No.32858 of 2011\n                            Kundan Kumar Mishra son of Ram Naresh Mishra\n                                                  Versus\n                                          The State Of Bihar\n                                                -----------\n<\/pre>\n<p>2.   12.10.2011                Heard learned Counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                              The petitioner seeks bail in a case instituted for the<\/p>\n<p>                  offence under Sections 364, 120B and 379 of the Indian Penal<\/p>\n<p>                  Code and 27 of the Arms Act.\n<\/p>\n<p>                              Considering that there is no explanation for delay in<\/p>\n<p>                  complaint and the petitioner is in custody since 26.7.2011<\/p>\n<p>                  having fair antecedents, let the petitioner above named, be<\/p>\n<p>                  released on bail on furnishing bail bond of Rs. 5,000\/-(Five<\/p>\n<p>                  thousand) with two sureties of the like amount each or any<\/p>\n<p>                  other surety to be fixed by the court concerned to the<\/p>\n<p>                  satisfaction of learned C.J.M., Muzaffarpur in connection with<\/p>\n<p>                  Complaint case No.1382 of 2010, subject to the conditions (i)<\/p>\n<p>                  That one of the bailor shall be the father of the petitioner and<\/p>\n<p>                  the other bailor will be a close relative of the petitioner who<\/p>\n<p>                  will give an affidavit giving genealogy as to how he is related<\/p>\n<p>                  with the petitioner. The bailor will undertake to furnish<\/p>\n<p>                  information to the Court about any change in address of the<\/p>\n<p>                  petitioner. (ii) That the affidavit shall clearly state that the<\/p>\n<p>                  petitioner is not an accused in any other case and if he is he<\/p>\n<p>                  shall not be released on bail, (iii) That the bailor shall also<\/p>\n<p>                  state on affidavit that he will inform the court concerned if the<br \/>\n<span class=\"hidden_text\">                                   -2-<\/span><\/p>\n<p>            petitioner is implicated in any other case of similar nature after<\/p>\n<p>            his release in the present case and thereafter the court below<\/p>\n<p>            will be at liberty to initiate the proceeding for cancellation of<\/p>\n<p>            bail on ground of misuse, (iv) That the petitioner will be well<\/p>\n<p>            represented on each date if he fails to do so on two<\/p>\n<p>            consecutive dates, his bail will be liable to be cancelled.<\/p>\n<pre>Narendra\/                       ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Kundan Kumar Mishra vs The State Of Bihar on 12 October, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
