This matter was notified before other Hon&#8217;ble<br \/>\n\tBench, and Hon&#8217;ble Bench passed an order on 03.09.2010, which is<br \/>\n\tquoted as under:-\n<\/p>\n<p>\tThe<br \/>\nrelief prayed for by the petitioner in present petition, is in<br \/>\nfollowing terms:-\n<\/p>\n<p> 10(B)\tYour<br \/>\nLordship may be pleased to direct the respondent School Authority<br \/>\nPrincipal, Primary School, Jahagirpura, Taluka   District : Anand<br \/>\nto make correct in the School Leaving Certificate, in the column of<br \/>\nBirth Date, the correct Birth Date is 03\/05\/1966 instead of<br \/>\n01\/06\/1996.\n<\/p>\n<p>\tIn<br \/>\npresent petition, as can be seen from the aforesaid relief prayed for<br \/>\nin para 10(B), any order by Civil Court is not under challenge.<br \/>\nHence, Office is directed to take necessary steps for listing the<br \/>\nmatter before the appropriate Court.\n<\/p>\n<p>Thereafter,<br \/>\n\tmatter has been notified before this  Court. The question, which has<br \/>\n\tbeen raised by petitioner in present petition is that the date of<br \/>\n\tbirth, recorded in Birth Register is correct and date of birth<br \/>\n\trecorded in School Leaving Certificate requires to be corrected and<br \/>\n\talso the name of mother required to be included in Birth Register as<br \/>\n\tthere was no column of mother&#8217;s name, when date of birth certificate<br \/>\n\twas issued. In light of this background, petitioner has approached<br \/>\n\tCivil Court, Anand by way of Regular Civil Suit No.424 of 2009,<br \/>\n\twhich was dismissed by Civil Court, Anand on 31.07.2010.\n<\/p>\n<p>Learned<br \/>\n\tAGP Ms.Jirga Jhaveri appearing on behalf of respondent   State<br \/>\n\tauthority submitted that when Civil Court has decided merits of the<br \/>\n\tmatter, then, present petition is not maintainable, because<br \/>\n\tpetitioner has to file first appeal before District Court under<br \/>\n\tSection 96 of CPC. This petition may not be entertained by this<br \/>\n\tCourt.\n<\/p>\n<p>I<br \/>\n\thave considered submissions made by both learned advocates. Keeping<br \/>\n\tin mind the fact that Civil Court has examined merits and then, suit<br \/>\n\thas been dismissed, it is open for petitioner to approach District<br \/>\n\tCourt by way of filing first appeal under Section 96 of CPC.
