(ORAL)\n<\/pre>\n<p>            Petitioner is aggrieved against order dated 15.12.2008 passed<\/p>\n<p>by the Court of Judicial Magistrate Ist Class, Amritsar. The order has been<\/p>\n<p>attached as Annexure P-4. Same read as under:-\n<\/p>\n<blockquote><p>                   &#8220;Heard. Complainant has suffered a statement on 5.2.08<\/p>\n<p>            that he does not agree with the cancellation report submitted by<\/p>\n<p>            local police in court. In view of the statement of complainant,<\/p>\n<p>            he does not agree with the investigation conducted by police.<\/p>\n<p>            However, accused filed petition u\/s 482 Cr.P.C. And the<\/p>\n<p>            Hon&#8217;ble High Court has not quashed the FIR. So as per the<\/p>\n<p>            submissions made by the complainant, present cancellation<br \/>\n Crl.Misc.No.M-3418 of 2009                                        [2]<\/p>\n<p>            report is returned to the officer-in-charge of Police Station &#8216;C&#8217;<\/p>\n<p>            Division to investigate the matter\/case and to submit his report<\/p>\n<p>            positively as earlier as possible.&#8221;\n<\/p>\n<p>            Counsel for the petitioners has made three-fold submissions. It<\/p>\n<p>has been submitted that Magistrate could not order re-investigation and<\/p>\n<p>could not specify any person as Investigating Officer, therefore, the<\/p>\n<p>Magistrate has committed an error by saying that Officer-in-charge of<\/p>\n<p>Police Station &#8216;C&#8217; Division to investigate the matter. Thirdly, it has been<\/p>\n<p>stated that the Court of Judicial Magistrate Ist Class has been swayed by the<\/p>\n<p>fact that the petition under Section 482 Cr.P.C. was dismissed.<\/p>\n<p>            Be that as it may, without going into the controversy involved,<\/p>\n<p>order Annexure P-4 is set aside and the Judicial Magistrtae Ist Class,<\/p>\n<p>Amritsar is directed to decide the matter afresh by taking into consideration<\/p>\n<p>the investigation and the statement made by the complainant on 5.2.2008.<\/p>\n<p>            What should be the procedure which should be followed by the<\/p>\n<p>Court of Judicial Magistrate Ist Class was considered and dealt with by this<\/p>\n<p>Court in Criminal Misc.No.M-4542 of 2008, titled `<a href=\"\/doc\/1710553\/\">Malkiat Singh<\/p>\n<p>Dhaliwal v. Manpreet Kaur Dhaliwal and<\/a> another&#8217;, decided on 6.1.2009.<\/p>\n<p>This Court while placing reliance upon a Division Bench judgment of<\/p>\n<p>Allahabad High Court in Pakhandu and others v. State of U.P. And<\/p>\n<p>another, 2002 Crl.L.J. 1210 held as under:-\n<\/p>\n<blockquote><p>                   &#8220;I am of the view that such a course is not open to the<\/p>\n<p>            Sub Divisional Judicial Magistrate. Reliance can be placed<\/p>\n<p>            upon &#8216;Pakhandu and others v. State of U.P. and another&#8217;<\/p>\n<p>            2002 Crl. L.J. 1210, where a similar controversy arose and a<\/p>\n<p>            reference was made to a Division Bench. The Division Bench,<br \/>\n Crl.Misc.No.M-3418 of 2009                                       [3]<\/p>\n<p>            after considering the entire conspectus of case law, held as<\/p>\n<p>            under:\n<\/p><\/blockquote>\n<blockquote><p>                     &#8220;15. From the aforesaid decisions, it is thus clear<br \/>\n                   that where the Magistrate receives final report the<br \/>\n                   following four courses are open to him and he may<br \/>\n                   adopt any one of them as the facts and<br \/>\n                   circumstances of the case may require:-<br \/>\n                     (I)    He may agreeing with the conclusions<br \/>\n                   arrived at by the police, accept the report and<br \/>\n                   drop the proceedings.      But before so doing, he<br \/>\n                   shall given an opportunity of hearing to the<br \/>\n                   complainant: or<br \/>\n                     (II)   He may take cognizance under Section 190<br \/>\n                   (1) (b) and issue process straightway to the<br \/>\n                   accused without being bound by the conclusions of<br \/>\n                   the investigating agency, where he is satisfied that<br \/>\n                   upon the facts discovered or unearthed by the<br \/>\n                   police, there is sufficient ground to proceed; or<br \/>\n                     (III) he may order further investigation, if he is<br \/>\n                   satisfied that the investigation was made in a<br \/>\n                   perfunctory manner, or<br \/>\n                     (IV) he may, without issuing process or dropping<br \/>\n                   the proceedings decide to take cognizance under<br \/>\n                   Section 190 (1)(a) upon the original complaint or<br \/>\n                   protest petition treating the same as complaint and<br \/>\n                   proceed to act under Sections 200 and 202,<br \/>\n                   Cr.P.C. and thereafter decide whether complaint<br \/>\n                   should be dismissed or process should be issued.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>                     16.    Where the Magistrate decides to take<br \/>\n                   cognizance of the case under Section 190 (1)(b) of<br \/>\n                   the Code ignoring the conclusions arrived at by<br \/>\n                   the investigating agency and applying his mind<br \/>\n                   independently to the facts emerging from the<br \/>\n Crl.Misc.No.M-3418 of 2009                                         [4]<\/p>\n<p>                   investigation records, in such a        situation the<br \/>\n                   Magistrate is not bound to follow the procedure<br \/>\n                   laid down in Sections 200 and 202 of the Code,<br \/>\n                   and consequently the proviso to Section 202 (2),<br \/>\n                   Cr.P.C. will have no application.             It would<br \/>\n                   however be relevant to mention that for forming<br \/>\n                   such an independent opinion the Magistrate can<br \/>\n                   act only upon the statements of witnesses recorded<br \/>\n                   by the police in the case diary and other material<br \/>\n                   collected during investigation. It is not permissible<br \/>\n                   for him at that stage to make use of any material<br \/>\n                   other than investigation records, unless he decides<br \/>\n                   to take cognizance under Section 190 (1) (a) of the<br \/>\n                   Code and calls upon the complainant to examine<br \/>\n                   himself and the witnesses present if any under<br \/>\n                   Section 200.\n<\/p><\/blockquote>\n<blockquote><p>                   17.    A plain reading of sub-section (2) of Section<br \/>\n                   202 with the proviso attached thereto makes it<br \/>\n                   clear that question of applying the proviso will<br \/>\n                   arise only in cases where the Magistrate before<br \/>\n                   taking cognizance of the case opts to hold the<br \/>\n                   inquiry. This matter was thoroughly examined by<br \/>\n                   the Apex Court in the latest decision in Rosy v.<br \/>\n                   State of Kerala, (2000) 1 JT (SC) 84 : (AIR 2000<br \/>\n                   SC 637).&#8221;\n<\/p><\/blockquote>\n<p>This view has been further reiterated by Allahabad High Court in &#8216;Surya<\/p>\n<p>Bhan v. State of U.P. and another&#8217; 2007 Crl. L.J. 2230.<\/p>\n<p>             Copy of the order passed in Malkiat Singh Dahliwal&#8217;s case<\/p>\n<p>(supra) be also sent to the Court of Judicial Magistrate Ist Class, Amritsar.<\/p>\n<p>The trial Court while taking into consideration the the guide-lines spelt out<\/p>\n<p>in Malkiat Singh Dhaliwal&#8217;s case (supra) will pass a fresh order within 15<\/p>\n<p>days from he date of receipt of a certified copy of the order.\n<\/p>\n<pre> Crl.Misc.No.M-3418 of 2009                          [5]\n\n            Petition is disposed off.\n\n\n\n                              ( KANWALJIT SINGH AHLUWALIA )\nMarch 17, 2009.
