M. SAHAI)<\/p>\n<p>\tWe<\/a><br \/>\n\thave heard Mr. S. C. Sharma, learned counsel for the petitioner.\n<\/p>\n<p>\tThis<br \/>\n\tpetition has been filed for the following reliefs :-\n<\/p>\n<p>&#8220;[A]\tThis<br \/>\nHon&#8217;ble Court may be pleased to admit this Special Civil Application;\n<\/p>\n<p>[B]\tThis<br \/>\nHon&#8217;ble Court may be pleased to allow this Special Civil Application<br \/>\nby issuing a writ of mandamus or any other writ, or order or<br \/>\ndirection to quash and set aside the impugned Tender No. C 78\/2nd<br \/>\ncomp FSLR \/ 59831 \/ 11 passed by the respondent no.1 at Annexure A<br \/>\ntill the final dispute of the petitioner and respondents pending<br \/>\nbefore the arbitrator in the interest of justice or thereby<br \/>\npermitting and allowing the petitioner to run business of<br \/>\ntransportation of parcels as per the agreement dated 1.6.2010 on<br \/>\nappropriate and suitable condition in the interest of justice;\n<\/p>\n<p>[C]\tBe<br \/>\npleased to issue appropriate writ, order or direction \/ and directing<br \/>\nthe respondent to reconsider the case of the petitioner forthwith;<br \/>\nand <\/p>\n<p>[D]\tDuring<br \/>\nthe pendency and final hearing of this petition, be pleased to stay<br \/>\nthe operation, implementation, execution of the impugned Tender No. C<br \/>\n78\/2nd comp FSLR \/ 59831 \/ 11 passed by the respondent<br \/>\nno.1 at Annexure A till the final dispute of the petitioner and<br \/>\nrespondents pending before the arbitrator in the interest of<br \/>\njustice.&#8221;\n<\/p>\n<p>\tThe<br \/>\n\tcounsel for the petitioner has urged that though he has moved an<br \/>\n\tapplication before the respondents invoking arbitration clause, but<br \/>\n\ttill date, Arbitrator has not been appointed.  Arbitrator is<br \/>\n\tappointed under the provisions of Arbitration &amp; Conciliation<br \/>\n\tAct, 1996.  The petitioner should seek his remedy under the<br \/>\n\tprovisions of Arbitration &amp; Conciliation Act, 1996.  This Court<br \/>\n\tcannot issue any direction that till the arbitration proceedings are<br \/>\n\tpending, the petitioner should be permitted to work.\n<\/p>\n<p>This<br \/>\n\tpetition is dismissed with liberty to the petitioner to take<br \/>\n\trecourse under the provisions of Arbitration &amp; Conciliation Act,<br \/>\n\t1996.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[V.
