RAMASWAMY, D.P. WADHWA\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted. We have heard counsel on both sides.<br \/>\n     This appeal  by special  leave arises  from the interim<br \/>\norder passed by the High Court of Bombay, Nagpur Bench, made<br \/>\non February 19, 1997 in Writ Petitioner No.3520\/95.\n<\/p>\n<p>     The respondent  was appointed  on July  9, 1992  for  a<br \/>\nperiod of one year. The appointment order read as under:\n<\/p>\n<p>     &#8220;Your   appointment    is\t  purely<br \/>\n     temporary for  a period of one year<br \/>\n     from 9.7.92  to end  of Session, in<br \/>\n     the leave\/deputation\/vacancy. After<br \/>\n     expiry of\tthe  above  period  your<br \/>\n     service  shall   stand   terminated<br \/>\n     without any notice.&#8221;\n<\/p>\n<p>     Subsequently,  on\t appointment  was   given   to\t the<br \/>\nrespondent as  indicated in the order of the Division Deputy<br \/>\nDirector of Education (Genl), dated May 19, 1994 sent on May<br \/>\n21, 1995 which reads as under:\n<\/p>\n<blockquote><p>     &#8220;That due\tto refusal  of\tsanction<br \/>\n     and  provision   from   the   State<br \/>\n     Government for the year 1993-94, no<br \/>\n     sanction was  granted for any class<br \/>\n     on grant-in-aid  basis. Information<br \/>\n     to all  Heads of  Schools should be<br \/>\n     sent  through  Deputy  Director  of<br \/>\n     Education,\t   Education\t Officer<br \/>\n     (Secondary)      and      Education<br \/>\n     Inspector, Bombay.&#8221;<\/p><\/blockquote>\n<p>     Thus, it  could be\t seen that  for the year 1993-94, no<br \/>\nappointment came  to be made. The respondent filed an appeal<br \/>\nin the Tribunal for direction. The Tribunal held that he had<br \/>\nbeen appointed\tagainst a  permanent vacancy  and  the\tHead<br \/>\nMaster has  no authority to pass an order of termination. In<br \/>\nthe face  of the appointment order, such finding recorded by<br \/>\nthe Tribunal  is clearly  unwarranted. When  a writ petition<br \/>\nwas filed  seeking suspension  of the  order, the High Court<br \/>\nvacated\t  the order  of stay  made in the impugned order. In<br \/>\nthe aforestated\t facts, the case was clearly for the stay of<br \/>\nTribunal order pending disposal of the writ petition.\n<\/p>\n<p>     The appeal\t is accordingly\t allowed. The  order of\t the<br \/>\nHigh Court  stands set aside.
