Appeal from Order No. 512 of 2002<br \/>\n          MR SK BUKHARI for Appellant No.<br \/>\n<span class=\"hidden_text\">          &#8230;&#8230;&#8230;. for Respondent No. 1<\/span><br \/>\n          MR HN BRAHMBHATT for Respondent No. 1\/1-1\/5\n<\/p>\n<p>     &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>              CORAM : HON&#8217;BLE MR.JUSTICE K.S.JHAVERI<\/p>\n<p>     Date of decision: 01\/02\/2005<\/p>\n<p>ORAL JUDGEMENT\n<\/p>\n<p>     1.The appellant has preferred this appeal from<br \/>\n     order being aggrieved by the order dated 26\/08\/2002<br \/>\n     passed in order below application exh.5 in Special Civil<br \/>\n     Suit No.55 of 1999 by the learned 3rd Joint Civil Judge<br \/>\n     (S.D.), Ahmedabad (Rural), whereby the said application<br \/>\n     was rejected.\n<\/p>\n<p> 2.While admitting this Appeal from Order, this<br \/>\nCourt in Civil Application No.9502 of 2002 had granted<br \/>\ninterim relief in terms of Para-4(b) of the application<br \/>\nby which pending admission and final disposal of the<br \/>\nappeal, the respondents were restrained from dealing with<br \/>\nin any manner or disposing off the suit property in<br \/>\nquestion. Now, as status quo is operating, it would be<br \/>\nappropriate to direct the parties to maintain status quo<br \/>\ntill the suit pending before the said Court is finally<br \/>\ndisposed of.\n<\/p>\n<p>3.I have heard learned counsel for the parties and<br \/>\nhave perused the relevant documents on record.   In view<br \/>\nof the facts and circumstances of the case, I am of the<br \/>\nopinion that ends of justice would be met if the trial<br \/>\nCourt is directed to expedite the hearing of the said<br \/>\nsuit while continuing the interim relief granted by this<br \/>\nCourt.\n<\/p>\n<p>4.Therefore, without entering into the merits of<br \/>\nthe matter, the trial Court is directed to hear and<br \/>\ndispose of the suit being Special Civil Suit No.55 of<br \/>\n1999 pending before the Court of the learned 3rd Jt.<br \/>\nCivil Judge (S.D.), Ahmedabad (Rural) as expeditiously as<br \/>\npossible and preferably within a period of two years from<br \/>\nthe date of receipt of writ of this order.\n<\/p>\n<p>5.With the above observations and directions, the<br \/>\nAppeal from Order stands disposed of.       Parties are<br \/>\ndirected to maintain status quo till the said suit is<br \/>\nfinally disposed of. Office is directed to send writ of<br \/>\nthis order forthwith.\n<\/p>\n<p> [K. S.
