JUSTICE M.VENUGOPAL\n\nM.P.No.2 of 2010\nin\nC.M.A SR.7279 OF 2009\n\n\n\nORDER\n<\/pre>\n<p>\tIt transpires from the Affidavit filed by Selection Grade Assistant Manager (Legal) on behalf of the Petitioner\/Transport Corporation in M.P.2 of 2010 that the relevant certified copies of Award, etc., have been made ready by the Lower Court Office on 20.07.2007 and thereafter, the Petitioner\/Corporation sought an opinion from the Panel Advocate during the month of August 2007 and after obtaining the legal opinion, the relevant papers have been placed before the Appeal Committee for approval and later, the Petitioner&#8217;s counsel misplaced the papers in the office and after tracing out the same, during the Third week of January 2009, the present Appeal has been filed with a delay of 105 days.\n<\/p>\n<p>\t2. The Respondent has been served as early as on 01.07.2010, but today there is no representation on his behalf either in person or through counsel.\n<\/p>\n<p>i\n<\/p>\n<p>\t3. Taking note of the fact that the Petitioner has attributed the delay in preferring an Appeal owing to the complaint with administrative exigencies and also the Lower Court Counsel misplacing the papers in the office inadvertently etc., this Court on being subjectively satisfied as to the reasons ascribed thereto in the interest of justice by taking a liberal view  allows this petition by directing the Petitioner to pay a sum of Rs.150\/- (Rupees One hundred and Fifty only) to The Tamil Nadu Mediation and Conciliation Centre, Chennai within a period of six weeks from the date of receipt of a copy of this order failing which it is made clear that the petition would stand automatically dismissed without any further reference to this Court.\n<\/p>\n<p>vri<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Madras High Court It Transpires From The Affidavit &#8230; vs Unknown on 27 July, 2010 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 27.07.2010 CORAM THE HON&#8217;BLE MR.
