SANKARAN,J.\n                          --------------------------------------\n                         W.P.(C) No.10392 OF 2008 K\n                          --------------------------------------\n                    Dated this the 11th day of August, 2008.\n\n                                 J U D G M E N T\n<\/pre>\n<p>                 The petitioner states that he is a physically challenged person<\/p>\n<p>having 50% disability.   He was provisionally appointed as Lab Assistant          &#8211;<\/p>\n<p>Agriculture, under Rule 9(a)(1) of Kerala State &amp; Subordinate Service Rules<\/p>\n<p>through the Divisional Employment Exchange, Thiruvananthapuram. He was<\/p>\n<p>working as Lab Assistant &#8211; Agriculture in the Government Vocational Higher<\/p>\n<p>Secondary School, Vakkam for the period from 2.11.1998 to 22.4.1999. The<\/p>\n<p>Government     issued   Ext.P6    order      dated      30.11.2007 providing regular<\/p>\n<p>appointment to handicapped persons who were earlier appointed in provisional<\/p>\n<p>service through Employment Exchange. The district wise list was appended to<\/p>\n<p>the Government Order. Petitioner&#8217;s name is also included in the list as Sl.No.20<\/p>\n<p>for Thiruvananthapuram District. Going by Ext.P6 order, the petitioner is entitled<\/p>\n<p>to get appointment in the next arising vacancy. It is also provided in Ext.P6 that<\/p>\n<p>if there is no existing vacancy, appointment should be made towards the 3%<\/p>\n<p>vacancies reserved for handicapped persons.<\/p>\n<p>                     2.   The reliefs prayed for in the Writ Petition are the<\/p>\n<p>following:-<\/p>\n<pre>\n\nWP(C) No.10392\/2008\n\n\n<span class=\"hidden_text\">                                            2<\/span>\n\n                                        (i)      issue a  writ   of\n\n<\/pre>\n<p>                   mandamus or any other appropriate writ or<\/p>\n<p>                   order directing the respondents to reappoint<\/p>\n<p>                   the petitioner as Lab Assistant &#8211; Agriculture in<\/p>\n<p>                   the Vocational Higher Secondary Education<\/p>\n<p>                   Department at the earliest and within a<\/p>\n<p>                   definite time frame;\n<\/p>\n<\/p>\n<p>                                        (ii)     Issue a  writ   of<\/p>\n<p>                   mandamus or any other appropriate writ or<\/p>\n<p>                   order directing the respondents to create<\/p>\n<p>                   supernumerary post for reappointing the<\/p>\n<p>                   petitioner if it is necessary;\n<\/p>\n<\/p>\n<p>                                        (iii)    Issue a  writ   of<\/p>\n<p>                   certiorari or any other writ or order quashing<\/p>\n<p>                   Exhibit P7 after calling for records leading<\/p>\n<p>                   thereto; and<\/p>\n<p>                                        (iv)     Pass such   other<\/p>\n<p>                   orders as are deemed fit and necessary in the<\/p>\n<p>                   interest of justice and for proper and effective<\/p>\n<p>                   adjudication of the case.&#8221;\n<\/p>\n<\/p>\n<p>                3.        A counter affidavit is filed on behalf of the<\/p>\n<p>respondents wherein it is stated as follows:-<\/p>\n<p>WP(C) No.10392\/2008<\/p>\n<p><span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>                                     &#8220;5.     It is submitted that<\/p>\n<p>                   consequent to the promulgation of VHSE<\/p>\n<p>                   Special Rules, 4th respondent had reported all<\/p>\n<p>                   the existing vacancies of Lab Assistant to PSC<\/p>\n<p>                   for permanent appointment.       That has been<\/p>\n<p>                   done long before the publication of the list of<\/p>\n<p>                   candidates    eligible  for   reappointment    by<\/p>\n<p>                   Government. Consequent to the reporting of<\/p>\n<p>                   vacancies PSC had already conducted the<\/p>\n<p>                   selection test and published the main list. In<\/p>\n<p>                   this circumstance 4th respondent is not in a<\/p>\n<p>                   position to appoint the petitioner due to lack of<\/p>\n<p>                   vacancies. Since all the existing vacancies had<\/p>\n<p>                   already been reported to PSC for permanent<\/p>\n<p>                   appointment     VHSE     department    have    no<\/p>\n<p>                   authority to direct the PSC to stop the selection<\/p>\n<p>                   procedures.     As per GO(MS) No.232\/71\/PD<\/p>\n<p>                   dated 12.8.1971 and Government Circular<\/p>\n<p>                   No.123786\/SD-5\/72\/PD dated 5.12.1972 once<\/p>\n<p>                   the vacancies are reported to the PSC they<\/p>\n<p>                   should neither be cancelled nor reduced.<\/p>\n<p>                   Public Service Commission had reminded<\/p>\n<p>                   VHSE department about this fact vide letter<\/p>\n<p>                   dated   28.9.2007     in connection    with  the<\/p>\n<p>                   appointment of Lab Assistant and certain other<\/p>\n<p>                   categories of Post. But VHSE department has<\/p>\n<p>                   no hesitation to appoint the petitioner against<\/p>\n<p>                   the newly arising vacancies of Lab Assistant.<\/p>\n<p>                   Due to the sanctioning of new VHS Schools<\/p>\n<p>                   and up gradation of existing schools in 2007<\/p>\n<p>                   there is a sure chance of creating 100 + post of<\/p>\n<p>WP(C) No.10392\/2008<\/p>\n<p><span class=\"hidden_text\">                                         4<\/span><\/p>\n<p>                    Lab Assistant in the department of Vocational<\/p>\n<p>                    Higher     Secondary     Education    and     the<\/p>\n<p>                    department will take all the efforts to appoint<\/p>\n<p>                    the petitioner in that post. It may be noted that<\/p>\n<p>                    in the GO(P) No.85\/07\/SWD dated 30.11.2007<\/p>\n<p>                    it is clearly stated that if the vacancies to<\/p>\n<p>                    accommodate the candidates eligible for re-<\/p>\n<p>                    appointment are not available in the concerned<\/p>\n<p>                    department they will be considered in the<\/p>\n<p>                    coming vacancies.&#8221;\n<\/p>\n<p>                 In view of the statement made by the respondents in the<\/p>\n<p>counter affidavit, the stand taken by the fourth respondent in Ext.P7 dated<\/p>\n<p>7.1.2008 that the petitioner would be appointed in the next arising vacancy<\/p>\n<p>cannot be faulted. Since the vacancies existing as on the date of Ext.P6 order<\/p>\n<p>were already reported, the petitioner can aspire for appointment only in the next<\/p>\n<p>arising vacancy.      Counter affidavit filed by the respondents is taken as an<\/p>\n<p>undertaking that the petitioner would be appointed in the next arising vacancy.<\/p>\n<p>                    Recording this undertaking, Writ Petition is disposed of.<\/p>\n<p>                                                      K.T.
