan had replied to the<\/p>\n<p>T  of charges. It is also not in dispute that the Worlman had<\/p>\n<p>&#8216;4 A. not avaiied the opportunity given to him to engage a co&#8211;worker.<\/p>\n<p>Fmm the proceedings before the Enquiry O\ufb01cer. it is clear that<\/p>\n<p>2%&#8217;<\/p>\n<p>\/&#8217;<\/p>\n<p>-7,<\/p>\n<p>he had an opportunity to cross-examine the Management<br \/>\nwitnesses. From Annexure-B, it is aiso clear that, on 2&#8242;?&#8217;L8,2003,<br \/>\nthe copies of the documents produced by the Eweure<\/p>\n<p>furnished to the workman. From the pxoceedingshof Z  <\/p>\n<p>O\ufb01oer, it is clear that the wor1o:aet3iA&#8221;had &#8216;_  T. <\/p>\n<p>participated in the pt-eeeettittge eee,%eeet : cros$eerta:niti:ec1T&#8217;t.he<br \/>\nwimesses and further has _theA.eviden_oe,_J<br \/>\nthere is any jus\ufb01\ufb01ca\ufb01oo to  the&#8217; &#8216;v\ufb02ndthg on the<br \/>\npre1J&#8217;.1nin.ary issue by the .&#8217;i:Ls&#8217;~.Ve&#8217;,\u00a3:&#8217;:,,::&#8221;_h()*;::I_{V:o1Is.<\/p>\n<p>9. The Latent    is proved. Only<\/p>\n<p>on the  &#8211;oiIt%i1iif;stax1ces the Corporation has<\/p>\n<p>   _  in this case. a major<br \/>\npunishment teh impo$et1&#8242;,&#8217;&#8211;~ moulded the relief. While<\/p>\n<p>moulding the&#8221;re_1ie\ufb01, Est eteetoeetee to Ex.W14, a Circular which<\/p>\n<p> V&#8217;  \u00abease  Worknnan is con\ufb01rmed in the sexvice, he<\/p>\n<p>  and further obsezves that the nemova}<\/p>\n<p>of  was not on the ground of unsuitability or<\/p>\n<p> &#8220;&#8216;*\u00a7l!1sati&#8217;s\u00a3aoto:&#8217;V5I performance. It further observes that, the<\/p>\n<p>   O\ufb01cer has heid that the charge is pmved only on the<\/p>\n<p>  that, the Workman has stated that he has studied in<\/p>\n<p> t h L eu-\n<\/p>\n<p> ezen so 00 {Egg}<\/p>\n<p>10. It is not in dispute that, once the enquixy is held fair<br \/>\nand proper, the Labour Court is required to   the<\/p>\n<p>documents and evidence produced before the  for<\/p>\n<p>the purpose of \ufb01nding out the perversity or  orithe <\/p>\n<p>unfair labour practice. Even in case; _1e:ad V<\/p>\n<p>\ufb02esh evidence, on opport1mity..shou:1d.hs.ire been<br \/>\nCorporation and in this case,i&#8221;foir&#8217;.t11ev. The<\/p>\n<p> tion &#8216;  by the Corporation is that, enquiry&#8217; is<\/p>\n<p>  rinitiateo&#8217;  removal of originals fmm. the \ufb01le and further submits<br \/>\n   xerox copies are maintain&#8217; ed by the Corporation. Since<br \/>\n ___&#8221;&#8216;i:&#8221;the,;&#8217;e is dispute as regard to the correctness of the documents<\/p>\n<p>&#8216;4&#8243;V.u}iroduced by the Corporation and if the workman is able to<\/p>\n<p>satisfy that the \ufb01ndings of the Enquiry O\ufb01icer based on these<\/p>\n<p>documents are perverse, the Labour Court should consider the<\/p>\n<p>(,..\n<\/p>\n<p><span class=\"hidden_text\">-9-<\/span><\/p>\n<p>same. If the Corporation wants to rely on those documents, it<br \/>\ncan prove the some by producing additional evidence. ifcany. In<br \/>\nmy opinion, the \ufb01nding of the Labour Court having&#8221; that<br \/>\nthe charge is proved and moulding the relief on of<\/p>\n<p>suitabi\ufb01ty was not justified.\n<\/p>\n<p>12. Since both the worlcman  i\u00e9feli<br \/>\nhave questioned the \ufb01ndings of _Labo&#8217;._uf   it<br \/>\nappropriate to remit the V_matterV_for&#8221; eoi1&#8217;sid.eA1&#8217;a?,ion Without<\/p>\n<p>expressiiig any opinion oxi&#8221; \ufb01ie .disp%.1{\ufb01&#8221;qi1e$4;:ion.<\/p>\n<p>Aooording1y&#8217;,&#8217;:!:io&#8217;th   Pe\ufb01\ufb01gns partly allowed. The<br \/>\naward datedi&#8217;2&#8217;7*%*&#8212;  &#8220;I[,D,No.64; 2005 is quashed.<br \/>\nHoweveezthc . issue is con\ufb01rmed.
