Mathur &amp; Markandey Katju\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>MARKANDEY KATJU, J.\n<\/p>\n<p>1.\tThese appeals have been filed against the final judgment and orders of<br \/>\nthe Karnataka High Court dated 15.2.2001 in W.P. Nos. 11728-755\/2000,<br \/>\nCW W.P. Nos. 11701-11727\/2000 &amp; W.P. No. 10723\/2000.\n<\/p>\n<p>2.\tHeard learned counsel for the parties and perused the record.\n<\/p>\n<p>3.\tThe appellants before us filed O.A. Nos. 1040\/1998, 1055-1081\/1998<br \/>\netc.  before the Central Administrative Tribunal, Bangalore Bench seeking a<br \/>\ndirection to quash Rule 6(4)(a) of the Defence Research &amp; Development<br \/>\nOrganization, Technical Cadre Recruitment Rules, 1995 (hereinafter referred<br \/>\nto as the Rules) as being violative of Article 14 &amp; 16 of the Constitution,<br \/>\nand for a direction to place the applicants\/appellants in grade II of category<br \/>\nII with effect from 26.8.1995 with all consequential benefits.\n<\/p>\n<p>4.\tThe applicants (appellants before us) were Chargemen grade II in the<br \/>\nservice of the Union of India, Ministry of Defence.  The Union of India<br \/>\nintroduced the aforesaid Rule on 26.8.1995. We are, however, only<br \/>\nconcerned with Rule 6(4)(a) which states as under:\n<\/p>\n<p>(4)  (a).  All persons holding the posts of Chief Glass Blower,<br \/>\nArtist-cum-Photographer, Commercial Artist, Junior Scientific<br \/>\nAssistant Grade I, Chargeman Grade II and Draughtsman Grade<br \/>\nII shall be placed in grade 2 of category II provided that they<br \/>\npossess the qualifications prescribed for recruitment to the<br \/>\ngrade of Technical Assistant A as laid down in Schedule III<br \/>\nfailing which they shall be placed in grade 4 of category I.\n<\/p>\n<p>NOTE:  For this purpose, the existing incumbents of the posts<br \/>\nof Draughtsman Grade II, possessing a certificate or a diploma<br \/>\nin Draughtsmanship of a minimum duration of one year shall<br \/>\nbe deemed to possess the required qualifications  <\/p>\n<p>5.\tA perusal of Rule 6(4)(a) shows that those Chargemen who possess<br \/>\nthe qualifications prescribed in Schedule III shall be placed in grade 2 of<br \/>\ncategory II while those who do not possess the same will be placed in grade<br \/>\n4 of category I.\n<\/p>\n<p>6.\tAdmittedly, the applicants\/petitioners did not possess the<br \/>\nqualifications in Schedule III to the Rules and hence they were placed in<br \/>\ngrade IV of category I.  Their  grievance is that they have been discriminated<br \/>\nagainst because before coming into force of the Rules in 1995 all<br \/>\nChargemen grade II were in the same category, while now under Rule<br \/>\n6(4)(a) the erstwhile Chargemen grade II have been divided into two<br \/>\ncategories, namely, those who possess the qualifications in schedule III and<br \/>\nthose who do not.\n<\/p>\n<p>7.\tLearned counsel for the appellants submitted that this is violative of<br \/>\nArticle 14 of the Constitution because chances of promotion of the<br \/>\nappellants have been adversely affected.\n<\/p>\n<p>8.\tWe regret we cannot agree.  It is well settled by a series of decisions<br \/>\nnow that there can be categorization on the basis of educational<br \/>\nqualifications.  The erstwhile Chargemen grade II who had the qualifications<br \/>\nmentioned in Schedule III have been placed in a higher category while those<br \/>\nlike the appellants who do not have the said qualifications have been placed<br \/>\nin the lower category.  In our opinion, there is no violation of Article 14 on<br \/>\nsuch a categorization.\n<\/p>\n<p>9.\tIt is well settled that categorization can be done on the basis of<br \/>\neducational qualifications and there will be no violation of Article 14 if this<br \/>\nis done.\n<\/p>\n<p>10.\tLearned counsel for the appellants then submitted that the<br \/>\nDraughtsmen grade II have been placed better off by the Note to Rule<br \/>\n6(4)(a) vis-`-vis the erstwhile Chargemen grade II who did not have the<br \/>\nqualifications in Schedule III.\n<\/p>\n<p>11.\tIn our opinion, this submission too has no merit.  It is well settled that<br \/>\nArticle 14 applies within the same class.  Draughtsman and Chargeman are<br \/>\ntwo different classes, and hence there is no question of discrimination<br \/>\nbetween them.\n<\/p>\n<p>12.\tFor the reasons aforementioned, there is no merit in these appeals.<br \/>\nThe appeals are accordingly dismissed.
